Consumer Complaint: My mother and I were co-borrowers on a home loan that was opened XXXX XXXX through Litton Loan. The loan was later taken over by Ocwen Loan Servicing in XXXX XXXX. During the time that the loan was with Litton we had several issue of payments not being posted correctly or being put in a suspense account. The payments included principal, interest, and property taxes. My mother was contacted by a local business man in XXXX who essentially told her that he owned her house now and that she should start paying him or he would put her out. We found out that Litton had not been paying her property taxes and that he had purchased the home in a tax sale. He wrote a letter to Litton Loan explaining such and drew up a contract with my mother. Litton then sold the loan to Ocwen. My mother file CH XXXX bankruptcy and pursuit of the debt seem to stop. I found out that it was reporting on my credit file and disputed it based on the history and mishandling of the account all along. They started reporting the account as " association terminated '' in XXXX of XXXX and deleted all account history. As of XXXX XXXX I get an update that state that I am XXXX delinquent on the account owing over {$15000.00}. I just gained access to the website and have found that there is no up to date information, statements, nothing. How can I be 180 days late on an account that has no history. The credit reporting alone is a violation. The loan should have never been sold to anyone when the original servicer was mishandling payments and not paying property taxes resulting in a loss of ownership and equity. My mother is now making payments to a person she never borrowed money from.

Consumer Complaint: My husband was a XXXX as a result of XXXX. I had a lot of bills to pay after he passed and failed to cash XXXX checks and found them last year as I was cleaning up my home. I contacted OCWEN and was told by OCWEN to submit the checks to be reissued which I did on XXXX XXXX, XXXX ( attached ). Over a year went by and I got no response. I contacted them again earlier this year and finally received a response from them dated XXXX XXXX, XXXX ( attached ). In my view their response is purposely very confusing and they claim my ( by then ) dead husband had confirmed receipt in XX/XX/XXXX and as such they are refusing to reissue my checks and refusing to send me the money which is rightfully mine. We are talking over {$12000.00}. I just sent them another letter today asking them to reissue the checks and pointing out my husband was dead when they claim he confirmed receipt. Regardless of whether the checks had been received none were ever cashed and they have my money to this day.

After careful review of the documents I noticed the value of the home that Ocwen was using was not the true value of the home. I disputed the value and I received a revised value that did not make a difference in the loan modification payment. I resubmitted the appraisal that shows the details of what work needs to be completed however Ocwen is refusing to take into consideration the appraisal which shows a $ XXXX difference. Below is a letter I recently sent and I have attached the original letter that shows the appraisal. The goal is to get a loan modification that reflects the try value of the home while offering a monthly affordable payment. On XXXX XXXX I provided Ocwen a appraisal that shows the current value of my home at $ XXXX. This appraisal included XXXX comparable homes that have no damage at : {$770.00}, {$770.00} and $ XXXX. Per our conversation today I was advised that the value Ocwen is offering is only {$720.00}. This appraisal I submitted provided detailed notes on the cost of repairs to bring the value up to fair market value. I am still disputing the value of the home Ocwen is offering based on the appraisal I submitted of $ XXXX. I would like the evaluation team to review the appraisal again and consider the amount of work that would get this property value up to where Ocwen states it should be. Again my appraisal is $ XXXX and I would like to have a loan modification based on that evaluation. This would allow my family to stay in our home with an affordable monthly payment. My last modification was approved by a Chapter XXXX judge and we used an appraisal similar to the one I provided and the judge approved. I am just trying to get a better deal on the loan modification and/or through a Principal Reduction based on the appraisal. We would like to have a new proposed solution that reflects the new appraisal of $ XXXX. The previous loan modification which shows that Ocwen was giving us a IN-HOUSE loan modification with a true Principal Reduction. Please see previous correspondence. Being transparent as the consumer is, the non regulated loan servicer issues have made my ability to have a secure decision with changes in streamline and different tier and DTI, NVP that servicer has changed since XX/XX/XXXX drive by with their advantage with a low ball appraisal and not advising of canceled compared to declined modification which apparent allocation of previous trial modification payments went to past issues not the rear of loan as described. Chapter XXXX attorney that requested all info about loan to his office staff, reneged on helping with modification as his staff was given all information pertinent to doing just that. Attorney was censured and gave me legal right for substitute attorney which also dropped out of representing me due to his ability to easily back out. JUDGE XXXX knows him ... ... He called her from his office with me present about being substitute. XXXX XXXX is in jail as he is corrupt with real estate and XXXX XXXX FRAUD, as his office allowed XXXX XXXX, the practice manager and paralegal and an Associate Attorney XXXX XXXX take funds to represent and provided representation without TRUSTEE approval and then derogation found out with no contract provided. Questioning XXXX later, he said XXXX was let go for wrong doing. He later opened his own office. Calling his office, found XXXX employed by XXXX, a joke. Pursuing reimbursement, was told by XXXX XXXX representing XXXX XXXX to call XXXX because XXXX a Wealth management attorney went back to New York after removing himself from XXXX XXXX and XXXX firm. XXXX XXXX XXXX. Transparent issues with legal representation being a hurdle because of original chapter XXXX attorney issues, XXXX XXXX, XXXX and XXXX counties. Case was reaffirmed due to his lack luster attributes with trustee payment not reduced as mod was approved. Fault of Legal Council, ... ... complicating due process.

His contact information is GMAC XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, CA XXXX, XXXX XXXX XXXX and XXXX XXXX XXXX. From the documentation I kept in my files, this is what I have pieced together. My husband and I were quoted a fixed rate of 8.25 % XXXX mo term. We received the loan documents to review on XXXX/XXXX/06. Everything looked good per the TIL and Good Faith. We then received a second copy which I kept. Then we received a third copy which turns out, was not the same set of documents. It is dated one day later on XXXX/XXXX/06 and did not include any specifics about the loan, no TIL and no Good Faith were included. I also have a copy of the closing instructions dated XXXX/XXXX/06. with no TIL or GF listed in the document section of the closing instructions. My loan was since sold to OCWEN. I recently received a letter from the current HELOC financer stating that I will be making the final loan payments at full principal as per the terms of my interest only loan. The problem is that my husband and I never applied for an interest only HeLOC. We feel that we closed on a different loan than what was initially disclosed to us and defrauded of 10 years of principal payments.

I was paying XXXX dollars a month. In XXXX XXXX I had XXXX XXXX XXXX and had to stop work for nine months but I was making my XXXX dollar payments to nationwide. In XX/XX/XXXX IndyMac /XXXX sent a letter stating I was to pay XXXX in three payments for taxes on the property which I paid and then gave them another XXXX check toward the past-due loan which came my father 's estate upon his death. Then in XXXX I had XXXX from XXXX and was out of work. I then retired XX/XX/XXXX. I was still paying the loan modification company. During this time my wife left and now I 'm divorced. I am also dealing with the VA over the XXXX XXXX that prompted the XXXX XXXX. Next thing I knew I was dealing with OCWEN which is the bank that IndyMac/XXXX transferred my original loan to OCWEN had sent me loan modification papers that required filled out over and over again .One major thing they messed up on was the property address which was different from mailing address. There are XXXX XXXX XXXX XXXX. XXXX is XXXX XXXX and XXXX XXXX which was in the low income area. They continually used the XXXX XXXX as the property address. They had pictures of the wrong house. This went on for months. It seemed like they were stalling toward resolution. When they finally came to a resolution, they wanted me to pay {$280000.00} the loan # XXXX. The amount left on loan before all this started was {$180000.00}. I have been trying to settle this and it has dragged out 24 months. I 'm now dealing with XXXX XXXX Cause I filed a complaint against XXXX for Quiet Title I am the Plaintiff in XXXX County Supreme court index # XXXX well Eyes were raised and OCWEN still wo n't deal I offered to a loan Mod of XXXX at 2 % for 30 years I have not heard maybe you can shake them up cause I do n't get answered. Ocwen had serviced my home mortgage until I closed on the sale of my home on XXXX XXXX, 2016. 2. An extra auto-payment of {$2600.00} was made on XXXX XXXX, 2016. The payoff amount declared by Ocwen was fully paid at closing on XXXX XXXX, 2016, so the auto-payment of {$2600.00} was an over-payment. 3. I called Ocwen 's Customer Care number ( XXXX ) on XXXX XXXX, 2016 to inquire about a refund of the over-payment. I was told that a full refund check was mailed on XXXX XXXX, 2016. 4. The refund check arrived on XXXX XXXX, 2016. The postmark shows it was mailed XXXX XXXX, not XXXX XXXX. The postmark is coincidentally the date of my inquiry. Furthermore, the check was backdated to XXXX XXXX, 2016. Finally, the check was only {$2200.00}, not {$2600.00}. Consequently, it was short by {$460.00}. 5. I called Customer Care again on XXXX XXXX, 2016. I was told by Customer Care representative " XXXX '' that my complaint would be submitted to the " Refund Department '' and I would need to wait for up to ten business days to get a response. CONCLUSIONS : 1. Ocwen failed to promptly refund the over-payment. 2. On XXXX XXXX, 2016, Ocwen made a fraudulent material misrepresentation that they had already mailed the full refund check on XXXX XXXX. 3. On XXXX XXXX, 2016, Ocwen made a fraudulent material misrepresentation that the check was a full refund of the over-payment of {$2600.00} that I had submitted via auto-payment on XXXX XXXX, 2016.

Consumer Complaint: Good Afternoon, I recently filed a complaint about our mortgage, Ocwen and how they wo n't re-evaluate our mortgage and the monthly payment. We are on the HAMP program, which is supposed to lower our payment but because of a miscalculation of of escrow last year, we are now paying way more! I have enclosed a copy of an accrued amount which is applied to our principal. They did n't include our hazard insurance and we had a surplus to our escrow and now they realized it and now we are paying more. Also the wo n't help is because the investors ca n't. We are also paying more for what our home is worth. I also made an appointment with the relationship manager, XXXX XXXX, for today to discuss some payments options, but no call. They are also constantly sending us paperwork to do a short sale and or foreclose. We are making our payments with the late fees, because we are late, but they are still sending us paperwork. Also they have a person taking pictures of our home. It 's not like we are not making our payments. My previous complaint number is XXXX. Ocwen promises that they will keep you in your home but does n't come through as it says on there website, statements etc. Thank you.

Consumer Complaint: I received damage to my property. My insurance company issued a claim check for the damage, addressed to me and my mortgage company ( Ocwen ). I contacted Ocwen and followed precisely the instructions they provided to get the check endorsed and returned to me. I also included a written letter including address, loan number, and the desire for expedited service, along with a {$15.00} personal check for expedited return service. I never received the check back. My personal check was cashed, but when I called customer service about it, they said I did not send a personal check and that they endorsed and mailed the check via USPS. That was more than a month ago. I emailed them and faxed a copy of the cashed check. They continue to claim that I did not pay for expedited service and that the USPS lost my check.
