Consumer Complaint: INDY MAC WAS MY LOAN SERVICING COMPANY FROM THE DAY I ORGANICALLY BOUGHT MY HOME BACK IN XXXX OF XXXX I HAD SIGHED TO BE IN A 3 YEAR ARM AT XXXX INTEREST RATE AT THE END OF THE THREE YEARS THEY HAD ME SIGN PAPER WORK TO GO ON A FIXED RATE OF XXXX XXXX I WAS INVOLVED IN AN ACCIDENT THAT RESULTED XXXX AND I WAS UNABLE TO WORK FOR THE PAST 4 YEARS THAT CAUSED ME TO FALL BEHIND IN MY PAYMENTS, TIRING HARD NOT TO DEFAULT IN MY MORTGAGE SINCE I HAVE XXXX MINOR CHILDREN SO I REQUESTED A MODIFICATION INDY MAC PUT ME ON A 3 MONTH TRIAL PERIOD STARTING XXXX XXXX IN THE TRIAL PERIOD INDY MAC TRANSFERRED MY LOAN AND PAYMENTS I MADE TO OCWEN. OCWEN CASHED MY CHECKS FOR THE NEXT XXXX PAYMENTS BUT NEVER SHOWED ANY CREDITS TOR WARS MY ACCOUNT. I HAVE CONTACTED THEM ABOUT THIS ISSUE A NUMEROUS TIMES THEY AVOID MY QUESTIONS AND ASK ME TO REFINANCE EVEN THOUGH THEY KNOW I AM UNEMPLOYED JUST SO THEY CAN COVER UP THE MONEY THEY TAKEN THAT THEY CAN NOT ACCOUNT FOR WHICH IS ABOUT $ XXXX.ADDED XXXX MORE YEARS ON THE LIFE OF MY LOAN I HAD MADE PAYMENT FOR 10 YEARS WITH NO DEFAULT I WAS DOWN TO 20 YEARS LEFT ON THE LIFE OF MY LOAN NOW I AM AT A 40 YEAR LOAN MAKING MY OUTSTANDING LOAN AMOUNT SIGNIFICANTLY LARGER THAN MY OUTSTANDING BALANCE AND NOT SHOWING ME WHAT THEY DID WITH THE XXXX PAYMENTS OF {$2.00} BUT REPORTING TO THE CREDIT BURIALS ABOUT LATE PAYMENT WHICH ARE FALSE SENDING ME A FALSE TAX RETURN THAT SHOW NO PAYMENTS MADE XXXX AND HALF OF XXXX. Issue : We have been in foreclosure since XX/XX/XXXX. It is XX/XX/XXXX. Back then my husband had lost his XXXX figure job and then took a $ XXXX/Hr job, now he is back to nearly XXXX figures, but we are still fighting foreclosure! The bank is using ROBOSIGNED FALSIFIED DOCUMENTS IN A COURT FORECLOSURE STATE, ( CT ), BUT OUR ATTORNEY WOULD NOT ARGUE THAT BECAUSE JUDGES DO NOT LIKE TO USE " FRAUD '' BY BANKS TO " GIVE HOUSES AWAY ''. The mortgage originated with XXXX XXXX XXXX XXXX XXXX XXXX went bankrupt XXXX XXXX, XXXX. HOW WAS AN ASSIGNMENT OF OUR MORTGAGE SIGNED BY AN " ATTORNEY-IN-FACT '' for the XXXX XXXX XXXX Mortgage by an OCWEN employee and notarized by an Ocwen employee with initials of reported robosignors in XXXX XXXX? FACT : THE ASSIGNMENT OF OUR MORTGAGE TOOK PLACE TWO YEARS AFTER THE MORTGAGE COMPANY WENT BANKRUPT AND THE ASSIGNMENT WAS SIGNED ON BEHALF OF THE BANKRUPT BANK TWO YEARS POST BANKRUPTCY. There is a " lost note affidavit on file. They had to have some " PROOF '' they had the right to the house, so why not falsify the assignment to XXXX XXXX who is actually the trustee!!!! acting on behalf of XXXX XXXX XXXX XXXX, XXXX XXXX to whom the mortgage was transferred purportedly?????

Consumer Complaint: There was wrongful foreclosure sale on my property ; XXXX XXXX XXXX XXXX, XXXX, GA XXXX. XXXX, XXXX, XXXX XXXX, XXXX, acted as the debt collector in this foreclosure. Ocwen Loan Servicing was servicing the loan, but are not the owners of the debt. Correspondence was sent to Ocwen Loan Servicing demanding validation for the debt. Ocwen Loan Servicing sent paperwork trying to validate the mortgage on the home, but was unable to validate the debt. Also the transfer or Assignment of Deed has signs of " robo-signing '' as well as incorrect information. Transfer of the mortgage has not been done correctly nor has the mortgage company validated the debt. Also there is an Affidavit of Fraud done that never got answered.

Consumer Complaint: on XXXX XXXX we had struggled to get a loan modification through XXXX mortgage after getting XXXX with a 3 % interest we signed on the dotted line. At the time we saw that they had installed a balloon payment of over {$28000.00} they said it was for the payments in arrears but we never missed more than 6 months of payments and this was only because XXXX mortgage said to stop paying thats the only way they would help us. Anyway back to the present ocwen our mortgage lender now added money to this bringing it to {$31000.00} that ocwen has added to our principle remaining balance. We our in the final stage of getting a va refi but again ocwen has tried to rip us off. after i had looked at our modification agreement i found that ocwen violated the contract by not changing our loan to principle and interest which they did not due .The mod agreement states that interest only period will end on XXXX XXXX XXXX which they did not due so now its going on 2 years later and only because i caught them violating the agreement on XXXX XXXX XXXX i had called them and are payment was at {$1700.00} and when i called on XXXX XXXX XXXX the payment doubled over night they took our 3 % interest and raised it to 7.25 % over night iam not a lawyer but this is against the law. So what we wanted them to do is remove the {$31000.00} from our principle loan balance because XXXX out of paying 2 years of principle on our house. they then said they would look into this matter and when i called back they told me that the amount of {$37000.00} would be removed from the pay off amount after the letter was approved .Ihave called almost everyday to find out when this would be removed so we can then payoff the remaining principle balance and get away from this completely crooked company .We were told that it would only take 10-15 days it has gone past that now they tell us to give them 24-48hrs they have said this 3 times .You can now see what we have been dealing with for years now please help us make them remove that fraudulant {$31000.00} deffered payment from our payoff amount so we get finally get a real XXXX fixed mortgage using my va refi. So were asking for any help that you can give us .Me and my family would like to thankyou in advance for any help you can give us to get them to remove that {$31000.00} from are payoff so we can proceed with our va refi thankyou.

Consumer Complaint: Because I view CFPB as a neutral government entity, I feel confident that keeping you updated to my plight is the right thing to do in my complaint process. I have submitted documents several time to Ocwen for a modification over the past month. My previous experience over the past years of dealing with this company is the issue of them stating documents are missing or information is missing. This is the same thing I have been told several times including two days ago, as the reason my request has not been processed. As a record I sent the documents through several different well established organizations proving the documents were sent and what was sent. Most recently I am told my IRS form and section XXXX and XXXX are missing here are the documents. I do n't understand why Ocwen is refusing to work with me.

After paying on the loan for the 3 years in thebankrutcy, I owed the mortgagae company more than the original loan before the bankruptcy was filed. The loan was eventually sold to XXXX and Owcen Servicing was designated as theservicer of the loan. I was offerd a modification by Owcen which I accepted, trems were given and I began the payment cycle. I do not think Ocwen is honoring the terms of the agreement

Consumer Complaint: I am submitting a complaint against Ocwen for failing to fulfill their commitment to proceed with the short sale of my primary residence. I am requesting a short sale of my primary residence. I have XXXX mortgages. The XXXX position mortgage is with XXXX and the XXXX position mortgage is with Ocwen. My representatives for the Short Sale are XXXX XXXX and XXXX XXXX with XXXX XXXX. My representatives contacted Ocwen on my behalf to request a short sale. Ocwen initially denied my short sale request. However, after further negotiations, Ocwen verbally indicated they would honor a short sale should we obtain HAFA approval with CitiMortgage. We have since secured HAFA approval with CitiMortgage. However, Ocwen is now denying the short sale.
