Consumer Complaint: For the past XXXX years, I have experienced an untold degree of hardship securing employment, housing, and credit. While several prospective employers and landlords alluded to pending charges in XXXX XXXX Florida ( or recent federal charges as early as XXXX ), I never fully understood why. Especially since the last time XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX agoa fact that was readily available to prospective employers via my resume. I would call the XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX check for active warrantsand was always informed that no type of charge or warrant exists. XXXX XXXX XXXX reform organizations, law firms, and even the XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX expressed serious interest in hiring the Defendant. Salary and benefits were discussed. I regularly make it to the final stages of the vetting process ( i.e., the point where background checks come into play ). And that would be the last time I hear from any of them in detail other than to say they werent moving forward with the hire. In early XX/XX/XXXX, I applied to drive with XXXX ( after being unable to secure work elsewhere ). Part of the screening process involves a criminal background check conducted by a third-party provider ( XXXX ). After waiting XXXX weeks, XXXX provided Defendant with a copy of the report. See XXXX Background Report XXXX ( XXXX XXXX, XXXX ) ( attached ). XXXX interprets records maintained by the XXXX as proof that the Defendant has an open federal felony warrant. Id. XXXX generally looks back XXXX years for purposes of determining suitability for employmentbut pending criminal charges will automatically exclude Defendant from employment there. XXXX has already notified Defendant of its intent to use this information against him in an adverse manner. See XXXX, XXXX XXXX Notice ( XXXX XXXX, XXXX ) ( attached ). Upon receiving this report from XXXX, Defendant ran an independent background check via LEXIS. See Florida Court Report for XXXX XXXX Case No. XXXX. The XXXX XXXX XXXX XXXX interprets Title VII of the Civil Rights Act of XXXX to bar employers from discriminating against individual based on their criminal history. Its plain to see how Checkr and countless other prospective employers, landlords, and financial institutions view this as an open warrant and have used this information to make a countless number of adverse decisions against me since XXXX XXXX commuted my sentence in XXXX. On XX/XX/XXXX and XXXX, XXXX, I spoke with a number of employees at the XXXX in re : XXXX XXXX. XXXX ( XXXX XXXX, XXXX ). They verbally confirmed that he has no pending warrantsand that no warrant was ever issued in connection with the aforementioned case number. Even after I explained how the information was being used against him, none of the XXXX employees he spoke with knew how to correct these records and suggested he contact the XXXX. On XX/XX/XXXX, I contacted the XXXX ( XXXX ). The XXXX representative XXXX spoke with explained that he would need to get a court order to have offending records removed. My lawyer was able to get the XXXX XXXX XXXX XXXX to remove the erroneous information from public view and amend the offending data. Nevertheless, the data is still maintained by consumer reporting agencies like LEXIS Nexis, Inflection, and others continue to maintain this errneous information. I want the offending XXXX data removed from all cnsumer reporting agency databases ( LEXIS Nexis, XXXX, XXXX and any and all others the bogus XXXX data was distributed to ). The information was in the unveriied portion of my file, it was incomplete, untimely ( more than XXXX XXXX XXXX ) and strict procedures were not employed to independently verify that data before it was published by these consumer reporting agencies and/or provided to prospective employers, landlords, etc.

Consumer Complaint: I have submitted request after request for my credit report inaccuracies to be removed almost a half dozen of times. The response that is being received is either not making sense or requesting verification on my credit profile in which this has already been included with the disputes. I tried to called XXXX and kept getting an automated recording after entering my social security number, their company was the first to respond on my disputes not correcting anything requested and then put a credit fraud alert on my account blocking credit applications from being processed when the fraud complaint was on the credit bureaus for reporting inaccurate information that has been asked to be removed. XXXX request you to upload a black and white copy of your drivers license and the Fraud Alert Form to be in black and white, but they issue the application in color. Lexis Nexis is continuing to kill trees sending the same letter requesting me to verify an account that " they say '' can be set up online. All of my rights has been violated under the follow 15 U.S.C 1681 Section 602 A states I have a right to privacy. 15 U.S.C 1681 Section 604A Section 2 states a consumer reporting agency can not furnish an account without my permission. I could go on and on, however we all know the laws regarding consumer fair credit, but yet and still there seems to be nothing done regarding all of these inaccuracies that are being reported regarding these issues from consumers.
