Issue: Communication tactics

Subissue: Used obscene, profane, or other abusive language

Consumer Complaint: I have called them to dispute the date listed on the debt. It is listed as XX/XX/XXXX when the account was closed in XX/XX/XXXX. Each time I call them to dispute this amount and force them to confirm they own the debt by providing the original bill they hang up on me instantly. This has happened mutilple times and becasue they refuse to provide documentation I want this amount removed from my credit report and for an investigation to begin into the company.

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I have received collecting letters from Convergent on behalf of XXXX for an apparent $ 5,000+ debt that is not mine. I have never been a XXXX customer. When I called both ( XXXX & Convergent ) they indicated that the account on their end had my name and social security information although the address was from Ohio. I live in XXXX XXXX and this is the only residence I have ( and always have had ). This debt, on collection, is not mine plus negatively impacts my credit report/score.

Issue: Written notification about debt

Subissue: Didn't receive notice of right to dispute

Consumer Complaint: XXXX XXXX placed a derogatory collection account on my XXXX and XXXX credit reports on XX/XX/XXXX and XX/XX/XXXX. The collection agency has not provided me with written dunning notification of this alleged debt within the 5 day timeframe mandated by FDCPA section 809 ( b ). Without prior notification I was not given the opportunity to have the debt verified nor validated as belonging to me. As a result of the reporting, my credit scores with both bureaus suffered a 20 point drop at a time when I was in the process of completing applications for new credit. I subsequently filed a dispute online directly with XXXX on XX/XX/XXXX citing No knowledge of this account. Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: InXX/XX/XXXX I received a letter from XXXX a debt collector about a XXXX account in the amount of {$510.00}. I made arrangement with that company and paid the debt off inXX/XX/XXXX. XXXX XX/XX/XXXX I received a letter from another debt collector XXXX XXXX for the same XXXX account. I informed them that the account has been paid and they asked me to send them proof. I called the company XXXX and asked if they could send me a copy of the letter sent that my balance for XXXX was XXXX and they did. I emailed the letter to XXXX as instructed proving that the account had been paid in full. A few days later a change had been made on my credit report where I had gained points because XXXX zeroed my balance. I was satisfied until a few days after that my account was deducted some points and when I checked it was the same company ( XXXX XXXX ) had put the debt back on my account. I have been going back and forth with them about this issue and correcting the problem and it doesn't look like they are trying to resolve the issue.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: I was never notified of the debt, until I took the initiative to understand my credit file I was then made aware of this company that I initially sent a validation of debt letter that I wrote up from the contents of the FDCPA ; and then reported the error to all three credit bureaus which took off the negative mark made from the debt from the original creditor who sold my account to a collection company, in which my account was XXXX when I cancelled my contract on that account in XX/XX/XXXX, but was charged for equipment I already turned in and the original creditor validated. I sent proper documentation in which I acquired from the original creditor that validated my position to which I did not owe any remaining balance, but somehow they still sold the debt to a third party collection agency ; but I digress. This lead to the credit bureaus to delete the inaccurate and misleading information. But in XX/XX/XXXX-XX/XX/XXXX two different collection companies are attempting to collect the same exact debt that I got deleted for the above noted reasons. However, XXXX XXXX, and XXXX are failing to respond to me to validate this debt I requested more information I dont know maybe the have gotten new information to validate this debt ; XXXX has never responded, XXXX XXXX responded 56 days after I sent out a priority mailed letter with invalid parroted information, in which my initial letter I sent I requested any and all information that they got from the original creditor who sold them this debt. In which it was just an account number an old address and my ssn, which I know anybody can acquire nowadays. I sent another letter to the credit bureaus stating that I need all of the information in order to prove that this debt is validated. I got a response 47 days after my initial correspondence from XXXX, XXXX and XXXX were prompt response with them all to say the information has been validated with no added or supported information to say it was so, I see theyre from the school of thought that whatever I say goes with no need to validate their actions with ill regard as to how it affects consumers. Im trying to wrap my mind around as to how the FTC, and my States attorney general allows these fraudulent tactics to flourish. How are these companies allowed to file inaccuracies continuously and these frivolous attempts to collect bogus debts with parroted invalidated information from scamming collection companies. And not once did they try to attempt to collect the debt before they filed anything on my credit report, maybe I couldve asked them as to what new information they had and they couldve been made aware as to why the previous collection company couldnt collect the debt ; and as to why the first collection company sold these two collection companies these bogus debts that theyre now attempting to collect as I continuously add that they have no supported information to retort my information that I acquired from the original creditor which is XXXX XXXX cable provider. If I had owed this debt I wouldve paid the original creditor in the first place. Ive contacted the administrators of the original creditor and have gotten subordinates to call to resolve this dispute but the credit bureaus have yet to conform or confirm their stance with proper documentation. I understand that its proper protocol to file a complaint before litigation, but I have no faith in our justice system but I know facts backed by evidence prevails over time.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: I have sent multiple letters to the CRA and the Collection Agency for Validation of this Account that is being reported to the CRA on my credit report. Neither the credit bureau nor the Debt collection agency has made any attempt to send the legal Account validation or any correspondence regarding this account it has been over 30+ days since I have reached out to both and neither have sent anything responding with my contract in writing with the Debt collector. If I can not get any feedback by posting this complaint with the CRA or the debt collection agency I will be seeking legal action to have this matter taken care of.

Issue: Written notification about debt

Subissue: Didn't receive notice of right to dispute

Consumer Complaint: XXXX XXXX is reporting on my credit even though they confirmed they did not have my correct address or information to send the 30 day right to dispute. I never knew of this until I saw it reporting on credit. I called and paid it and advised them I never received a notice, they confirmed they had the wrong info. I don't understand how they can just report whatever they want whenever they want.

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I received a letter from XXXX XXXX, XXXX on or around XX/XX/XXXX. They letter said I owed their client, XXXX, for some sort of service or product. I sent a debt validation letter to Convergent via USPS certified return receipt on XX/XX/XXXX requesting that they validate the debt. They received my letter on XX/XX/XXXX @ XXXX XXXX. I specifically asked that they provide the following : -Proof that they purchased or was assigned the debt by XXXX XXXXCopy of a signed contract proving that this is my debt -Complete billing ledger that outlines how the alledged debt was incurred with dates. On XX/XX/XXXX, I received a letter from Convergent stating that they have validated said debt and had attached a copy of an invoice that appears to be from XXXX dated XX/XX/XXXX. Convergent has failed to properly validate said debt. What's more troubling is after I looked at what appears to be a XXXX invoice sent by XXXX, I noticed the date. Statute of limitations in Georgia is 6 years. Is Convergent illegally attempting to collect on debts that are past the statute? Are they providing false documentation with the intent to collect money from innocent people who don't owe the debt? How many people have they done this to?
