Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: Hello, I am writing to dispute a debt collection attempt from XXXX XXXX. I have the following contact information for them. XXXX. XXXX XXXX XXXX, WA XXXX ( XXXX ) XXXX-XXXX That said, my main dispute is with XXXX. They are reporting on my credit report a delinquent account, that should have been closed without fees by XXXX. I was given permission to terminate my service by XXXX, due to inadequate data speeds that were far below their advertised amounts. I tested my phone in multiple cities and states, including XXXX XXXX, XXXX and XXXX, as well as all around my state of Massachusetts. On XX/XX/XXXX - XXXX sent me an email stating they were providing me with return envelopes for my handsets. When I did not receive them for quite some time, I continued on as normal. Once receiving notice of their want for my handsets still, I contacted XXXX. On XX/XX/XXXX - I contacted XXXX via chat and an employee by the name of XXXX stated " I currently do not see return kits being sent out here online. '' At this time, she could no longer assist me and told me that my recourse was to phone a specific department. Due to a hectic schedule, I could not get to a phone to dial in and I explained this in full. I attempted to just buy the phones themselves out without being hit with a penalty, but they would not assist with that. I believe my debt with XXXX to be invalid and I believe you will find in their records or notes they have on my account that they agreed to let me out of the contract without fees. Dragging the return process for the phones on for months was an undue burden on me as a consumer and I do not believe I should be held liable for their lapse in shipping said kits. Additionally, they then sold this debt to a collection agency. I have the original email where they claimed to have sent the return envelopes and I have a copy of the chat which I have mentioned above.

Consumer Complaint: On XX/XX/2018 I send a letter via Certified Mail to XXXX XXXX XXXX to validate the debt they are claiming that I owe of {$310.00}. The original creditor is XXXX XXXX. I have no knowledge of being acquainted with XXXX XXXX or XXXX XXXX. They were unable to provide validation of the debt but they have not closed/deleted this from my credit report.

Consumer Complaint: There a some huge issues with the collection that showed up on my credit report yesterday. One, it is well beyond the statute of limitations in Florida. Also, this is for a XXXX account that my ex-husband open years ago without my knowledge or permission. XXXX recognized this and subsequently removed my responsibility for the balance owed approximately 7 years ago. I believe Convergent bought some old debt and is trying to make some money without even attempting to find out if the debt is even valid. I am in the process of buying a house for myself and my children and this just made my credit score drop 40 points!

Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: I closed a cell phone account with XXXX in XX/XX/XXXX/XX/XX/XXXX in good standing and all payments were paid in full with a XXXX balance. Since XX/XX/XXXX/XX/XX/XXXX I did not have any accounts with XXXX and I joined my husband 's phone account where all bills are under his name. Therefore, I have not had a phone bill under my name since XX/XX/XXXX/XX/XX/XXXX. Suddenly, in XX/XX/XXXX, I noticed a derogatory collection on my credit report with XXXX XXXX stating that I owed {$170.00}. I XXXX XXXX XXXX to obtain a phone number and inquire as to why I was being hit with a collection on my credit report? I was notified that the collection was with XXXX and that if I did not believe the collection was valid then I needed to contact XXXX. I contacted XXXX and gave them my information. When I went to verify information on the collection account, it was noted as an active phone line and all of the information on the cell phone account was not mine except for the name. At this time, the rerouted me to the XXXX Fraud department where I provided information by phone to a representative. After this, there was no further communication with XXXX. I then proceeded to call XXXX XXXX and let them know that the information provided to them was inaccurate and that I had not had a phone account with XXXX in 8 years. I asked for Verification of Debt to see if my information had been cross-referenced or used by someone else. Convergent told me that I had to pay the collection and never provided me with any type of documentation. Subsequently, I disputed the accuracy and legitimacy of the debt. The collection was removed twice without any statement or follow up from anyone but then it would reappear in 2-3 months. Now it is XX/XX/XXXX and XXXX XXXX is continuing to call me multiple times a day but will not leave a message or reference as to why they are calling. In addition, I never received any validation that this collection is mine and if it was legitimate, my last valid account with XXXX would have been in XX/XX/XXXX/XX/XX/XXXX which is 9-10 years later ( past the Statute of Limitations. ) I question the validity and accuracy of this collection and I would like to be provided with all information necessary so I can proceed with necessary legal action.

Consumer Complaint: Received a letter today from " XXXX XXXX '' saying that I owe a debt to them, through XXXX, of {$620.00}. That is frankly impossible, I currently have an active account with XXXX ( had it for years now ) which is auto-paid directly from my bank account every month. I also check online to make sure everything goes through, I have never missed a payment. They'd bill me before sending it to collections, I have never heard about any debt or seen anything on my ( again, *active* ) account about any outstanding debts. The debt mentioned in the letter from Convergent is obviously, and completely, false.

Consumer Complaint: I wrote to XXXX XXXX XXXX and advised them that the collection account they took over was a fraudulent account and that it was already given to two other collections agencies within the last 6 months. There were two previous complaints filed with CFPB concerning this same debt, XXXX XXXX had this account and closed it out XX/XX/2018 complaint number XXXX, XXXX XXXX also got this account shortly after and once given the FTC report closed it out on XX/XX/2011. After XXXX closed out the account Convergent picked it up. XXXX sent me a letter stating that the account was valid because it had a bill attached, a bill does not mean that the account is mine. This was an account that was fraudulently opened in my name. This bill is not mine regardless of who XXXX sells this account to. I am not going to be responsible for an account that had no knowledge of.
