Issue: Managing an account

Subissue: Problem using a debit or ATM card

Consumer Complaint: We always check our bank accounts to check on balances and transactions. We were surprised to see a {$1000.00} ATM withdrawal from our account on XX/XX/XXXX. The withdrawal was a Non-WF ATM withdrawal somewhere in Pennsylvania. My husband and I were nowhere near Pennsylvania at that time. As a matter of fact, we were not in the United States at that time the withdrawal was made as we were both on a cruise from XXXX XXXX XXXX and we both have our ATM cards in our possession. My husband had been XXXX since XX/XX/XXXX and only returned to the United States on XX/XX/XXXX. As a matter of fact, my husband used his ATM card in the XXXX which shows that he has his card in his possession. We contacted Wells Fargo Bank N.A. right away to report the fraud incident. They conducted an investigation and told us that our claim is denied as the chip was used to conduct the ATM transaction by us or someone authorized by us and it was legitimate. We have proof we were out of the country when the incident happened so it is impossible for us to make the withdrawal. I sent an email to their cardclaim department and attached copies of our airline itinerary and cruise documents showing that we were out of the country. They told me that a supervisor would contact us in the next 2 business days but we never got a call back. I called again and was told the same thing but never got a call back. Someone called us yesterday while we are at a graduation ceremony and left a voice mail. We tried calling that person back, but no success. I searched the internet and XXXX if a card chip can be duplicated and sure enough there were articles of criminal activities of cloning ATM chips. I demanded Wells Fargo to investigate further but they refused and insisted that our case is closed. Our case is never closed for us as we are out of pocket by {$1000.00} plus the {$2.00} Non-Wells Fargo transaction fees. We are not rich people and this amount is a huge amount for us. Wells Fargo is supposed to protect our money. However, in this case, they did not protect us and they did not do their due diligence. They should go after that person who made the withdrawal who obviously is a criminal and conduct a more thorough investigation and return our money back to us.

Issue: Managing an account

Subissue: Problem making or receiving payments

Consumer Complaint: Complaint Against Well Fargo Bank Situation Details : Well Fargo Banking Error that I am paying for currently. I received a check from XXXX XXXX Administrators for a car accident I was in on XX/XX/XXXX. I was going to deposit this check online, so I wrote on the back, deposit online only but the funds of {$8100.00} was too much to deposit online. So, I put a line through the check on the 2nd line of the check below my signature. Although this check had been scratched on the 2nd line the Well Fargo teller continued to process the check when I went in to make the deposit to my account. Both the teller and her supervisor saw the check and made no comment about the scratched-out information on the back. If they had and told me, they could not deposit the check due to the scratched-out writing ( That I wrote on the 2nd line ) I would have gotten a new check from XXXX XXXX Administrators with no issue. Now I understand Wells Fargos end on a check being altered might cause a flag but that should have been caught at the branch or by the Fraud department before they allowed the funds to be validated. Then have be me go and get a new check to be deposited to the account. Now they are stating that there is suspicious activity on my account due the check and they closed my account. Even though I have been getting direct deposits for months. There was a negative balance at the time of deposit transaction, that would have Been cleared by my check I was depositing and 2. Would have been cleared by my direct deposit that was coming out just a few days after the check was deposited, but before that happened Wells Closed my account. They did inform that there could be a 7 day hold to validate funds of a large amount which I was okay with, then they said 2 weeks which would then they said on XXXX the funds would be available. Now they are continuing to hold my funds asking for something called Proof of issuance making me validate the check by getting something written to say this check is a check made out to me. I have provided them with as much information as I can get from XXXX XXXX Administrators group, phone numbers contact names, etc. but they still are making me chase down validation information. Which isnt right because they deposited the check which verified the funds and used it on my account. So how can they use it to clear a negative balance but then keep the rest? I have been able to get some of the money out, but there is still a balance of {$3200.00} that they are holding from me. That is the amount I am looking to get off hold of Wells Fargo. I have bank statements, email conversations with XXXX risk that are associated with the email account assigned to my former Wells Fargo account. I will attach these documents to the claim. This also shows how Wells paid my negative balance with the deposited check showing there used and verified the funds. I also have a document from XXXX XXXX showing wells did clear the funds on their side on XX/XX/XXXX. The mistakes this to make it seem like was at fault and like I was doing criminal activity even though the mistakes that have been made are solely on Wells Fargos side. I have contacted both Berkly Risk Administrators and Wells Fargo Fraud department that I would like CFPB to contact and mediate if possible so I can put this failed mess of Wells Fargo behind me. Been trying to work with Wells on contacting XXXX but keep give me different responses. They also never said why they actually closed my account.

Consumer Complaint: I use to have an account with Wells Fargo Bank and the made many charges on my debit and credit card and never solve the issue, I ended closing my account and a few months later I started receiving letters from the same institution saying that my account was overdraft, I went to the bank and the person who helped me out said that the manager open another account under my name, that was with out my authorization. I also had a credit card on those times and they sent several bills to me, I was scared so I paid those bills to the bank but now I read about all this issues, I would like to file a complaint. Issue: Applying for a mortgage or refinancing an existing mortgage

Subissue:

Consumer Complaint: During the last week of XXXX, we first became aware that Wells Fargo had filed a notice of default, dated XX/XX/XXXX, with the intention to foreclose on our home at XXXX XXXX XXXX XXXX XXXX The home, as previously held in the name of the Trust of XXXX XXXX XXXX was wrongly allowed to be used as collateral in a personal loan taken out by XXXX XXXX XXXX ( deceased ), mother-in-law and trustee to the now defunct trust. The property was transferred into the name of XXXX XXXX XXXX belatedly and by court order in XXXX but was, by attorney error, quit claim to XXXX with the encumbrance of the WF lien. Our complaint is that we have made multiple efforts to speak with Wells Fargo about this loan as we are obtaining a mortgage to remedy the debt and prevent losing our home with substantial equity however no one will speak with us about the payoff amount. XXXX XXXX has personally reached out to the WF Life Events and Home Equity Deceased ( XXXX ) Departments and both continue to say they can not discuss the loan. We believes Wells Fargo may be intentionally blocking our attempts to allow us the opportunity to payoff the loan and halt the foreclosure process. XXXX XXXX first received written notice of the action in a certified letter on XX/XX/XXXX. No recourse as to how he might contact WF to resolve this debt was included. On XX/XX/XXXX, we had already begun forwarding documents demonstrating his rightful ownership of the property he has occupied for 37 years. Our lawyer, XXXX XXXX submitted a Letter of Representation on XX/XX/XXXX, to XXXX XXXX, collector and current trustee for this issue, requesting to discuss this foreclosure action for a resolution. We have made multiple phone calls to XXXX XXXX who have continually advised us all the ownership documents are " being reviewed at the WF legal department ''. On XX/XX/XXXX, we first met with XXXX XXXX, Relationship Banker at Wells Fargo in XXXX, UT. Our title company, XXXX XXXX has since furnished him with rightful ownership documents. We contact XXXX regularly and in spite of him also fulfilling all requests to supply his head office with these documents relating to the correct ownership of XXXX XXXX, his attempts to help us look at refinancing the existing loan have been futile with no response forthcoming. I filed a previous complaint protesting the original action on the part of WF to allow such a loan but was advised in their response that we need to pursue it as a civil matter which we are doing in the XXXX XXXX civil court here in XXXX XXXX XXXX with XXXX XXXX XXXX. There can be no resolution in time to halt the process so, in the meantime, we plan to payoff the loan. Mortgage payoff documents have been requested by the lender. XXXX XXXX, HUD Certified Mortgage Modification & Rental Counselor at XXXX XXXX XXXX XXXX XXXX in XXXX, Utah, whom we are consulting to help with this foreclosure, has likewise reached a closed door in contacting WF to help us modify the existing loan. We all recognize that XXXX XXXX ' name is not on the loan itself because neither he nor his deceased wife, XXXX, were responsible for making payments on the loan. XXXXXXXX XXXX loan documents specify she was responsible for insurance, property taxes and maintenance of the home and all payments apparently ceased when she quit as self-professed trustee of the XXXX XXXX XXXX XXXX XXXX XXXX resulting in the WF foreclosure action. Could someone just tell me how it is that WF continued to address XXXX XXXX XXXX at her home residence of XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX as demonstrated on the attached letter, when loan restrictions clearly required she be occupying the home at XXXX XXXX XXXX XXXX as her primary residence which she, in fact, never did? Can you not see how this letter demonstrates WF was complicit in " looking the other way '' in the XXXX some years she continued to do business with Wells Fargo while maintaining two back to back loans on our home at XXXX XXXX XXXX XXXX which she falsely claimed as her primary residence? Does evidence get any clearer than this? Finally, it seems that CFPB has been " left the fox guarding the henhouse '' in expecting that WF will make a fair and equitable decision to our complaints by asking them to find themselves in error to have allowed this loan in the first place. Do the right thing now!

Subissue: Transaction was not authorized

Consumer Complaint: On XX/XX/2023 Wells Fargo processed XXXX ATM withdrawals from XXXX different checking accounts totaling {$3000.00} along with several XXXX purchases. WF has refunded the XXXX purchases, but has not refunded the {$3000.00} stolen from my account. The first attempts to withdrawal the money were DENIED, however WF approved the subsequent transactions without ever verifying my identity. This is opposite how they would handle any credit card transactions. Once there is attempted fraud on the account, i don't understand why they would approve additional transactions The Wells Fargo case number is : XXXX

Issue: Trouble during payment process

Subissue:

Consumer Complaint: I have been in communication with the Mortgage servicer regarding information recently discovered. There is an associated complaint, and it is not corrected. XXXX complaint id I have a copy of the credit report showing the lender reported to my credit bureau report that my note was paid in full on XX/XX/2008. Paid as agreed with 228 payments of {$980.00}. that totals approximately {$220000.00}, in 15 years, we paid note off early they reported the note as paid, and 2 years later they had attorneys evict us from the property. They lied on the answers on the previous report complaint and they have never answered my questions that I ask, they reword the questions and then answer what they want to answer. I paid off my note and they did not tell me, but the attorneys who evicted me from my home, had information, and evidentally Wells Fargo failed theyre duty in following thru. As you can see in the attached letters from them on the complaint, and on my questions, they stated, they sold the home again to someone. After reporting I paid off my note, even after that the banks attorneys were constantly defaulting us, they never answered theyre phone, or my calls, or questions, at the time we had no idea that we paid our home off early, but when we look at the ledger it all adds up. Some how, this happenned and it was not reported as a foreclosure, they know we paid it off, and in the letter they state, that the information they reported to the credit bureau was accurate, so why am I homeless. I am asking for the money I paid for that home to be returned to me with interest, and cant see a reason why, this is not a good reason to collect from them. Truth in lending disclosure which they are not mentioning anything with that, as they never even acknowledge that it is a final document and attached to the note. Furthermore how much do they think they should get for a {$75000.00} note, the truth in lending disclosure stated when we make all our payments in 30 years we would have given them XXXX, well we gave them {$220000.00} in 15 years and they stole our home, and never had to show proof of any ledger for the foreclosure, they have washed the ledgers and rewritten them several times, but we have the original, another thing is in theyre requests for a copy of the payment history internally with theyre company they request only until 2008, why is that, because it was paid off in 2008, and they reported it to the bureau, but then they say, what we reported is accurate, so with that how did they take my home.
