Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I 've been trying to dispute this alleged collection debt of {$720.00} that XXXX XXXX ( CV ) claims I owe. I sent CV my first certified letter dated XX/XX/XXXX, which requested them to remove this false debt or send proof that validates this debt with my signature, according to the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, and my state laws. Valid evidence should contain my signature, agreeing that I ever had an obligation to pay them. If no such documents exist, all collection debts from XXXX XXXX should be ceased and removed from all my credit reports. CV replied with a letter dated XX/XX/XXXX, stating that they completed their investigation and found the debt " valid. '' Their verification included a letter from XXXX XXXX XXXX, which appears that CV contacted XXXX XXXX XXXX under " my name and current mailing address. '' That letter included an itemized bill, but no sight of any signature agreeing that I pay XXXX XXXX. CV 's evidence is invalid. I sent a second certified letter dated XX/XX/XXXX, which CV received on XX/XX/XXXX. I included in the letter that they failed to provide viable evidence, and I also state, " as per FTC opinion letter from Attorney XXXX XXXX XXXX, you should be aware that a printout of a bill or itemized document does not constitute verification. '' For a second time I requested them to cease collections or send proper documents. I have not heard back from XXXX XXXX since, which further proves that this debt does not belong to me. However, they are still falsely reporting the debt on my credit reports

Consumer Complaint: In XXXX XXXX, I received an email from XXXX that Convergent XXXX has been added to my credit report. According to the email, they are trying to collect a debt from XXXX XXXX.I have never had a XXXX account and feel that this is an incorrect information being reported on my credit report. XXXX XXXX is not listed on the Florida Office of Financial Regulation. Unfortunately under the Department of Business and Regulation, Convergent XXXX is listed as an electrical company not a debt collection agency. I have mailed in multiple letters asking that this information be validated and/or verified and they have not responded. Now they have reopened this account and listed is a late payments from XXXX XXXX, but have the account reported as open in XXXX XXXX.

Issue: Communication tactics

Subissue: You told them to stop contacting you, but they keep trying

Consumer Complaint: Convergent refuses to cease and desist attempts to collect false debt from XXXX. I have wonderful relationship with XXXX, whom themselves never attempt to contact me about this fraudulent debt. I have sent numerous emails, physical letters, and told them over the phone to stop calling and harassing me and that they are wrongfully contacting me. Supposed debt is well over 7 years old, as well as date the supposed case was opened against me. I do not recognize any information they provide, only responded saying that at one time I had someone wrongfully withdraw money from a paypal account years ago. But that I never defaulted on any purchases etc. Back then the money had to be IN the XXXX account for a purchase to be made so it is impossible I would be able to overcharge a credit card etc. There was a negative report on my credit report from this incident because I was never able to find proper information on the individual in order to bring them to court, they hacked several accounts of mine at the time even finding my address. However this poor mark on my credit has been long removed from all credit bureaus for several years now. Convergent refuses to stop harassing calls and letters, even going as far as contacting previous addresses/phone numbers and family members. Harassing them when asked to stop. I do stay off and on at this old residence often using it as mailing address for packages, but do not own this home nor was this the address I resided at when this dispute was created I lived in XXXX XXXX CA. They also send a statement saying they may post a negative mark on my credit score if I do not submit to their harassment and give them funds. Which considering the dispute is over 7 years old, I find to be wrongfully threatening and deceptive. Being I have spoken on phone, and sent letters mostly..As far as responses from me I only have a copy of the last letter sent to them in which they have already ignored and begun calling family members again. They do state in other letters that they acknowledge I have told them I do not owe them money and do not wish to speak with them yet continue to keep this up, I can find those in storage if necessary.

Issue: Written notification about debt

Subissue: Didn't receive notice of right to dispute

Consumer Complaint: This is an additional complaint from closed CFPB complaint # XXXX. First, I would like to start this complaint in writing by saying " I have never paid any money to XXXX EVER. I never even knew XXXX existed until they showed up on my credit report without my prior knowledge of a debt owed to Covergent untilXX/XX/XXXX of XX/XX/XXXX for the first time by way of credit reporting on my credit files. The date the debt was assigned to their office ( which they claim wasXX/XX/XXXXXX/XX/XXXX of XX/XX/XXXX ) is only relevant to me because they violated my rights by not alerting me at ALL. I only disputed the debt with them after I saw it show up on my report, after I paid my last bill with XXXX as stated on complaint # XXXX. As I said before I never knew they existed or that XXXX was reporting me to XXXX despite that fact that when I canceled my mobile service I was still paying my bill with XXXX. Be that as it may, why did XXXX not contact me prior to this being reported to the credit agencies? With that said below is my official complaint. In XX/XX/XXXX, XXXX reported to my credit profiles ( XXXX, XXXX, and XXXX ) as owing Convergent {$930.00}. UN-announced to me, without prior knowledge that XXXX claimed I owed a debt to them as they claim the debt was transferred/assigned to them in XXXX of XXXX. Prior to, or after XXXX of XXXX, I did not owe XXXX {$930.00} nor was I ever notified by XXXX that their office was responsible for collecting {$930.00}. XXXX has no proof they notified me that their office was responsible for collecting XXXX 's bills that they claim I owed. Again, I never received any notice of collection at any point ever in writing or otherwise until after the debt was reported as paid on my credit files. If I were to have received a written notice from XXXX, I would have disputed the validity of the debt owed because I have been making my payments to XXXX as agreed. I did n't even know Convergent was the new owner of debt until AFTER it was reported and the debt was already paid. This is a clear violation of my rights under the Fair Debt Collection Practices ACT and the Fair Credit Reporting Act. Convergent never called me at any time in XXXX or XXXX prior to this debt showing up on my credit report or mailed me any debt collection letters or bills. As I did every month and agreed with XXXX, I paid XXXX as XXXX confirmed on their response to CFPB complaint XXXX until my bills with XXXX were fully paid. It may appear that this collection agency " parked '' the debt until after the fact. Why did Convergent report me to the credit bureaus on a debt Convergent never billed me for? or sent me a letter about. To at the very least afford me my right to dispute the validity or accuracy of the debt? Why did XXXX wait until I finally paid off XXXX for XXXX to then report me to the credit bureau? I hereby request the debt reporting on my credit files be removed immediately as required by federal law. I would like to request a full investigation by a Consumer Financial Protection Bureau investigator and including the Federal Trade Commission for potential violations by XXXX and XXXX 's unfair business practices for clear violations of my rights.

Issue: Took or threatened to take negative or legal action

Subissue: Threatened to sue you for very old debt

Consumer Complaint: XXXX, a debt collector for XXXX sent mail to me concerning payment that they claim I owe. The debt is for a bill they claim I owe XXXX for service received in XXXX XXXX. The first I have heard of this debt was when XXXX contacted me, which was in XXXX of XXXX. I contacted the New York Better Business Bureau on XXXX XXXX. They referred me to Consumer Financial Protection Bureau -complaint number-XXXX- This was my complaint : I do not agree with the bill sent to me by a XXXX XXXX for XXXX XXXX for services rendered to me almost five ( 5 ) years ago ; especially since I did not live at the location at the time of the billing which I can prove.t. I resent that they waited that length of time to contact me ; and not personally, but through a collection agency. I have tried to fix the issue with Better Business Bureau.
