Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: A company call convergent outsourcing, client service, XXXX XXXX XXXX XXXX XXXX, XXXX XXXX. They attempted to collect a debt that was originated as a fraudulent account with the XXXX XXXX XXXX XXXX, a utility company. I informed them in 2019 that this was a fraudulent account and I am not responsible for it. I filed a police report and provided them with the information. However they continued to call me daily, nonstop, sometimes twice a date to collect on the debt. In addition, the utility company itself refused to help. I asked for information on how the account was opened with out my consent, I was told thats non of my business. I find this abaolutely unacceptable both by the debt collection agency as well as the utility company.

Issue: Communication tactics
Subissue: Frequent or repeated calls
Consumer Complaint: Convergent Outsourcing calls me twice per day, every three days from two different phone numbers. They are posing as if in the XXXX, ID area. I live in Washington state. I do not have any debts in collections. All of my obligations are in current, good standing. The company never leaves a message. When I tried to speak to employees today to request my phone number to stop being called, I was put back into the waiting/hold system six times! Some employees told me that they are not allowed to leave phone messages per Federal Law ( an untrue statement ), this is a personal matter and that they can not find my " account '' via phone number. After playing their game of hold, a friendly employee finally got on the line. She looked up my phone number and said she could not find it anywhere in their system. She asked me if I have any other phone numbers, to which I said no. My cell number is my only phone number. She agreed that she would have her supervisor look my phone number and take me off of their calling list. I provided information to this company ; this company never identified the debt. I am making a formal complaint so this company will keep their word and stop calling me.

Consumer Complaint: On XX/XX/19 i transferred my XXXX account to a new account. The phone representative told the XXXX store representative that in order for them to authorize the transfer I had to pay a final balance from my old account for {$44.00}, which I paid immediately at the store. On XX/XX/2019 I received a letter from a collection agency saying that I own XXXX {$29.00}. I contacted both the collection agency and XXXX, I asked them why they never sent me a bill and why they transferred me to a collection agency if I had already paid my final balance as the representative stated on XX/XX/19 and I already started paying phone bill in the new account. The representative and the supervisor keep arguing and acting rude and sarcastic. The supervisor implied that if I don't paid the " hidden charges '' I could damage my credit. They were not professional and unable to explain why they never sent me a bill before but they just transferred me directly to a collecting agency, which makes XXXX a not reputable company, since they put their clients in risk of harming their credit fo no reason. And I can not keep paying their mistake of paying my old account and new account which will be a duplicate charge if I already paid off the final balance from the old account. What they actually want from me is making me pay twice for my phone bill which is an unfair practice.

Consumer Complaint: In response to a denial of an extension of credit, this consumer checked with one or more consumer reporting agencies and discovered the following : 1. On or about XX/XX/XXXX, Convergent Outsourcing ( hereinafter CO ) began furnishing negative information about this consumer to one or more consumer reporting agencies. ( See attached Exhibit B & C ) 2. As part of COs debt collection activities, CO furnishes information to consumer reporting agencies. As such, CO is a person or entity subject to regulation and liability under Section 623 of the Fair Credit Reporting Act ( FCRA ), which imposes a series of duties and prohibitions upon any person or entity that furnishes information to a consumer reporting agency. 3. Section 623 ( a ) ( 7 ) of the FCRA requires that persons or entities such as CO send to this consumer an initial disclosure informing this consumer that CO may report information about this consumer to one or more consumer reporting agencies. Additionally, Section 623 ( a ) ( 7 ) of the FCRA requires that this disclosure be provided to this consumer in writing, prior to, or no later than thirty days after CO furnishes the negative information about this consumer to a consumer reporting agency. 4. In connection with the furnishing of negative information about this consumer to one or more consumer reporting agencies, CO failed to disclose/notify this consumer in writing that it had furnished negative information to one or more consumer reporting agencies, a practice commonly referred to as debt parking. 5. Notice of the debt and that CO is reporting it is of particular importance to this consumer, the deprivation of which has caused this consumers character, reputation, and/or credit to be unjustly damaged. 6. The acts and practices of CO alleged within this complaint caused this consumer to send CO an initial communication on XX/XX/XXXX via certified mail, return receipt requested. ( See attached Exhibits D & F ) 7. Notwithstanding the five ( 5 ) day Notice requirement imposed upon debt collectors such as CO, in an effort to show good faith, this consumer extended CO with a period of thirty ( 30 ) days to respond to this consumers initial communication. ( See attached Exhibit A ) 8. Upon information and belief, this consumers initial communication was accepted and received by CO on or about XX/XX/XXXX. ( See attached Exhibit F ). 9. Despite this consumers efforts to extend CO with a reasonable amount of time to respond to this consumers initial communication with substantively admissible facts, it appears that CO has refused and/or failed to respond to this consumers initial communication. 10. As of the date of this complaint, CO continues to willfully and maliciously furnish negative information about this consumer to one or more consumer reporting agencies. ( See attached Exhibit B & C ) In addition to the foregoing, this consumer does not have in her possession a bonafide record of any transactions executed between CO and this consumer under the alleged account # ( # XXXX ) reflected on this consumers report. Therefore, it is reasonable for this consumer to believe that CO has falsely represented to one or more consumer reporting agencies that CO holds an account belonging to this consumer. Furthermore, in the absence of such a record, it is also reasonable for this consumer to believe that CO has used this consumers identifying information without authority to manufacture into existence the alleged account ( # XXXX ).
