Issue: Cont'd attempts collect debt not owed
Subissue: Debt is not mine
Consumer Complaint: The debt belongs to my ex-husband ( divorced 18 years ). He died on XXXX XXXX, 2016, therefore, he has not been paying his bills, because he is dead. I have explained to these people XXXX separate times, that I have nothing to do with my dead ex-husbands debts. I know they did an internet search for a related phone number and they focused on mine, as I am the only XXXX with a landline. My name nor phone number was never on his account, as he continued on with his life independently of myself. I have also told these people that, I am on the " Do NOT Call '' list and, they need to remove my phone number from their call list, especially since I had nothing to do with my ex-husband 's finances. They have refused to remove my number " unless an authorized person states it should be removed ''. I told them Good Luck with that, unless they can communicate with the dead. My dead ex-husband being the only authorized person on this account. I have also told these people XXXX that, his adult children will fax his death certificate to them, this Monday, XXXX XXXX, 2016, when they return to work. They continue to incessantly ring my phone and disturb my right to peace.

Consumer Complaint: On XXXX XXXX XXXX I submitted a compliant against Ocwen home mortgage servicing my loan because at that time I had been held in default since XXXX unable to make any payments while my loan was bought and sold numerous times. 2 years later XXXX XXXX i am still in the same situation but now after having been assigned 4 project managers with Ocwen and filled out and sent in all my HARP required information 8 total times I have had no choice but to file for bankruptcy because my total amount owed now with late fees and penalities over 7 years has my loan repay over XXXX on a loan which was XXXX but never allowed to make payments in 7 long years. I have spent XXXX on lawyers assisting me to stop their foreclosure efforts 3 times over these seven years. Each time I thought I was going to have a deal worked out with them I would be blind sided with papers of Ocwen trying to foreclose on me while I am in the middle of my work out programs with the assigned counselors. In XXXX I received a letter telling me i was denied a refinance program due to my income which was reported XXXX less then the information i provided them. Then the VERY NEXT DAY I received another letter telling me i was assigned a new counselor and to send in all my required paperwork after I had just sent in all my information and having monthly conference calls with the project manager to ensure I sent it all in. Then the letter would tell me that once all the proper paperwork was received no further action on foreclosure would occur over the next 30 days of the review process. The same letter I received 6 times. 2 times i did n't received anything for my submission.. It is so confusing at this point that when I speak to attorneys they look at me as though I am making this up. i need to move on with my life and bankruptucy due to a loan they will try to collect from me for XXXX would destroy what is left of my future. I do n't even have a solution at this point I am speechless and they need to know how lives are destroyed. lastly I have every single email, fax, paper and letter over the years as well and did everything a consumer was asked to do such as I attended all monthly assigned conference calls with counselors. I met counselors at the XXXX who were as stunned as I was with my situation. It has consumed and ruined much of my life these past 7 to 8 long years

Consumer Complaint: Ocwen has serviced my mortgage for the past several years, succeeding GMAC when GMAC sold its assets in bankruptcy. In the past few years I have received several communications from Ocwen that appear to be attempts, surreptitiously or by threat, to extract money from mortgage-holders beyond the amount payable to remain current on your mortgage or escrow. These include : 1. Sending notice that Ocwen is increasing the customer 's monthly escrow payment ( and correspondingly the mortgage payment XXXX to purchase property-casualty insurance to insure the property securing the mortgage, despite the property-owner already carrying the necessary coverage. When confronted with this fact, Ocwen representatives claim that they have no record of the existing insurance, despite receiving documentation from the customer and the customer 's insurance provider. I receive essentially the same letter every XXXX for several years, despite carrying the same policy from the same insurer from the date I purchased my home. 2. On XXXX XXXX, 2016, I received a monthly statement from Ocwen stating the amount payable on the mortgage XXXX XXXX, 2016. I paid that amount during the requisite payment period ( prior to XXXX XXXX ). I have since received numerous calls from Ocwen " attempting to collect a debt '' stating that the amount of my monthly mortgage has changed and the amount stated on the XXXX statement was incorrect by {$72.00}. I have not received, nor can Ocwen identify sending, a statement with the different, larger amount stated on it. Nonetheless, I have received almost daily calls attempting to collect this amount. I have notified Ocwen representatives several times that I have never received, nor, as they acknowledge, has Ocwen sent, a written notice or statement identifying the higher amount. This would appear to be both fraud, and an unlawful attempt to collect a debt.

Consumer Complaint: Ocwen Mortgage agreed to a repayment plan since I had fallen behind because my husband had XXXX and we had gotten behind. Down payment of {$3000.00} on XXXX XXXX, 2016, and equal payments of {$1100.00} for 5 months. I paid XXXX and XXXX payments early, but I had to be late on XXXX and called them and they said that was fine. I made that payment XXXX XXXX, 2016. Then I stared receiving calls and ugly letters telling me first that I had not paid XXXX payment, then the next person said XXXX payment. I have been on the phone all day speaking with different people. They revoked the repayment agreement because I was late and have my money sitting there. Finally I spoke with a really nice guy who got them to reinstate the loan with my regular payment, but I have n't made the XXXX payment yet because they have taken part of what I sent and made it the XXXX regular payment, even though I sent them {$1100.00} for the XXXX payment and they will apply {$480.00} as soon as I send them {$170.00} to complete the XXXX payment, even though I sent the XXXX payment of {$1100.00}. The guy I spoke with today said it was noted I called, but they have the right to revoke if your even XXXX day late on a repayment option. I also received a notice this week that they are taking out insurance on my house. I have told them repeatedly that the escrow is to cover the taxes and insurance. Our loan was originally with Homeward Residential and it was in the paperwork. I have since lost my paperwork and Ocwen claims there is nothing about it.

Consumer Complaint: I have paid my 6.25 % interest loan faithfully for 12 years. I finally paid my balance off enough to have 20 % equity therefore allowing me to refinance my loan. I attempted to get a payoff from Ocwen first in XXXX and then again through the lawyer who is handling the refi. He was unsuccessful for a time, but I eventually made it happen around XXXX XXXX. The payoff was sent to the lawyer. My principal balance was somewhere around XXXX on my XXXX statement. I was sure the payoff would be somewhere around XXXX. I received the closing statement XXXX XXXX before the scheduled closing on XXXX XXXX. The payoff Ocwen sent was XXXX. I have submitted a dispute. Ocwen says they need 10 days to research something that should pop up on a computer. 10 days is {$700.00}. Ocwen stalled giving me my payoff ( at least 3 weeks ). They gave an incorrect payoff and are now forcing me to make another {$3500.00} payment to them before I can refinance the loan. I am concerned I may never get a correct payoff. They do not want me to pay this loan off. I am super concerned.

Consumer Complaint: I, XXXX XXXX XXXX, am currently in Chapter XXXX ( Case # XXXX ) and filing a complaint against Ocwen for Loan # XXXX. I am in the process of a Short Sale with Ocwen on my family 's home for over 50 years, then my property for 15 of those 50 years. I am simply asking my relationship Manager to suspend or postpone my Foreclosure Sale for a 30 to 60 day period allowing my Short Sale to come to fruition and from that Short Sale, I would not receive anything but moving expenses which I am OK with. This would complete my Short Sale and give me moving expenses in Lieu of becoming Homeless from the XXXX/XXXX/2016 Foreclosure Sale. My relationship Manager XXXX XXXX would simply inform XXXX XXXX, Ocwen 's foreclosure Attorney to remove XXXX XXXX XXXX from the XXXX/XXXX/2016 Foreclosure 's Sale.

Consumer Complaint: My mortgage collector, XXXX ( nka Ocwen ) refused payments and forced me to file Chapter XXXX Bankruptcy. My Chapter XXXX was a full repayment plan. After all payments were made the Court confirmed with all Creditors that full payments had been received and they said that nothing was due and owing. 6 months after my bankruptcy was discharged Ocwen claimed ( through notice to my attorney ) that I owed an additional {$8500.00} and threatened foreclosure. My bankruptcy attorney was not helpful with disputing this amount and I was so stressed out that I went ahead and entered into a Loan Modification with them and did not dispute the amount. During the bankruptcy and after I have requested monthly statements. My attorney sent several letters telling the it was ok for them to send monthly statements ; and I have called and faxed/mailed letters asking for monthly statements. I have not received a monthly statement since 2008. When I call they tell me that they have notes saying that I told them to " not '' send statements. Oh and when I do call I 'm calling XXXX or some foreign country. Is there anything I can do?
