Consumer Complaint: My ex-husband, XXXX submitted a fraudulent loan modification with OCWEN Loan Servicing , LLC . on the property that I am co-borrower. The XXXX signatures on the paperwork are forged, I never signed or agreed to a modification. ( I was actually out of the State on the date that the papers were signed ). Per our divorce decree he is required to refinance the property to remove me ( not remodify ). XXXX knowingly submitted the modification with intent to defraud OCWEN ; however, OCWEN is allowing him to do so because they benefit from the fraudulent modification. The property went into default and OCWEN offered my ex husband a modification. There was never any type of hardship, and he should not have been offered a modification ; his income was {$150000.00} in XX/XX/XXXX and his overtime alone was {$35000.00} enough to have covered the {$26000.00} of late payments. OCWEN is allowing fraudulent servicing practices. I have tried several attempts to contact OCWEN to discuss this but each time I called they said that they were protecting their customer and could not discuss the loan with me ( my ex husband was allowed to remove my name as an authorized contact on a loan that I am co-borrower on ). I received a letter today ( XX/XX/XXXX ) stating that after their review they are doing nothing, stating the signatures are " consistent '' against other signatures. THE SIGNATURES ARE FORGED, OCWEN is doing nothing! I filed a police report in XX/XX/XXXX with the XXXX Department ( XXXX ) and it is currently with the District Attorney 's Office.

Documentation from Ocwen in XXXX XXXX, XXXX states my Principal balance is about {$140000.00} and I was {$4700.00} in arrears 3 Payments ( Not True ) XXXX XXXX, Ocwen stated I was 4 payments in arrears and the amount was {$5900.00} plus Attorney Fees ( stated by Paralegal ) Again not true I have paid XXXX, XXXX XXXX and XXXX XXXX payment above principal and Interest due, I have being paying Ocwen XXXX above normal payment amount only to stop the Harassment and intimidation to attempts by Ocwen to get a Modification agreement signed by me, and increase term of loan by 40 years XXXX XXXX, met with Ocwens lawyer, and gave him documentation that I was ahead of schedule on a Amortization schedule of original loan. Ocwen and their Agents, as well as the Attorney have altered my loan payments, by going in the account and REV ( which according to Ocwen, stands for Reversing the payment ) Now Ocwen is stating my Principal Balance is {$140000.00} I would ask for Forensic Accounting of this Account, however a sixth-grader can see these figures have been altered. I have been making payments, however my Principal is going up?

Consumer Complaint: In XXXX of XXXX, Ocwen offered us a modification. We informed them that the monthly pay was still high and that we could not afford it. Ocwen promised to continue with its efforts to find us a more affordable modification. However, in XXXX XXXX, we received a denial letter from Ocwen denying us a modification and offered us a short sale. Despite the modification denial, Ocwen continued with it efforts to modify the mortgage. They would call or write to us several time to get more information from us which we willingly provided because we wanted to have the loan modified because the house was seriously underwater. {$420000.00} loan on a house worth at best {$280000.00}. In XXXX of XXXX, Ocwen revived the XXXX XXXX modification that they had initially offered to us in XXXX of XXXX. Keep in mind, that this is the one that we had told them that the payment was not affordable. But now, in XXXX XXXX, when Ocwen could not come up with a new modification, they offered us this modification that we had refused initially. Ocwen stated at that time ( XXXX XXXX ) that since the documents were already signed by us in XXXX XXXX, that it ( Ocwen ) would go ahead and implement it if we accepted it now in XX/XX/XXXX.They informed us that to get the modification implemented we have to come up with a deposit of {$3000.00} and pay our monthly payment on time and that they Ocwen would reduce the principal balance on the loan by {$91000.00}. This happened in XXXX or XXXX of the telephone calls with Ocwen in XXXX XXXX. Sometime towards the end of XXXX, we made an enquiry to Ocwen wanting to know why the principal balance as stated on the account monthly statement has not reflected any reduction in the principal balance. This was when we got the shock of our life. Ocwen now says that although paid the {$3000.00} deposit and have remained current in our payments, they would not waive the {$91000.00} as promised because by the time we made that first {$3000.00} deposit that they ( Ocwen ) required of us, to implement the modification, the loan was already considered late. Whoa. Keep in mind that the sole purpose of paying the {$3000.00} was to implement the modification. They now say that they can only defer that amount and not waive it as promised. There would be no reason or incentive for us to accept a worthless modification as Ocwen now claim, so they lied to us. Why would we consciously accept a modification that was already late ; pay {$3000.00} deposit ; managed to sustain the monthly payment to stay current on the loan with the knowledge that we would get nothing in return? It just do not make any sense. It should be noted that Ocwen knew that the first {$3000.00} payment that we paid in XXXX XXXX, XXXX and all the subsequent payments were made for the sole purpose of implementing the modification. We would never have made those payments but for the fact that Ocwen told us, albeit over the phone, that it was needed for the purposes of implementing the modification. We were intentionally misled because Ocwen knew then that there was no incentive for us to accept that modification if it did not include the {$91000.00} principal waiver. So they misled us. We ask that they fulfill their end of the agreement because we have done everything that they asked us to do.

Consumer Complaint: For the third year in a row Ocwen has sent an incorrect form XXXX for my taxes. This requires submitting an amended return, once they realize their mistake - which costs me money. This year I am holding off on filing my taxes even though I could use my refund. The XXXX I got this year says I paid XXXX in mortgage interest. I do not get statements from them but my principle and interest this past year was XXXX a month for a total of XXXX. When I contacted them in 2015 about the incorrect initial XXXX and having to file an amended return they apologized for the inconvenience. Normally mortgage principle and interest are straightforward calculations easily done by any computer. I do think that their financial abilities should be looked into I find it hard to believe that my account is the only XXXX they manage to miscalculate.

Consumer Complaint: I bought my house in XX/XX/XXXX for approximately XXXX dollars. I missed 4 or 5 payments in the first few months of the loan due to losing my job. The mortgage company that I got the loan through contacted HUD for assistance. I met with HUD and was entered into a forbearance agreement with HUD. HUD stated that with the forbearance agreement I would continue paying monthly payments to them and that over time I would see a slight increase in the monthly payments. On my original payment plan sheet it showed that I would be paying about XXXX dollars a month near the end of the loan but I ended up paying about XXXX dollars a month. I was told that they would pay the real estate taxes and I would be responsible for paying my home owners insurance. HUD also told me that as long as I made my monthly payments my house would end up being paid off at the end of 30 year loan in XX/XX/XXXX. Somewhere during the thirty years HUD transferred the loan and it ended up with a company called Litton Loan Servicing LLC to whom I continued making my monthly payments. When Litton had the loan they paid the taxes and insurance. Around XXXX or XX/XX/XXXX I was contacted my Litton and was told I had to pay them about the full amount of the loan in order for it to be paid off. I checked with a small mortgage company and we called Litton to see what they were talking about and when we asked for copies of the paperwork they said I had signed we were told they would not going to send me anything. I was advised to contact a lawyer but could not find one that knew had to handle this type of case. In the meantime Litton kept sending me billing statements and I continued to my the monthly payment. Then around XX/XX/XXXX Litton transferred my loan to Ocwen Loan Servicing LLC and they contacted me saying I needed to pay about XXXX dollars for the loan to be paid off. I asked them to send me the billing statements and I would continue making payments until I found a lawyer. They refused to send any statements and they never contacted me again. Then in XX/XX/XXXX on a Wednesday I received a letter from them saying my house would be sold at a foreclosure sell 4 days later. I called a friend and she contacted a lawyer that knew what to do and I went to see him. He was able to stop the sell. I took him all the paperwork I could find, but a lot of it was missing, because I had a house fire in XX/XX/XXXX and some of it was destroyed. Since then my attorney has tried to see if this is a fraud case by going to federal court and tried to reach a settlement with Ocwen, but he did n't get anywhere. Then again in XX/XX/XXXX Ocwen had my house going to a foreclosure sell again and the only way I found out is when a lady came to our house and told my wife she wanted to see the house, because there was a notice in the news paper about the sell. I contacted my lawyer and he quickly stopped the sell by filing a bankruptcy notice. My attorney contacted Ocwen and found out the pay off is now close to 60,000 dollars. The bankruptcy did not get approved at this time and Ocwen has started calling every few days. I have thought of selling the house in order to pay them off but found out the value of my house is not enough to paid off XXXX dollars and start over again especially since Ocwen has my credit all messed up. I am also going to check into getting a reverse mortgage to see if I can keep my house. I have tried to contact HUD about the original forbearance agreement but was told that only my mortgage company could request that information. I THINK MY ORIGINAL MORTGAGE IS FHA

Consumer Complaint: I have owned and lived in my house for 44 years and never had a problem making the mortgage payment. However, a few years ago my loan got sold to Ocwen Loan Servicing. they randomly sent out an inspector to my home in 2014 and he claimed that I had to redo my roof. Ocwen used this to try and justify cancelling out my insurance and forced me to use their insurance company, which cost way more. I could barely afford my payments when they did that, and in that same time period my wife had to have XXXX. I had a large co-pay and was not able to keep up and fell behind on the mortgage. Now Ocwen is dragging their feet and refusing to negotiate with me and pushing me into foreclosure. I tried on many occasions to make some progress with Ocwen to try and get them to remove their force placed insurance so I could get back to my more affordable policy but made no progress. I also tried to get Ocwen to work with me to restructure or modify my mortgage loan, but feel that I have run into a brick wall. I ended up hiring a third party to assist me with Ocwen, but after a year of providing documents over and over it feels like no progress has been made. I am semi -retired but still do electrical estimating work and my wife is receiving XXXX, so we have the means to make a fair mortgage payment. Our issue is that our mortgage company Ocwen created a problem when one did not exist and put their greed and profits ahead of the people who live in the homes they financed. My father built this home and I have lived here over 40 years. I never thought it would come to this. I just want to get back to making regular mortgage payments and put this behind me but have been unable to do so because of Ocwen 's failure to communicate and negotiate fairly.
