Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: 1 ) I have submitted my PSLF certification documentation as I do each year from my federal employer, the XXXX. XXXX is delaying the certification of my payment history for XXXX. It keeps saying it is still evaluating my employment. The company 's website also says it has reached a determination but its letter sent to me keep asking for more time to evaluate. I believe it is intentionally delaying certifications of XXXX forms. 2 ) Please provide detailed statements for all loans from XX/XX/XXXX to XX/XX/XXXX and count these towards PSLF. I was employed at the XXXX XXXXnd made qualifying payments. XXXX has inaccurately marked the loans as in forbearance or deferment or no payment due. This is not true. It must correct its error and count these months towards XXXX.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Investigation took more than 30 days

Consumer Complaint: Initially I saw an additional XXXX in student loan debt reporting on my credit report by a parent company whom acquired the loans several years back. When I first inquired about information to consolidate the loans the loans were reporting XXXX owed in total on XXXX, when on my credit report it stated XXXX. I requested more information to open a investigation into the loans by this company since they were not reporting the XXXX additional loans totaling the XXXX in addition which was not being reported to XXXX. The remaining loans that total XXXX I know to be true and valid, however the additional XXXX loans totaling XXXX I challenged the validity of them via the company 's dispute portal. I believed the loans to be potentially duplicates of when these accounts were initially acquired back in XXXX etc. I have since submitted my documentations supporting the facts stated and requested in full including but not limited to, all supporting facts and documents providing the validity of debt. They have since not providing anything besides a XXXX page document providing the signature of a unknown loan because they blacked the loan number references out when they sent the document over. They have replied stating they believe the loans to be true and accurate yet have not submitted the requested information to prove the validity of debt.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: Fed Loan Servicing coerced and deceived me into entering an unidentified program to make monthly {$5.00} payments toward student loan accounts, without disclosing that they were a debt collector. The company at no point in time ever identified itself as a debt collector. Consequently, I was never aware that I was dealing with a debt collector. In fact, I believed this company was a federal agency. Much to my surprise, the student loan accounts, dating as far back as 1989, are being reported as open on my credit profile at the national Credit Reporting Agencies ( CRAs ). Fed Loan Servicing has violated federal law by using deceptive and misleading tactics, not identifying themselves as a debt collector, in an effort to collect on more than 30 year old student loan accounts by reporting them to the CRAs.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I graduated with my XXXX in XX/XX/XXXX and began repayment on my loans XX/XX/XXXX per expectations. I was using a Segal Education Award for the first several years as I had done 2 years of XXXX XXXX prior to graduate school and was using it to pay off my loans while I worked to secure stable employment with a stable income. I was working in a public school during this time so my employment was qualifying employment. My plan was to work for 10 years, from XXXX in public service and have my remaining loan balance forgiven. I noticed after a year of payments that my payments from XXXX stopped showing as qualified and many of my payments weren't actually being processed as qualifying payments due to the way that the XXXX system did not always sent payments in a timely manner and was impossible to contact and told me there was nothing else they could do. I spoke to fedloan on a monthly basis to confirm my payment was received and would qualify and always submit payment requests on time and per fedloan and was given mixed information regularly. I was told my account was under review for 3 years and that the payments should show up as qualifying once the review was complete. The review is still pending. It has been 5 years now. I have been paying my loans on time since XX/XX/XXXX ( 49 months ) and only have 18 months of qualifying payments. My account is still under review and I am worried that nearly 20 of my payments will be deemed as 'not qualifying ' because of issues beyond my control. These payments were ones made with the Segal Award ( from the government ) to the government and should absolutely qualify for public service loan forgiveness. I need my qualifying payment information to be updated to reflect the accuracy of what I have been doing .... this is unacceptable and I wish I could discharge these loans in bankruptcy but I am unfortunately a public service slave for now longer than 10 years because fedloan refuses to review and understand the situation of the XXXX XXXX Award system not processing payments on time. This is beyond my control, but I am being penalized for up to 20 payments being deemed as not qualifying.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: On XX/XX/XXXX I received a letter from Fedloan that my payment terms had changed and my payment was going to increase due to previous monthly payment amount not be sufficient to pay off your loans within the time period allotted. When I received this letter I knew immediately something was wrong AGAIN ( I have made prior complaints through CFPB and Dept of Education regarding Fedloan ). My payment terms should not be changing due to : 1. payments being suspended due to COVID. 2. my payment should not be increasing due to the 0 % interest rate since XX/XX/XXXX. 0 % interest rate saves money overall, even though my payment won't be lower. The full amount of my payment should be applied to the principle balance of the loan. I was up to date with my payments prior to the payment suspension period began, interest accrued prior to XX/XX/XXXX, will not capitalize. Therefore no outstanding interest will be added to my principle balance when payment suspension ends. Despite not having to pay my loan I have continued to make payments : {$1100.00} on XX/XX/XXXX {$1100.00} on XX/XX/XXXX {$1100.00} on XX/XX/XXXX {$1100.00} on XX/XX/XXXX {$1100.00} on XX/XX/XXXX Repayment terms : XXXX XX/XX/XXXX Repayment amount {$28000.00} - 90 months {$310.00} 1 month {$310.00} Repayment amount {$78000.00} 90 months XXXX 1 month XXXX Total : {$1100.00} New repayment terms XXXX ( this date is incorrect it should be XX/XX/XXXX ) Repayment amount {$25000.00} 76 months XXXX 1 month XXXX Repayment {$69000.00} 76 months XXXX 1 month XXXX Total : {$1200.00} I should not have to pay more I should actually being pay less especially since I have resumed my payments. first loan amount is reduced by {$3300.00} ( $ XXXX now {$25000.00} ) second loan amount is reduced by {$8900.00} ( $ XXXX now {$69000.00} )

Issue: Dealing with your lender or servicer

Subissue: Need information about your loan balance or loan terms

Consumer Complaint: I left school in XX/XX/XXXX and my last student loan was issued prior to that. I consolidated and made payments under a consolidation plan. After that I was forced into a new consolidation because loans that had been paid off were being placed in collections. Now, after making more than {$20000.00} in payments, I have a balance due of {$140000.00} on loans that originally totaled around {$50000.00}. I have asked the both the servicer and the Department of Education for copies of all of the promissory throughout my loan history as I believe there are discrepancies. The servicer told me to contact XXXX and XXXX told me to contact the servicer and this has just gone back and forth for about two weeks. I want the copies because I believe they reconsolidated loans that had already been consolidated. I also want these copies so I can share them with my Senators as they move forward with their loan forgiveness legislation.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: Once again, I submitted my complaint, and once again, XXXX less than 2 days sent a message saying they were " investigating '' and then sent an email saying it was " updated '', but did NOTHING! It is like NO ONE is actually LOOKING or READING any of the attachments, including the discharge from the BANKRUPTCY COURT showing ALL Student loans, including XXXX were discharged. It was discharged due to hardship because of an injury. Not ONLY did XXXX turn around and SELL OFF the discharged debt for someone ele to try and collect on AFTER discharge, which is illegal, PHEAA is now claiming I owe {$20000.00} addtional in fees. ( HA HA HA HA HA HA HA ). AS IF! In 3 years it went from {$21000.00} to {$43000.00}? That's AMAZING! As previously stated. I will submit all my paperwork EVERY DAY until THIS IS PROPERLY taken care of as it is FRAUD and WRONG! it goes against EVERYTHING CFPB is set up to do and so much for protection to me under Federal law!!!!!! These companies are getting away with breaking FEDERAL BANKRUPTCY LAWS and NO ONE seems to give a XXXX! I am XXXX and XXXX and this is incredibly frustrating to have to explain the obvious and NO ONE READS!!!! Submitting my Complaint AGAIN and WILL CONTINUE to do so EVERY DAY until SOMEONE LOOKS at the documents and these two companies are REMOVED from my report or at the VERY least, reported CORRECTLY!!! Due to an injury, I am NO LONGER ABLE to work. Under my chapter XXXX I lost my XXXX, my retirement, everything I had. The judge declared by case to be a hardship case and ruled that even the student loan to XXXX was discharged. XXXX was aware and, as indicated in the paperwork I am RESUBMITTING, at one point they had reported the account to all the credit bureaus as CLOSED/CHAPTER XXXX BANKRUPTCY. 2 years later, they decide to pass it off AFTER DISCHARGED BANKRUPTCY to a PHEAA for " collection '', which is totally ILLEGAL! Now, both PHEAA AND XXXX are reporting to all the credit bureaus that this DISCHARGED DEBT is PAST DUE! It was NEVER past due! EVER. It was deferred or in forbearance, but NEVER LATE! It is bad enough that my credit report is showing a bankruptcy that hurts me, but to now have these TWO companies reporting FALSE information and CONTINUING to get away with what is a CLEAR violation, is just baffling and infuriating to me! That has the ENTIRE point of Chapter XXXX and DEFEATS the purpose! I am REALLY, REALLY tired of these companies getting away with reporting something that was LEGALLY under FEDERAL LAW DISCHARGED. I am about to file a lawsuit and I will drag in every doctor, judge and person I know for the pain and infliction these companies are causing to me over my credit report. I have had ENOUGH! HOW MUCH DOCUMENTATION does it take to get SOMEONE to REALLY DO SOMETHING?? LOOK at the attachments! THIS IS NOT ROCKET SCIENCE! You asked for Documentation and I have given it. AGAIN AND AGAIN AND AGAIN! THE DISCHARGE PAPER FROM THE COURT IS CLEAR! THEY CAN NOT COLLECT on a DISCHARGED DEBT!!

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I graduated from the University XXXX XXXX in XXXX, with a total of {$45000.00} in federal student loans which I consolidated that year. I made payments except when I obtained a deferment for financial reasons. In XXXX I filed for Chapter XXXX bankruptcy. I tried to make student loan payments, but they were returned by AES. I completed my plan and my bankruptcy was fully XXXX in XXXX. In XXXX, I was advised by AES that my loans now totaled over {$130000.00}, due to the interest that compounded during the bankruptcy. My attempts to have AES forgive the interest during the bankruptcy ( since it refused payment ) were futile. The balance is now over {$160000.00}, and I will be in repayment until I am XXXX XXXX XXXX. The monthly payments are {$1300.00}. Again, I graduated in XXXX, and have not returned to school since that year. I have repeatedly requested a copy of my XXXX consolidation application, to find out the repayment terms. AES can not provide me with the document. I have been making payments now, excluding deferments and the five-year bankruptcy period, for 22 years. Any help will be greatly appreciated. Also, I have been denied a pause on payments during the pandemic, which is difficult, as my husband can no longer work due to a XXXX. Thank you. XXXX XXXX

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Investigation took more than 30 days

Consumer Complaint: XXXX Report dated XX/XX/XXXX, AES shows I'm late XXXX, XXXX, XX/XX/XXXX. This report also shows I'm was late XX/XX/XXXX. XXXX Report dated XX/XX/XXXX, now shows I was on time all of XXXX. They completed deleted my late payments. And this report states I was on time XX/XX/XXXX. Why does this company keep changing my past due dates? More recently, after my dispute with XXXX dated XX/XX/XXXX, they changed the date this account was first reported, from XX/XX/XXXX to XX/XX/XXXX. Again, why does this company keep updated and changing the dates on my report? Furthermore, not AES nor XXXX have supplied me with the information used to verify and validate my profile the way it is being reported to the credit bureaus. In addition AES states they no longer are in possession of this loan. If they are no longer in possession of it what do they keep incorrectly updated my file? Lastly, this account and case was dismissed by a Florida judge because after 11 months they refused to submit any documentation that substantiates their claim that I was in breech of a contract. This matter has been escalated to Florida Attorney General XXXX XXXX XXXX Consumer Protection Division and I'm actively interviewing attorneys to proceed with litigation.
