The NOTICE OF ASSIGNMENT , SALE OR TRANSFER OF SERVICING RIGHTS created XXXX . Currently XXXX is a company delisted since XX/XX/XXXX. Formally, know to grant a mortgage for XXXX. resident. This foreclosure results requires immediate review and correction of any wrongful laws. I had been a home owner at the residence since XX/XX/XXXX with eviction from the property date XX/XX/XXXX The foreclosure has created undue stress, family hardship , stress for my spouse and myself. Within, the month of XX/XX/XXXX, I was in the process of retiring . In the month's XX/XX/XXXX to XX/XX/XXXX I was not healthy for the type of work I was assigned. Nonetheless, a disaster for the family was created with the foreclosure, loss of income, court fees, moving expenses, attorney fees for XXXX different attorneys, misrepresentation with disbarment of the XXXX attorney, relocation at XXXX residents, deposits and rent fees, transfer of electric services, credit tarnished -- a lien on the property from Citi Financial that continues to show on my credit report and unable to secure Retirement Benefits until XX/XX/XXXX. Uncertain of how the foreclosure status on my credit report will be removed or discharged with balance of $XXXX GMAC MORTGAGE / HOMECOMING XXXX. ORIGINAL SERVICER XXXX. a delisted company. Seeking review for a $XXXX bond that was placed on the property thru the Courts. With no DUE PROCESS this seems to be a cover up. XXXX loan modifications were requested with no results. No response was ever given for acquiring a loan modification with XXXX requests. In as much , XXXX loan modification paperwork was inclusive to record XXXX on a document and appears to fraud...DOCUMENT AVAILABLE FOR REVIEW... The XXXX was inclusive as if this was part of a down payment in the modification process. However, the modification was never approved and foreclosure procedures were mandated , with every piece of personal property placed on the curb side in front of the resident . for a public display and scavengers to steal possessions owned by my family. In XX/XX/XXXX, I experienced issues with late payments and requested a loan modification. DOCUMENTED XX/XX/XXXX XX/XX/XXXX. A workout /or repayment plan is documented with a notice from Homecoming XXXX. Within the terms of the agreement it was determined that Homecoming XXXX approved a REPAYMENT PLAN DOCUMENTED XX/XX/XXXX - XX/XX/XXXX Payments are part of my immediate file on record. I request an audit of my payment for this mortgage. Consumer Complaint: I am writing this on behalf of a very good friend that lost his Spouse 3 yrs ago. after she passed he could not afford the house payment that he has lived in for over 27 yrs. I helped in to work with the original lender but in the middle of the loan modification process they sold the loan to Ocwen Mortgage. We filed all teh loan modification documents with them and we had an offical Loan mod trial period as long as we made the payments for 6 months we woudl be clear for the loan mod. here we are 2 yrs later and the loan mod is still pending, Teh owner is still getting foreclosure letters but when i call and talk with the file manager they keep telling me to just keep paying the loan mode payment as they keep checking to find out why the loan modification isnt going thru. after a yr so far of doing this. ITS STILL UNRESOLVED XXXX/XXXX/2015. the stress it is creating for the owner an dmyslef for helping him stay in his home like I pormised him I will try to do a dn as far as we were told he was when I talked to Ocwen about the loan modification we are doing everythign they have asked us to do. but he is still getting certified mail saying that he needs to pay the rears or they will foreclose. All we want is it to be final at the payment they agreed to and move on with life.

Consumer Complaint: My home loan was modified by Ocwen Loan Servicing , LLC under the Home Affordable Modification Program XX/XX/XXXX. The modified payments included the loan 's principal, interest and an escrow account, and remained the same until XX/XX/XXXX for the payment due XX/XX/XXXX. This is due to the increase in funds for my escrow account. I was n't notified of this change. My escrow account is current. In fact, it had a surplus amount which is supposed to be mailed to me. I inquired about closing my escrow account, and was told that I can not do so because the HAMP guidelines suggests that borrowers ' accounts must be in escrow for XXXX ( XXXX ) years from the date of the modification approval. Is this true? Section 4D, Funds for Escrow Items of the executed Home Affordable Modification Agreement state that " Servicer may waive my obligation to pay to Servicer Funds for any or all Escrow items at any time. '' It seem that this statement contradict the information that I was given. Additionally, the executed agreement does not mention a XXXX year requirement period for an escrow account. Moreover, I was asked to google CFPB when I inquired about the HAMP guideline on the XXXX year escrow account period. What is CFPB 's relationship with Ocwen Loan Servicing LLC when it comes to my escrow account? Do I have the legal right to request Ocwen to close my escrow account? The loan account is in good standing, and the amount that they are now requesting to fund the escrow will cause financial hardship. Please advice. Thank you.

The XXXX mortgage was disclosed on the deed in lieu application and is even serviced by the same company as the primary mortgage. This all seemed like a delaying tactic. In XX/XX/XXXX, I received a notice that the XXXX mortgage had been written of in XX/XX/XXXX. I reapplied for the Deed in Lieu in XX/XX/XXXX. I am still seeing delaying tactics from the mortgage servicer.

Consumer Complaint: today XXXX ocwen called to inform me AGAIN that i needed to fax them our tax returns and a letter stating when our hardship began and our application would be complete. i have faxed it XXXX times now along with the letter of hardship. this is ludicris. i have never in my life seen something like this. this is exactly what ocwen did to us when they told us if you want help you must fall XXXX months behind and we did and after we called for help and we sent in a complete application they just kept wanting things over and over and over again the whole time assuring us they would help us to find a resolution to stay in our home. they did this to me for XXXX months, mind you we were already XXXX months behind bc they told us in order to get help you must fall behind, now XXXX months into that help how can you get caught up. does anybody care what they do? is anyone listening to me? if i find me a lawyer that aint scared of ocwen im suing their pants of them. they better cross their every t and dot their i because if their paperwork is wrong i will fight them all the way to the top.

Consumer Complaint: After obtaining a HAMP modification, I enrolled my account in EFT payments. When I set this up XX/XX/XXXX, I was told that I had to make my regular payment XX/XX/XXXX. I initiated my regular mortgage payment on XXXX XXXX, and the company went and drafted another mortgage payment on XXXX XXXX, despite them advising that they would not be deducting a payment from my account. It took 10 days and a lot of running around for Ocwen to refund the additional payment. During the refund process, I asked them to cancel the EFT since I had received too many differing stories regarding the refund. They confirmed that my account was unenrolled in their EFT program. On XXXX XXXX, XXXX, I initiated my regular mortgage payment which was successfully processed from my account. Ocwen went and drafted another payment from my checking account on XXXX XXXX, 2015. I immediately noticed their error and contacted them on a daily basis to request yet another refund. They told me that the refund was issued on via wire transfer on XXXX XXXX, the funds were not received into my account until today, XXXX XXXX, 2015. The newest problem is that they have over-refunded me and are now calling my loan late and applying a late fee.
