Consumer Complaint: We have a mortgage with Ocwen that matured XX/XX/XXXX. Ocwen notified us that we still had {$29000.00} of unpaid principal. We disagreed with that amount. Ocwen would not budge. We hired a firm called XXXXto handle an arbitration to either reduced that amount or the 10 % interest rate.This was XX/XX/XXXX. We paid {$2700.00} although we were told ito retain them was {$1700.00}. They assured us that they could take care of it before the maturity date. They didnt. And we were billed an additional {$500.00} twice. Now I cant get them on the phone. I have email, text, fax with no response. Can you help us. I dont know whether to file bankruptcy or go back to Ocwen. My husband is on XXXX, I have XXXX and XXXX and this need to be taken care of. I dont know what to do.

This had ruined my credit and I need this late payment to be removed and status to be current. On top of all this they stopped reporting my payments after they reported that late pay. So as of now XX/XX/XXXX, my payment history is inaccurate and they are not willing to correct it. I have called them numerous times, and they just say they will get with me but never do. Not only did they report a late pay that they were not supposed to but also have stopped reporting my payments after that.

When we paid with a manual check for the XX/XX/XXXX because the online system was blocked, XXXX XXXX, Ocwen et.al ONLY returned the XX/XX/XXXX payment. XXXX XXXX Ocwen, et al. suspense account shows the SAME SUSPENSE BALANCE after the appliedXX/XX/XXXX payment. XXXX XXXX, Ocwen, et al. claimed they were supposedly reviewing newly submitted loan documents for a reinstatement of the loan, or another forbearance modification which never occurred. b. The crux of XXXX XXXX, Ocwen, et al. case was they returned the XX/XX/XXXX payment and that we were late but they NEVER returned our paymentdoing simple math, the Suspense Account Balance NEVER changed after the XX/XX/XXXX. XXXX XXXX, Ocwen, et al. ONLY retuned the XX/XX/XXXX payment, as the Suspense Balance illustrates. c. There are laws and cases where banks are prohibited from foreclosure when new loan applications and documents are being evaluated to modify or reinstate loans. However, apparently, it is acceptable for XXXX XXXX and their representatives do as they wish with absolutely no recourse. 2. How can XXXX XXXX, Ocwen, et al. enter into a forbearance agreement with us and our company, while simultaneously maintaining a Notice of Default, when its against the law? a. Learned that XXXX XXXX, Ocwen, et al. were simultaneously doing the evaluation for another modification while keeping the Notice of Default alive. 3. How can XXXX XXXX, Ocwen, et al. collect our payments over the course of eight ( 8 ) months, though sometimes late but ACCEPTED, during the worse economic downturn since the XX/XX/XXXX, then foreclose on our property? 4. I recently sent a payment and Ocwen voided. So I called Ocwen today XX/XX/XXXX ( XXXX / agent XXXX ) and they said that because I was 48 days behind they proceed to cancel the plan and now they are requesting me to pay the 6 months all at once. I asked them why they did not informed me any of this and they said that the plan closed automatically and that they do not inform about this. So, I asked them to reopen the plan they said they can not and that I have to pay 6 regular months to put my house up to date. Obviously they are aware of my situation and there is no intention to help me. It is true I was behind few days but I sent the payment and they rejected. I really appreciate your help to this matter. I purchased in XXXX and my lien holders have been XXXX Bank, XXXX, XXXX XXXX, current lien holder is OCWEN Loan Servicing, LLC and now, handing over my title to XXXX. I lost my job in XXXX due to an auto accident and since that time I received short-term disability assistance payments from the insurers/my policy ( through them ) ; then they denied my permanent disability coverage. After receiving disability award from XXXX, I have been trying to modify my loan with this company to no avail ; in XXXX there was an attempt to forclose, but that was dismissed. Since that time I have been on OCWEN 's trial modification since XX/XX/XXXX through now. I received a letter on XX/XX/XXXX that my account was in default. I called for an explanation. On XX/XX/XXXX I received an escrow disbursement check from OCWEN. On XX/XX/XXXX I received a notice of intent to foreclose and an instructions for appeal, deed-in-lieu, and lastly short-sale. I have as of this date informed OCWEN by phone and letter of my request of appeal. I am in need of further assistance to maintain my home. I am a disabled independent.

Consumer Complaint: I noticed recently that the principal payments are not getting properly distributed to my mortgage balance. I closed on my condo on XX/XX/XXXX. XXXX XXXX had this mortgage before they sold it to Ocwen Financial in XX/XX/XXXX. On XX/XX/XXXX I noticed the mortgage balance is incorrect and called them. I was on the phone over 2 hours and spoke with a manager specialist regarding this case. The current balance on my mortgage that Ocwen has is {$150000.00}. The original balance Ocwen has is {$190000.00}. I asked for a amortization report for the history of the loan and they said they can't provide this b/c they don't provide on fixed loans. They don't have any of XXXX XXXX records either when loan was transferred. The original loan amount actual real numbers are {$170000.00}, which I have proof of all these numbers and original docs. I refinanced pulling $ XXXX out, which changed the balance to {$180000.00}. The balance was never {$190000.00}. The records online only go back 3 years. I saw that {$430.00} per month is going to principal. When Ocwen acquired the loan, they said the balance was {$190000.00}, which is impossible considering I paid my mortgage for 6 years and no principal was applied. They will not supply records. My mortgage balance should be {$120000.00}. Ocwen will not show me the amortization, or any documents that were transferred to them when they acquired the loan. This is in clear violation and the correct balance needs to be updated. It's not possible to pay a mortgage for 6 years and have no amount that goes to principal. This has always been a 30 year fixed mortgage. Ocwen is under investigation, and has been for some time for providing fake financial records, among many other things. This is a very stressful matter, and hope to get solved soon. Thanks
