At the time I was salaried at 42k a year + OT. In XXXX of XXXX the company I worked for re-structured and I was let go along with many others. Little did I know that at the same time this happened the economy crashed. It was impossible to get hired again in my occupation as XXXX. While I was able to get a loan modification, it did not reduce the principle on the loan leaving me upside down on the note. Owing XXXX on a home worth around XXXX plus a XXXX mortgage of XXXX.I have stayed in my home determined to keep it regardless but got behind by XXXX payments back in XXXX. Since XXXX XXXX I have been in the same very stable position, but have not made enough to handle all the late fees from back payments. My mortgage is now XXXX of my take home pay and has made it difficult to make ends meet. Now another hardship of a family emergency with a parent that needed me. This has left me more than 3 months behind. I applied for a loan modification back in XXXX and was turned down by OCWEN. They said I did not make enough money. I applied for another loan modification with them, this time my mother paid my health insurance. OCWEN then said that I made too much money and did not need another modification. They said that they were a loan servicer and that they did not have the means to do a principle reduction. In short, I stayed in a home that has been underwater for most of the years that I have owned, put a lot of money into it. Loved my neighbors like family but am not able to get caught up on my payments and am sorely in need of a principle reduction /loan modification. Consumer Complaint: I represent XXXX XXXX, who is trying to stop the foreclosure of her home. Originally, the property was purchased by XXXX XXXX, XXXX 's partner of 20 years and common law husband. The XXXX separated and XXXX remained in the property. A foreclosure was initiated in XXXX. XXXX agreed to transfer the property to XXXX in XXXX, and the foreclosure was voluntarily discontinued and then filed again with XXXX and XXXX as defendants. XXXX has been working with me to try to get a loan modification since XXXX. However, Ocwen, the current servicer, will not provide any information on the account, nor will it provide any instructions on whether and how XXXX can assume the mortgage.I contacted Ocwen several times ( with permission from counsel for the mortgage holder XXXX XXXX XXXX XXXX but Ocwen would not provide information about the account without XXXX 's authorization. After making several attempts to get information, Ocwen eventually transferred me to the assumptions department, which instructed me to fax a request for an assumption. I faxed the request on XXXX XXXX, XXXX along with a copy of the deed to the property from XXXX XXXX to XXXX XXXX, as evidence of her ownership interest in the property. I have not received a response from the Ocwen about whether the loan is assumable or how XXXX could assume the loan. I have also not received a response to whether the streamlined modification offer sent to XXXX could be accepted by XXXX. When I made that request, Ocwen responded by contacting XXXX and informing their attorney that they could not reach the borrower, rather than attempting to reach my client. There is some urgency to this matter as the foreclosure case is scheduled for trial sometime in XXXX and Ocwen has not reviewed XXXX 's application for a loan modification or an assumption.

Consumer Complaint: My mortgage loan servicer, OCWEN, send me my mortgage interest statement ( " substitute form XXXX '' ) for XX/XX/XXXX. On it, I noticed a mistake in their favor. My property insurance and property taxes are " escrowed in '' with my mortgage payments. The annual property insurance of {$590.00}, was mistakingly deducted from my escrow account XXXX, on XX/XX/XXXX and again on XX/XX/XXXX. I contacted OCWEN on XX/XX/XXXX about this issue. After many frustrating hours on the phone, with people in XXXX and the XXXX, finally employee XXXX, ID # XXXX, discovered what went wrong : They mailed the payment XXXX to a wrong address of XXXX, whom I have my property insurance with, then they got the check returned to them and then they mailed a new check to the right address. The problem is that OCWEN deducted the amount XXXX as disbursements from my escrow account, and never reimbursed me for the mistakingly XXXX deduction from my account. A supervisor, XXXX, ID # XXXX, XXXX, ID # XXXX and I had a conference call about this issue and it would be researched. On XX/XX/XXXX, I had heard nothing, so I called OCWEN again, and only after suggesting that I might take legal action, did I get connected for the XXXX time with somebody in XXXX USA. His name is XXXX, ID # XXXX and he is a manager for OCWEN. Finally he understood and saw the problem, which can be very easily seen on form XXXX, and he figured the issue will be fixed in a couple of days. A week later, on XX/XX/XXXX, he called me, but had absolutely no information other than that the issue is not resolved. I waited till XX/XX/XXXX to call XXXX again, who had given me his phone number and extension, XXXX ext. XXXX, only to get an answering machine. I left a message with my phone number, loan number and a reminder of the issue. On XX/XX/XXXX I tried to call several more times only to get an answering machine. On XX/XX/XXXX I left another message. Up to this moment in time I have not heard from XXXX or anybody else from OCWEN. I called the " note holder '' of my loan, XXXX, and they informed me that OCWEN has the servicing rights, but that OCWEN does not work for them. They said I would get results solving this issue by filing complaint with you, the CFPB. All in all, OCWEN has now been shorting me on my escrow account 16 days short of one whole year, and known about and admitted to, the {$590.00} mistake for 34 days. No action has been taken to reimburse my account and I am being completely ignored with all my phone calls and messages to the employee who would handle this issue, XXXX.

As of XXXX 2015, my mortgage payment will be {$2400.00}. They have stated the rate increase is do to {$3500.00} for property tax, {$640.00} for FHA, {$1200.00} Hazard Insurance, *** {$1200.00} for New Loan Setup***I should not have to pay {$1200.00} for New Loan Setup. This loan was taken over without my knowledge by Ocwen. My original loan was with GMAC who went out of business. Why do I have to pay when I had nothing to do with GMAC going out of business and selling my loan. This seems to me as another form of Predatory Lending tactics. The payment was returned two weeks later. I was told today I had to pay the late fees and could not repay them later ( as told by previous rep ). The delay increased the amount I owed to more than a thousand, catching me in complete dire straits. I do n't understand why I can not get out of default paying the months I missed alone. Consumer Complaint: Ocwen sent an escrow analysis stating we needed to pay {$410.00} for a shortage ( even though by their own paperwork we had a {$0.00} shortage on our mortgage this past year ) I mailed the check, it was received and documented by the post office, cashed with in the time limit set by the company, even so our mortgage payment was increased to the level as if we did n't pap the shortage. When I called to find out why it was increased - I was told I needed to call again after the payment was made to request a new escrow analysis. Why? you did XXXX told me I was short and I paid it. I want the overpayment refunded to me and the monthly amount corrected.
