Consumer Complaint: XXXX XXXX have an insurance ( insurance ) claim, due to a fire, the claim begins with XXXX XXXX XXXX, and was transferred over to Owen Loan Servicing. The XXXX draw was distribute to the contractor, However he did any building,, Ocwen was informed of the matter on hand, when the loan was transferred over. I informed Ocwen again of the matter. Ocwen states that it is XXXX XXXX XXXX responsibility because the check was sent out by XXXX XXXX XXXX. And they can not act on the issue, with out Authorization from XXXX XXXX XXXX. Ocwen wants to know why I am inquiring of the matter, to them and they will not take any action on the matter, or assist with the issue. Per Ocwen it 's XXXX XXXX XXXX responsibility. Per Ocwen they will not do the necessary process to inquire about the XXXX, for the completion of the repairs because it is XXXX XXXX XXXX responsibility. And for me not contact them, any more. I received ( return ) a call from, Ocwen ( XXXX ) representing XXXX XXXX XXXX. On what they can and want do. Per XXXX, it is Ocwen responsibility to inquire with the contractor, on the repairs. Because the loan is with them and the money is part of the Mortgage loan. Please see Attachments. Per Ocwen, they need XXXX XXXX XXXX authorization, to proceed to take action on the money. Due Ocwen need Authorization to move forward with Retrieving the Missing Money ( Funds ).

Consumer Complaint: On the advice of an Ocwen rep, I made a XXXX payment on my mortgage. They told me that there was no scheduled payment in their system though I swore I had made one. A couple days later, I checked my bank account and found that there were XXXX ACH's pending, so I put a stop payment on XXXX of them. The bank charged me $32 to do this. I have sent the proof to Ocwen and they have gone back and forth with me.

Consumer Complaint: We sold our home and closed the account with OCWEN XXXX XXXX. In late XXXX they took another loan payment from our checking account. After repeated Emails we received a check for reimbursement. Then they did the same thing in XXXX. Again after several conversations we received another reimbursement check. In XXXX they tried again, this time we did n't have enough funds in our account so we now have over 100 dollars in overdraft fees. We are living out of the United States so this makes everything more difficult. After more emails and expensive phone calls. We finally got another email saying after checking their records we were mistaken and they never took any funds from our account after we closed the loan. I have never dealt with a company as inept as this. The sad part is we tax payers bailed out their company when the economy crashed, big mistake

Consumer Complaint: Ocwen took over my loan XXXX XXXX. My mortgage has been a total nightmare since. The most latest issue is as follows : Please find attached documents for your review ). I was approved for the Florida Hardest hit fund ( HHF ). Monies were actually funded and posted to my loan on XXXX/XXXX/XXXX in the amount of {$50000.00}. Ocwen sent me a " MODIFICATION OF PROMISSORY NOTE '' which I signed and had notorized. As you can see by the attached document, Ocwen 's Loan Servicing had XXXX persons sign this same document. Promissory Note is entered into XXXX XXXX, XXXX. Based on this Note, I started making my monthly loan payments, P & I then add in my escrow, which is {$120.00} for XXXX. All of sudden, Ocwen is sending me Default Notices. As you can see by my PAYMENT HISTORY from Ocwen 's Website, my payments are made per our contract, each and every month. Payments are due on the XXXX of every month, I have a grace period up to the XXXX of each month. I live of Social Security XXXX, only, each month. Ocwen continues to put my Mortgage payments into a Suspense account each nmonth, rather than posting to my loan. Ocwen is now claiming that I owe them over {$2500.00} dollars. They have never changed the payment amount in their system to reflect what is on their contract. Now, Ocwen claims the 'MODIFICATION OF PROMISSORY NOTE '' Is 'NULL & VOID '' How can that be? It is my opinion that we agreed and entered into a legal contract together. Now they want to back out of this contract. Can they legally do this? Is it considered to be a legal & binding contract? If so, how can I get them to realize this and change the figures in their system. I have been working with their account Representative " XXXX ''. Her supervisor finally got involved and he escalated it to the Modification Department who states they can not honor this contract since they are claiming my loan can not be recasted. Before the HHF money posted to my loan, I owed approximately {$120000.00}. Then after the monies were posted to my loan my Principal went down to {$75000.00}. What Ocwen is doing, is making me pay my monthly loan payments based on thel old balance. I am requesting that the contract of XXXX XXXX, XXXX be honored and the payments are to change according to this contract. Why do I do next? I can not afford an attorney. HELP!!!! I will have no place to live if Ocwen takes my loan into Foreclosure. I pay every month .... Your assistance is much appreciated.

Consumer Complaint: I am on a bi-weekly advantage payment plan that makes my monthly mortgage payments on my behalf to Ocwen. These payments are sent by XXXX Bank XXXX Ins company each month. On XXXX XXXX, Ocwen misdirected my monthly payment to my Escrow account. XXXX different Ocwen escalation agents have confirmed this is an error on Ocwen 's part. XXXX promised it would be taken care of within XXXX business days and provided me a number to reach them at directly if it was not resolved by then. XXXX have not been reachable since. It is now XXXX, I 'm still receiving collection calls and letters. And today XXXX/XXXX/XX/XX/2015 I received a formal letter in the mail that requires me to respond by XXXX/XXXX/XX/XX/2015 as to whether we want to refinance our house or apply for a loan modification. We do n't need assistance in paying our mortgage, Ocwen needs to apply our payment appropriately. Additionally, we pay approximately {$420.00} extra dollars towards our principal each month of which they are placing in a suspense account because they say they can not apply it to the principal until our loan is current. Our loan is CURRENT. I 'm at my wits end and feel it is time to hire an attorney. I have documentation to support this claim, as well as XXXX XXXX 's confirmation directly to the escalation specialist of the payment and the check number, of which they have confirmed was indeed cashed. The escalation specialist # 1 was XXXX, XXXX ID XXXX, XXXX, extension XXXX and # 2 XXXX XXXX, phone number XXXX, option XXXX, extension XXXX. Additionally, on XXXX/XXXX/XX/XX/2015 XXXX XXXX instructed me not to make any further payments until this was resolved to cut down on confusion on which payment I was making while they work this out. Had I followed his direction I would likely be in line to lose my home at this point.

Consumer Complaint: I wanted to short sale this property and I called GMAC mortgage and they advise me that I would have to go late XXXX days on the mortgage to do a short sale. They put me info forclosure at the same time as the contract was submitted to them. I was n't in forclosure at all and I was XXXX days and not XXXX days. Doing exactly instructed by GMAC mortgage. This loan was closed by XXXX/XXXX/2012 and property listed for sale XXXX and contract was signed XXXX/XXXX/12 by seller and buyer. I have attached copies of documents. Showing this was never into forclosure.

Consumer Complaint: Ocwen has made numerous mistakes, delay tacktics, postdating items I have sent in, and now decided to foreclose without any notice or proper advertisment of my foreclosure. On XXXX XXXX I received a letter from Ocwen stating that my loan had been postponed and that as of this date, no future date has been determined. I continued to sell my house and my house is due to close on a sale in XXXX days. I submitted this information to Ocwen on XXXX the XXXX. They wrote me on the XXXX that my home was being sold at auction Tomorrow XXXX XXXX. I supplied them with a copy of the letter and they wrote me back and stated they did not need to give any notice to sell the property. I was given no information of the sale, I asked for copies of proper advertisement and they did not provide it. I am beyond myself. I have filed several complaints about there actions which are currently under review. Alaska statute states they must properly advertise the sale prior to foreclosure for date and time. This has caused me extreme hardship. They stated they would postpone the foreclosure if I provided proof the loan would close on XXXX XXXX, which gives me XXXX business days notice to foreclosure. There letter clearly stated no new date had been set. I could have secured short term financing for the amount due but since the house has sold and they did not set a new foreclosure date, I opted to do the entire payoff. I also notified Ocwen they had made an error by not advertising the sale and not giving me notice and denied me the XXXX day delay until they formally respond. Now they tell my I have to submit any further correspondence with them in letter form to ensure delays in my correspondence instead of contacting them by email.

Consumer Complaint: Ever since my mortgage was transfered to Ocwen always had problem with this company. the latest is about last week XXXX/XXXX/2015 I send this company XXXX payments of {$5000.00} dollars and another payment of {$530.00} via electronic transfer to be applied towards my Principal balance. Before I make transfer I called the company and instructed them to apply all this payment towards principal and they should continue to take my monthly mortgage according to automated Periodic payment I have set up few years ago. They assured me that they do just that. As I was tracking my payment, I noticed that they have not applied all the payment and they have taken XXXX payment of {$530.00} for months of XXXX and XXXX despite them assuring me that all payments will be applied towards principal. Since I discovered this, I have call them on XXXX separate times and every time they can not confirm definitely the will do just that. I have never been late in my monthly mortgage payment ever and I do n't accept this behavior and mismanagement with my money.

Consumer Complaint: I purchased a house a few years ago, and got a fixed 30yr mortgage. The monthly payment, including taxes came to {$2500.00} ( {$1900.00} for principal and intrest and {$600.00} for taxes ). About a year ago, the mortgage changed hands and the new company is now charging me {$2600.00}. I was confused by the increase in amount as it is a fixed loan and my taxes have not gone up. I called the company multiple times to try to figure out why, but the best explanation I could get was that they were now demanding an additional {$8000.00} sum to be kept in an escrow account, in addition to monthly sum I was already paying towards my taxes. I checked the fine print of the contract, and it is RESPA compliant, which means the amount the are charging is illegal.
