Subissue: Attempted to collect wrong amount

Consumer Complaint: Convergent Outsourcing Inc is harassing me about a debt allegedly owing to XXXX XXXX XXXX XXXX XXXX, NV. During an 11 month stay in XXXX XXXX, I used XXXX XXXX for about 11 months. I bought a TV and my own modem and router at XXXX XXXX XXXX XXXX on XXXX/XXXX/XXXX and XXXX/XXXX/XXXX respectively ( Exhibit D ). I hooked up with XXXX for XXXX and XXXX service. XXXX withdrew their monthly bill from my bank account for the next 11 months. Shortly before I left XXXX for good, I contacted XXXX to get the amount for my final bill ; it was {XXXX. I personally drove to their office, paid the XXXX} XXXX Exhibit E ) and handed over their equipment consisting of the " top box '' ( converter box ) and the handheld remote. I was assured that I owed nothing further. Now they ( Cox ) seem to claim that I purchased a modem from them. Why would I buy their modem ( I had my own ) and why was that modem allegedly bought AFTER my final payment? What took over XXXX years to engage a collection agency? Is n't there a statute of limitations? I have not seen a sales slip, nor an invoice, nor a proof of delivery ; nothing. Convergent claim the debt is valid ( Exhibit F ), twice, but have not produced anything other than a XXXX ledger sheet. Convergent Outsourcing do not want to listen to my explanations ( Exhibits A, B, C ) and keep on harassing me despite telling them, please, not to.

Issue: Written notification about debt

Subissue: Didn't receive notice of right to dispute

Consumer Complaint: I have sent several letters letting the debt collection company know that this debt does not have the correct date that the account went into default. This debt is well past XXXX XXXX XXXX and past the statue of limitations for the state of South Carolina. They will not send me any information about this debt when I asked for validity of the debt. They remove it and then put it back on my credit report as if it is a new debt.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: Convergent Outsourcing opened a collections account on my credit reports on XX/XX/XXXX. They lied and said they sent something to my address when in fact I did not recieve any documentation from them. Under FCRA I am entitled to verification and validation documents bearing my signature before its placed on my credit. Convergent does not have my signature on this fraud trade. Convergent is the company name listed on all CRAs ; therefore, they need to remove this illegal trade and fraud trade from all CRAs. Under Section 611 ( 5 ) ( A ) of the FCRA you are required to promptly DELETE all information which can not be verified. Instead of updating the CRAs to remove this fraud trade, they instead added it on two other CRAs making my score crash! I will seek damages if this trade is not removed ASAP.

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I do not have a signed contract nor any contract with CONVERGENT XXXX XXXX. I have never done business with this company. I am not liable for collection from this debt from XXXX XXXX. I am not responsible for this debt with CONVERGENT XXXX. Also upon further review of my own I discovered this company is not licensed nor bonded in the state of Florida to collect any debt. I am in receipt of my credit report dated on XXXX XXXX, XXXX and I am for certain that I do not owe your company any money. For starters, I have never done business with you. In fact, I had never heard of your company until having received my credit profile. What I find strange is your attempt to settle the debt with me when I do not owe you any money in the first place! Please see this as me disputing this alleged debt with your company as well as requesting debt *VALIDATION*. You have more than enough time for your company to send me and CFPB legal supporting documents bearing that I 've done some type of business with you, *HENCE OWING YOU MONEY*. This is not my debt. Since this " UNKNOWN '' debt appears to have been sold to a collection agency anyway. The contract should be CANCELLED!

Consumer Complaint: XXXX XXXX opened a collections account on my credit reports on XXXX XXXX,2017. The only reason I know this is because I have credit monitoring accountt. ( I dont recall getting anything in the mail from them. ) And I know I received no phone call from them. I worked diligently to clear ... ALL COLLECTIONS from my credit reports. Then XXXX XXXX has come along to make this achievement short-lived. This is an illegal trade on my file. I am supposed to be informed per the FCRA before any trade is listed on my file. This is illegal and infringes on my rights! I received no documentation of this alleged debt. I have no contractual agreement with XXXX XXXX. I ca n't any information about this false debt. This fraudulent charge is hurting my credit report. Remove this fraudelent trade on all CRAs ASAP! I will sue!

Consumer Complaint: My daughter was sued by a law firm representing XXXX. We hired an attorney, and 10 days before the four separate filed suits were to go to trial, XXXX 's lawyers non-suited them. There were statute of limitation issues and I am doubtful that XXXX could prove that they had a right to sue since they probably could not prove that they owned the loans. Now, XXXX has sent at least some of these loans to XXXX XXXX, XXXX, and they are actively attempting to collect. I personally received a phone call today, XX/XX/XXXX2017, from XXXX XXXX. They are also bothering my daughter. I thought this was the case : " The Consumer Financial Protection Bureau today took action against the XXXX XXXX XXXX XXXX XXXX and their debt collector, XXXX XXXX , XXXX, for illegal student loan debt collection lawsuits. Consumers were sued for private student loan debt that the companies couldnt prove was owed or was too old to sue over. These lawsuits relied on the filing of false or misleading legal documents. The proposed judgment requires an independent audit of all 800,000 student loans in the XXXX XXXX XXXX XXXX XXXX portfolio. It prohibits the XXXX XXXX XXXX XXXX XXXX, and any company they hire, from attempting to collect, reporting negative credit information, or filing lawsuits on any loan the audit shows is unverified or invalid. '' Seems to me that XXXX is already in violation of the CFPB order. Have they completed the independent audit?
