Consumer Complaint: XX/XX/XXXX Letter to Wells Fargo : This letter is to follow up on the correspondence dated XX/XX/XXXX about a problem I am having with the above referenced Wells Fargo Home Mortgage account for following property : XXXX I am dissatisfied with the information XXXX XXXX provided because the correspondence indicated details of specific phone conversations with different customer service representatives, but did not address all conversations and also did not provide a solution to resolve the previous inquiry and complaint. The letter dated XX/XX/XXXX mentions only three conversations between a customer service representative and my authorized spouse. XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. All of your records indicate that XXXX XXXX was advised it was a possibility for the Forbearance Plan to break and the representative was unable to confirm that the plan would not be broken. First, I am asking you to provide me with the exact date noted on the account, that the Forbearance Plan was in deed broken. Also, can you please advise why a customer service representative cant advise of a procedure that explains if a payment plan is broken or not. I dont believe that a financial hardship and customer efforts in trying to bring the account current, should be treated with statements such as may or may notit is a possibility, but cant be promised. Is this Wells Fargos general guideline to put customers in a situation when all of a sudden no solution can be found except for paying the past due amount current all at once to avoid foreclosure? It certainly appears to be a lot more efficient for Wells Fargo to collect their money that way rather than trying to work with customers to keep the home by making certain payment arrangements. Second, I would like for you to provide a detailed explanation why the call between a customer service representative and XXXX ( as well as the witness XXXX ) on XX/XX/XXXX was omitted from your correspondence dated XX/XX/XXXX. I am sure that there is a valid reason for this. Could the reason be, that XXXX and XXXX ( who were both on this call ), received confirmation that the Forbearance Plan is still in effect and that the XXXX XXXX payment in the amount of {$4000.00} would be acceptable to continue with the Forbearance Plan? Prior to the XX/XX/XXXX conversation, on a separate call, XXXX was advised that the latest date to submit the {$4000.00} payment ( that is reflected on the Forbearance Agreement with a XX/XX/XXXX due date ) is XX/XX/XXXX ( 30 days from XX/XX/XXXX ). XXXX was told that the {$4000.00} payment by XX/XX/XXXX will be applied to the account and the Forbearance Plan would remain in effect. If we were not provided by a Customer Service representative with the XX/XX/XXXX date as the latest date to submit {$4000.00} to Wells Fargo Home Mortgage, then please advise how we came up with a date of XX/XX/XXXX by ourselves and why we submitted the payment XXXX XXXX at that time to assure that the payment will be on time? Would there have been any reason for us to do so if not instructed by a Wells Fargo Representative? During the XX/XX/XXXX phone conversation, we were advised that the {$4000.00} payment has been received, but the Forbearance Plan was broken. There was no option provided to reinstate the plan based on the fact that we were previously assured that the plan would remain in effect. Furthermore, providing our financial information again resulted in the outcome that would no longer qualify for a repayment plan. Based on the information provided by our Home Preservation Specialist, XXXX XXXX, we submitted a hardship letter, financial worksheet as well as paystubs on XX/XX/XXXX. On XX/XX/XXXX we were told that the submitted documents are not sufficient and needed to be resubmitted with signatures and dates on all documents. All documents were submitted again on XX/XX/XXXX via Fax and a Customer Service Representative confirmed the receipt on XX/XX/XXXX. She also confirmed that all documents are complete and in order. I have already attempted to resolve this problem by contacting Wells Fargo Customer Service Representatives, conversations with the Home Preservation Representative, XXXX XXXX, as well as submitting written correspondence on XX/XX/XXXX. I have enclosed copies of my records. Unfortunately, the problem remains unresolved. I am hereby requesting that you : 1 ) Review all phone conversations from XX/XX/XXXX present ( request to listen to the recorded phone conversations rather than reading the documented call notes. 2 ) Review all documents previously submitted by us to find a way to get our account back on track. 3 ) Provide an acceptable solution to resolve this issue. 4 ) Provide additional training to customer service representatives in order to assure that correct information is provided to all customers on every single phone call. Please contact me within 30 days to confirm that you will review and honor my request. I have prepared a complaint for submission to the proper agencies for investigation. I will not file the complaint if you resolve the problem within this time period I have indicated. XX/XX/XXXX Appeal to Wells Fargo : This appeal is being sent in response to the FHA Home Affordable Modification Program ( HAMP ) Trial Plan dated XX/XX/XXXX which we received on XX/XX/XXXX. We appreciate your time and consideration to find a loan modification / workout option. However, we are appealing the trial plan based on the below outlined reasons : 1. We are disputing the value of the property used in the decision. During our Mediation Meeting in XX/XX/XXXX we were advised by Wells Fargo Home Mortgage that the estimated appraisal of the house was {$240000.00}. The appraisal was done in XX/XX/XXXX. We are requesting documentation of the current appraisal used to determine the terms and conditions of the FHA Home Affordable Modification Program ( HAMP ) Trial Plan. XXXX. XXXX XXXX XXXX email dated XX/XX/XXXX which was sent to XXXX XXXX XXXX and XXXX XXXX XXXX XXXX specifically stated Before Workout and After Workout modification details. After reviewing the information provided, we determined that the amounts for P & I, Taxes and Insurance do not match the total monthly PITI in the After Workout column. 3. Consequently we would like to request full disclosure of the Net Present Value ( NPV ) information. 4. Due to the fact that we did not receive the detailed calculations for the HAMP Trial Plan, we are also asking you to provide specific information regarding the calculations of income vs. expenses used to determine the provisions of the plan. Originally we requested a loan modification or workout option which allows us to remain in our house and have my husband, XXXX assume the mortgage in place of XXXX and XXXX Therefore, we provided the income and expense information for myself and my husband, XXXX However, Wells Fargo Home Mortgage requested additional income and expense information for my father-in-lawXXXX XXXX, as well as my mother-in-law, XXXX, because both co-borrowers are listed on the mortgage. If the income and expense information foXXXX XXXX and XXXX was used in addition to my income and expenses, then the income and expense information previously provided for XXXX should not be considered in any way for the modification. We also believe that only my, XXXX, and my father-in- laws, XXXX, income was considered to determine the terms and conditions of the HAMP Trial Plan. It appears that the expenses for XXXX XXXX were not factored into the calculations. In order to determine correct modification amounts, only the following options should be considered : a. XXXX and XXXX who provide the income and expense information since XXXX is listed as borrower and XXXX husband of XXXX is a contributor. Or b. XXXX XXXX and XXXX All three parties are listed on the mortgage. In this case, all of the income and expense information provided to Wells Fargo Home Mortgage has to be taken into consideration. We are trying to understand the reason why it was declined to create an affordable mortgage payment and / or reduce our principal and interest, property taxes and hazard insurance payment by 10 % or more because Wells Fargo Home Mortgage reflects a calculated monthly income of {$16000.00}. 5. In addition, we would like to clarify the {$0.00} amount listed on the workout details for the Mortgage Insurance Premiums. We are in the understanding that our FHA loan also reflected that we have paid the Mortgage Insurance Premiums and based on those terms the Federal Housing Administration is a backstop to the banks and it is stated that if our loan ever goes into default, the FHA is there is to repay the bank 's loss. 6. We are requesting to review our loan for a reduction of the principal balance. We understand that this may be possible through the FHA Streamline Modification which is available to borrowers who owe more than the property is worth. Our existing FHA loan originated before XX/XX/XXXX and we are willing to pay possible refinancing costs upfront.

Consumer Complaint: On XX/XX/2023, I received an email from Wells Fargo stating that my credit card request was approved. I received a follow up email stating that my balance transfer had been approved, from an account that is not mine. I forwarded these emails to the email address listed on the wells fargo web page : If you did not respond, forward the suspicious email/text message to reportphish@wellsfargo.com No response! On XX/XX/XXXX, I called Wells Fargo and was routed to somone who took all of the information, and confirmed they had opened an investigation and the card would not be activated. They also stated that I would receive a follow up call to collect additional information if needed. The number called was XXXX. No response! On XX/XX/XXXX, I received a new credit card in the mail, and a letter from Wells Fargo regarding my credit report. I immediately called the number on the card and was told that the card was active and my balance transfer was approved. I stated that this is fraud and the card was not requested by me. I was transferred to another person who again asked the same questions as the person I spoke with the previous week. There was no record of my previous call, according to that rep. They then asked if I wanted to keep the new card and keep the account open. I may have yelled at this point, as I had clearly never wanted the card, and did not request it. They confirmed that the account is inactive and the balance transfer would be denied. I have no faith that they can handle this, and assume that they are just creating new accounts for customers without their permission.

Consumer Complaint: I am told changing my automatic payment with Wells Fargo is no longer possible with external accounts, so I resorted to manually making payments through their online portal. On XX/XX/2023, I paid the full amount due on my credit card. However, on the same day, Wells Fargo debited my savings account for the minimum payment and an over limit amount. Unfortunately, my non-Wells Fargo savings account did not have enough funds to cover both the full payment and the additional amounts. I was informed about this issue on XX/XX/XXXX by my bank where my savings account is held. To resolve the problem, I contacted Wells Fargo via phone and requested either the removal of the minimum payment and principal payment or an adjustment of the amount I initially initiated ( the full statement balance ) to account for the difference between the minimum payment plus over limit amount and the full balance. However, Wells Fargo prohibited me from making any changes to the payment. Additionally, when I attempted to add funds from another account on XX/XX/XXXX to avoid interest charges, I was also prohibited from doing so. On XX/XX/XXXX, I called Wells Fargo regarding the interest fee, but my concerns were ignored. No follow-up, email, or correspondence was sent to me regarding the approval, denial, or explanation of the interest charges. I will consider this issue resolved when I receive a full refund of the interest charged and when my full credit limit is restored. Currently, I am unable to access my credit line because Wells Fargo requires a letter from my savings account, on bank letterhead, confirming my ownership of the account.

I sent copies of my social security card, passport card, passport, and birth certificate as verification and the account still remains on my report after the dispute was closed by the respective companies. The account in particular has a suffix on it, and I do not have a suffix in my name. The account has an address I have never resided at as well. These are violations of the FCRA, my personal information, and it is impeding my credit worthiness.

Since XX/XX/2021 Wells fargo start refusi ng to follow the laws and regulation concerning my privacy. in the last 30+ years Wells Fargo were directing the my mail concerning my account to my po box address as indicated on my account preferences. But in the last XXXX years Wells Fargo has been ignoring my preferences and thjery have been using my street address to mail me. Wells fargo is been ignoring my privacy rights and they have been ignoring all my preferences and they have been ignoring my 50+ complaints that I have filed in the last XXXX years regarding this same issue. Wells fargo is been ignoring this issue even in their responses to my complaint at the CONSUMER FINANCIAL PROTECTION BUREAU and at the OFFICE OF COMPTROLLER OF CURRENCY. They just do not want to hear about it and that for sure is going to cost Wells Fargo some fines for not following the rules and regulations. I did files complaints here in the past but that did not stop Wells Fargo from keep Braking my privacy rights and they keep sending me letters to my street address in contrary of what my preferences on my account are. Wells Fargo is still refusing to Use my Mailing address po box . Today I received a new Letter to my street address from Wells Fargo So here I am filing a new complaint and I am adding this new letter as a new evidence on my new complaint.

This person called me on the phone number listed on my Wells Fargo account and already knew my account login name. I have never shared that login name with anyone and it is not my name or easily guessed. This person stated that they were a representative of Wells Fargo. I do not know who the person is, and I never gave anyone access to my account or account information. Between XXXXXXXX XXXX and XXXXXXXX XXXX ( in a different time zone than mine ) a " total account wipeout '' ( as described by a Wells Fargo employee ) occurred. This includes the following actions and time stamps in the time zone that the fraud was committed in. The time zone that I was in is two hours later. Account password was changed XXXXXXXX XXXX Online transfer initiated XXXXXXXX XXXX ( all funds from my savings account transferred to my checking account ) Wells Fargo Wires Enrollment Confirmed XXXX ( new enrollment for online bank transfers ) Wire Transfer Recipient Add XXXX Wire Transfer Initiated XXXX Your XXXX Deposit Account Has Been Updated XXXX Your Mobile Number is no longer active XXXX Transfer with New Account Number XXXX In addition to these actions, there were additional actions taken by the fraud doer. They used my Wells Fargo credit card and did a cash advance for the entire available balance of the card and transferred that to my checking account. This is a card that I do not use and have never done a cash advance with. In this short time my credit card was maxed with a cash advance and transferred to my checking, my savings was transferred to my checking, my checking account was enrolled in wire transfer and XXXX, a new recipient that I am not familiar with and have never interacted with was added to the transfer list. The entire contents of my checking account was transferred to this unknown person 17 minutes after and 28 minutes after I reported fraud to Wells Fargo. All of these items were not initiated or done by me and I did not give anyone permission to access my account or act on my behalf. I became aware of the fraud at XXXX XXXX in my time zone, which would have been XXXXXXXX XXXX in the scammers time zone. I contacted Wells Fargo instantly when I became aware of the fraud, and there is still fraudulent account activity that is time stamped 17 minutes after my initial contact with Wells Fargo. I have reported all of this to Wells Fargo. I was told by a Wells Fargo employee named XXXX on a recorded line on XX/XX/2023 at XXXX XXXX that the credit card activity was recognized as fraud and the funds would be revered and all late fees and interest will be reversed in 1-2 business days. This did not happen and is now not being acknowledged as fraud. I have repeatedly attempted to resolve this with Wells Fargo and received contradictory information and misleading information. A local Wells Fargo branch manager was able to detect that the IP address with which the wire transfer was made is connected to Wells Fargo. It is his opinion that this was done inside of a Wells Fargo Branch office. The recipient of the stolen funds is XXXX XXXX and the funds were transferred to XXXX XXXX, which is located in Texas. Why was this not recognized as fraud? I seldom use Online Banking, and I seldom use the credit card. I never use wire transfers or XXXX and I have never done a cash advance. My password and contact info were changed and all my funds were depleted entirely and none of this was flagged or considered to be suspicious to Wells Fargo? I want the funds reversed, I want the credit card fees refunded, and I want my credit report amended.

We have not even talked, I have called them today and they have me on the phone with the case manager. XXXX told me she was recording me but when I told her I was recording her she told me she did not want to be recorded. What WELLS FARGO RESOLUTION CENTER just did is fraud and you keep allowing me to be damaged by WELLS FARGO. I assumed the loan in XXXX when my mother died and then the loan I paid the loan for 15 years until I settled the debt in XXXX. I am very upset, when are you going to protect me. Why are they not sending you information showing I settled the loan? My mother is dead, she died in XXXX and you foreclosed against her in XXXX. XXXX XXXX XXXX and XXXX put a Power of Attorney on the record in XXXX saying they were my mother 's POA. How! She is dead? She had an executor and they usurped the executor. That is illegal! I am part of the Georgia Coalition for Fair Housing Justice and am one of the original members whose land was listed in the public notice placed in the newspaper involving 87 other property owners. I am a member of FBI Case Number XXXX where it has been proven that all the banks are committing Mortgage Identity Theft and 5 other crimes when they foreclose on any property or land. Frankly, they steal, and you are allowing them to take our house, land, equity, title and leave us with nothing. When are you going to stop allowing these crimes to happen? Aren't the people paying your salaries? Don't you take an oath to protect the people? I am also part of the Department of Justice group action where they found the banks have in fact committed crimes and are in the process of paying out the money WELLS FARGO was ordered to pay for fraudulent practices. I settled her note and the deed of assent says the property is owned fee simple. Yet you foreclosed against a dead woman in XXXX, when her estate was already settled. You lied to me many times, I settled with you again and you lied again. The Legal Notice you ran in the newspaper was against XXXX XXXX. If she did business with you, how did she? She was dead? You have no wet-ink signature. You are defaming my grandmother who was a civil rights leader who worked in the community for 50 years, be careful of how you destroy her name sir! Truth in Lending 15 U S Code 1605 Determination of Finance Charge ( what they aren't telling you ) - Finance charges should be provided separate from the rest of the document, but you WELLS FARGO loves small print and comingles all the charges together. ANY transactions that I have ever done with WELLS FARGO have been settled many times over plus when I had my business account their they got full benefits for the income I put in the bank from the business. They kept title to the securities deposited because according to their records the securities were abandoned. If the public school system and universities trained us to operate in commerce we would know and America would not be on the verge of finance collapse! This is WELLS FARGO and their gang of banking criminals ' fault!
