Consumer Complaint: We are facing foreclosure auction of our home of 26 years on XXXX XXXX, XXXX. Just a few days away. We have hired Attorney XXXX XXXX to file an injunction and a complaint against XXXX XXXX, Ocwen & XXXX XXXX. We have been fighting them since XXXX. We have absolute evidence they have no interest or standing in our mortgage /loan. They are not the original lender. They have filed for an illegal foreclosure XXXX times. They have charged us for illegal forced placed insurance and 13 % interest. Refuse to modify and constantly give us the run around. They have tried to have XXXX auctions regarding our home since XXXX XXXX. All postponed at the very last minute without the injunction being decided. They have a XXXX party trespass onto our property taking photos and trying to look into windows. We live in fear and terror every day. We are afraid to leave our home i fear they will break in. The injunction was denied last week. Attorney XXXX states there is nothing he can do to stop the auction, even though we have an active complaint. We may be forced to file ch.XXXX to try to prevent the auction. This loan is a high cost predatory loan. We lost a rescission case in XXXX. Had not heard from Ocwen / XXXX for 3 years after that. They filed the order of notice in XXXX of XXXX. We filed our complaint that same month. We are beyond stressed not knowing how we will survive. The courts are absolutely biased against the homeowner. They do n't want to hear the facts. They just rubberstamp the forclosures. We are not trying to get a " free Home ''. We had job loss and illness which caused us to fall behind in payments. Our home is valued at XXXX and the loan was orig. XXXX. There is equity. Any help would be greatly appreciated to guide us through this nightmare. We know we are not alone in this injustice. Consumer Complaint: Well the saga continues after XXXX complaints and XXXX months later my deed in lue is still not completed and now the home owners association is planning on taking me to court because of past arrears that I can not not pay due to the fact that Ocwen has taken so long with completing my deed in blue that they said would take XXXX days. Ocwen continues to lie about their process and push me off. I recently receive foreclosure paperwork from an attorney about the house in question that Ocwen submitted to them. I contacted Ocwen and they told me not to worry about t and they can stop the foreclosure at any time they are just waiting for their attorney to get back to them. So about their attorney, they gave me the name and number to try and get in contact with " THEIR '' attorney who I found out if a family attorney not a mortgage or real estate attorney. After calling them back multiple times and spending time I found out they were never able to contact their attorney for many months and this was the delay. I told them to find another attorney, and they wasted all this time. I had to kick out the renters who are still waiting on their {$3000.00} from Ocwen to move out and Ocwen 's escalation team s horrible to work with everyone puts a priority on the escalation and nothing happens. There must be something to protect consumers from this behavior of the mortgage companies. Where can I go? Do I have to take them to court? I now have less than 30 days before they foreclose on my house that I have been trying to give back to them for over a year and their inability to do the right thing and provide professional services is completely unacceptable.

Consumer Complaint: On XX/XX/XXXX my Chapter XXXX Bankruptcy was discharged, and Ocwen was included in the Chapter XXXX. In XX/XX/XXXX I applied for a loan modification with Ocwen. In XX/XX/XXXX, I was approved for a XXXX loan. I as well as Ocwen signed the documents. Since the modification, Ocwen reported my payments to the XXXX main credit bureaus MONTHLY. Which helped build my credit. In XX/XX/XXXX, my credit score with XXXX was XXXX ( fair ). I got credit card offers and was approved for XXXX credit cards. In XX/XX/XXXX, Ocwen sent me a letter stating they had reported in error and contacted the XXXX main credit bureaus, and told them my account was closed, removed all of my on time payments, and now refuses to report my payments. in XX/XX/XXXX my XXXX credit score dropped to XXXX ( poor ). Now I have been denied an auto loan, and multiple credit cards. I would like Ocwen to report my payments, but since they cant, and ruined my credit. They should be fined.

Consumer Complaint: My mortgage loan is currently serviced by Ocwen Loan Servicing. Ocwen currently has the outstanding balance listed at {$1000000.00} ~ see attached. They also have the interest rate set at 10.7 %. Since my mortgage loan payments and overall balance have adjusted upward sharply, I have requested a detailed accounting ledger and proof of the current serious interest rate increase. Ocwen has ignored my requests. Ocwen has recently sent a trial loan modification offer to me ~ see attached. They have stated the current payment will be figured off a {$580000.00} figure, but they have not advised where if the rest of the balance will be written off, forgiven or deferred via balloon payment. There is also no amortization schedule or interest rate listed. The loan modification offer lacks clarity, which is a requirement per the National Mortgage Settlement of XX/XX/XXXX. I have a pending foreclosure hearing on XX/XX/XXXX and Ocwen is stalling on responding my critical questions.

Consumer Complaint: The loan was an 80/20 loan used to purchase the property XXXX with the same company, Option One Mortgage, sold to AHMS, sold to Homeward Residential, acquired by OCWEN. The Original Date of First Delinquency on the loans for the property was in XXXX XXXX. The property was later foreclosed upon, of the date of that I am unsureCountless times of requesting modifications with the servicer of the loan beginning in XXXX, we were refused at the initial point of contact with a customer representative every time. We were never allowed to speak with management for review or consideration or recommended to fill out an application to submit a request. We encountered such things as " You must live in your house for at least five years for us to even consider a modification '' " You owe too much on the balance to even be considered for a modification '' or " We do n't really do that for people '' " Im sorry but there is nothing that we can do for you. " In XXXX after we fell way behind, Homeward Residential began foreclosure process on the property. My husband received a sum of money from an inheritance and he offered a sum to bring the delinquent balance current and do a modification. Homeward Residential agreed to temporarily suspend the foreclosure and do a modification. While in the modification process, they directed us to stop paying on the smaller 20 % portion of the mortgage and just bring the 80 % portion of the mortgage current. There was no forgiveness of any debt. They reduced the interest rate very little. The payments were barely reduced. At the end of the process, as a complete surprise, they tacked all of that delinquent mortgage that they told us not to pay, onto the loan, extending the debt even further. we requested if there was any way to rework another modification, and they refused and we had to eventually let them foreclose on the property. I do not have details of the foreclosure, and our understanding of the process was very limited. But I do know that there is no public court judgment against for a deficiency balance after the foreclosure was complete. A balance of {$31000.00} is on our credit reports being serviced by XXXX XXXX XXXX Debt collectors for Homeward Residential ( a subsidiary of Ocwen ). The trade line reports as a current mortgage due with a past due balance and has been reporting late every month for the last XXXX years, since first defaulting in XXXX. In XXXX We received small payments as part of the agreement for the XXXX settlement with Ocwen who owns Homeward Residential whom was servicer of our loans. After being informed we would be included in the National Mortgage Settlement with Ocwen, I wrote to the Credit and requested that the foreclosure status listing from Homeward Residential be removed and delinquent balances be removed from the reports. The foreclosure listings were removed, but the balance of {$31000.00} listed with XXXX XXXX XXXX ( who is servicing the collecting of the debt on behalf of Homeward Residential XXXX remained and the credit bureaus would not remove the listing. I have recently been trying to negotiate with XXXX XXXX XXXX to settle the balance, even though I do not believe we owe this debt after the abusive practices suffered from the servicer before and during the foreclosure. XXXX XXXX has informed me that they do not own the debt but that Homeward Residential owns the debt and they are servicing it on their behalf and are only the collectors. XXXX XXXX agent XXXX who is assigned to our case, has given me counter offers but told me they can not remove the trade line and or remove the late payment postings with no real explanation as to why, and I believe they are trying to strong arm us into just paying with no real benefit to us.

Consumer Complaint: I entered into a loan modification with ocwen and was on time every month and was never late. Even before that was only 30 days behind. Was told 3 months and it turned into XXXX. Finally they sent me the modification loan after I did complaints. But the principle was {$13000.00} more than it should of been. It went back and forth and the consumer office told me to just sign then they would fix. I ended up just selling yeh house to get away from them and paid my loan in full. Now they have reported to my credit agency I was late for over a year. While I never missed the payment. They sent me my sector balance which shows {$3800.00} in it remaining after close but they 're saying that 's wrong now and I 'm owed nothing. I tried to correct credit report but they still are refusing to correct.

Consumer Complaint: I do n't know where to turn. Ocwen has a class action suit levied against them and is forced to pay some homeowners money back. My issue seems pretty simple. Ocwen acquired my XXXX mortgage when XXXX/GMAC declared bankruptcy years ago. I declared bankruptcy near the same time, but I signed a letter of intent for both of my mortgages with XXXX/GMAC at the time ( 1st ended up with XXXX which is almost as bad, XXXX with Ocwen ) and my payments have been current since XXXX/GMAC modified my loan long before either BK - that is after the initial mixup many have found with Ocwen where I follow their instructions to change the payment from my bank account, it was lost, I changed it back to the old " Pay To '' and problem apparently solved since they 've taken my money ever since. Both mortgages are still showing on my credit report as negative because they show closed/discharged in BK. Neither servicer will take responsibility to correct the erroneous credit reporting. Why is this an issue? Because I want to refinance with someone, ANYONE else but the negative marks make me less than a favorable choice for any kind of loan. How are they getting away with this? How do we the consumers fix it?!
