In which under 1581m, a consumer is entitled to hold them civilly and criminally liable for each of the violations.I have a Right to Privacy, it also states a consumer reporting agency XXXX as XXXX, can not furnish a account without my written instructions, in which I never once gave them consent to furnish any Accounts, Phone Numbers, Addresses, Amounts, or Any of my personal information.In which an account means a demand deposit, saving deposit, or asset account ( other than on occasional or incidential credit balance in an open credit plan as defined in section 1602 ( i ) of the title established primarily for personal, family, or household purposes, but XXXX term does not include an account held by a financial instution pursuant to a bonafide trust agreement. Consumer Complaint: LEXISNEXIS BROKE THE LAW!!!!! LexisNexis is in violation of 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information ( a ) NOTICE REQUIREMENTS Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. ( b ) OPT OUT ( 1 ) IN GENERAL A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. LexisNexis has disclosed my nonpublic personal information to a nonaffiliated third parties. LexisNexis has provided XXXX, XXXX, XXXX, and XXXX with information on me without providing me with disclosure in writing or electronic form or other form permitted by the regulations prescribed undersection 6804 of this title. LexisNexis has not given me time that such information is initially disclosed, to direct that such information is not disclosed to such third party. LexisNexis has also failed to give me an explanation on how I can exercise that nondisclosure option. I gave LexisNexis two opportunities to correct the above-mentioned violation since XX/XX/2023. LexisNexis had over 30 days to correct these violations. My rights have been violated. To correct each violation, means remove all items/information LexisNexis has collected on me as LexisNexis does not have my consent and never had my consent to collect information on me nor provide that information to third parties. Under FCRA 15 U.S. Code 1681n ( b ) ( B ) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer because of the failure or {$1000.00}, whichever is greater ( 2 ) such number of punitive damages as the court may allow. Under 15 US Code 1681n ( b ) civil liability of a natural person Ive been violated. I gave LexisNexis over 30 days to remove the file LexisNexis has created on me without my consent. As of today, LexisNexis has removed XXXX records from the LexisNexis Report created by LexisNexis on me. Deletion is admission. LexisNexis still has not removed the entire file they created on me. LexisNexis continues to move in negligence and LexisNexis is liable. I am asking the CFPB to step in and help resolve this matter of negligence and continued wrongdoing of LexisNexis to me.

And in accordance with the Fair Credit Reporting Act, XXXX Account # XXXX and XXXX XXXX XXXX - BALANCE {$15000.00} - CREDIT LIMIT {$10000.00} - Incorrect Balance being report, and high credit utilization disclosed and 30 day late payments ( XXXX - XX/XX/2023 ), XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX are violating 15 USC 1681 and 15USC 6802. Consumer Complaint: 2nd attempt You are required under the FCRA to have a copy of the original creditors documentation on file to verify that this information is mine and is correct. A debt buyer CANT verify accuracy for any PURCHASED debt. Only I as the consumer can I verify if a debt is mine. You are clearly committing identity theft because XXXX XXXX is stating that you are the one that gave them updated personal information on me which is against the law. The original address and name XXXX XXXX have was not mine. In the results of your investigations, you stated in writing that you verified that these items are being reported correctly Who verified these accounts? You have NOT provided me a copy of ANY original documentation ( a consumer contract with my signature on it ) as required under Section 609 ( a ) ( 1 ) ( A ) & Section 611 ( a ) ( 1 ) ( A ). Furthermore, you have failed to provide the method of verification as required under Section 611 ( a ) ( 7 ). Please be advised that under Section 611 ( 5 ) ( A ) of the FCRA you are required to ... promptly DELETE all information which can not be verified. Its very obvious that your agency doesnt know what the FCRA is because from the looks of my credit report and all the errors I see you are disregarding it so heres my breakdown. 1.The Fair Credit Reporting Act is the primary federal law that governs the collection and reporting of credit information about consumers. Its rules cover how a consumer 's credit information is obtained, how long it is kept, and how it is shared with othersincluding consumers themselves. 2. What is a FCRA violation? Creditors give reporting agencies inaccurate financial information about you. Reporting agencies mixing up one person 's information with another 's because of similar ( or same ) last name or social security number. Agencies fail to follow guidelines for handling disputes. 3. My rights under the fair credit reporting act Verify the accuracy of my report when it is required for employment purposes. Receive notification if information in my file has been used against me in applying for credit or other transactions. Disputeand have the bureaus correct and deleteinformation in my report that is incomplete, inaccurate, and unverifiable. Remove outdated, negative information ( after seven years in most cases, 10 in the case of bankruptcy ). I demand these items be deleted immediately. I entered the items and the outcome I desire below because you are in violation and these items are not 100 % accurate and they are either INACCURATE, Unverifiable and Invalidated. I recently applied for extended credit and was denied I am in distress because of your mistakes. The law is very clear as to the Civil liability and the remedy available to me ( Section 616 & 617 ) if you fail to comply with Federal Law. Consumer Complaint: The credit bureaus keep disrespecting the laws. I showed them multiple times how they are violating the Fair Credit Reporting Act. the Fair Credit Reporting Act ( FCRA ) is codified at 15 U.S.C. 1681 et seq. Section 1681e of the FCRA sets forth the requirements for accuracy in credit reporting, and includes provisions related to the reporting of bankruptcies. Specifically, subsection ( b ) of Section 1681e states that a credit reporting agency may not furnish a consumer report containing information on a bankruptcy case that is more than 10 years old. Additionally, Section 1681i of the FCRA provides consumers with the right to dispute inaccurate information in their credit reports, including information related to bankruptcies. The credit reporting agency is required to investigate and correct any inaccuracies found during the dispute process. The credit bureaus keep disrespecting the laws. I showed them multiple times of how they are violating the Fair Credit Reporting Act. Consumer Complaint: Dear LEXIS-NEXIS, I am writing to dispute the information being reported by your company regarding an alleged bankruptcy. You are in violation of the Fair Credit Reporting Act ( FCRA ) by selling, transferring, and reporting inaccurate information to the credit bureaus. As per the FCRA 15 USC 1681, a credit reporting agency can be sued for negligent or willful compliance with the law within two years after discovering harmful behavior, or within five years if the harmful behavior occurred. It also stipulates that only data furnishers are authorized to provide information to credit bureaus. Banks, credit unions, retail credit, car issuers, auto lenders, mortgage brokers, debt collectors, and other voluntary send information to credit bureaus. Furthermore, I have some questions regarding how your company obtained the information regarding my bankruptcy from the United States Bankruptcy Court. Did the court sell or transfer this information to your company, or did your company obtain it through some other means? Is the United States Bankruptcy Court a credit reporting agency, and do they have the authorization to provide information to credit bureaus? Therefore, I request the following information to support your Metro 2 compliance for consumer and commercial credit reporting : A copy of your written policies and procedures for Metro 2 compliance in consumer and commercial credit reporting. Information on how your company obtains and verifies the accuracy of consumer and commercial credit information, and how it ensures that information is reported in accordance with Metro 2 guidelines. Details on any training or education provided to your employees regarding Metro 2 compliance in consumer and commercial credit reporting. Information on the systems and technology used by your company to report consumer and commercial credit information in Metro 2 format. Details on whether your company has undergone any audits or assessments of its Metro 2 compliance practices, and if so, request copies of the reports or findings. I also request information showing a contract you signed to become a data furnisher, including the data furnisher agreement. Additionally, I would like to know how you were able to convert to Metro 2 format and become Metro 2 compliant.
