Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: On XX/XX/XXXX I received a letter from a debt collector, Convergent Outsourcing. The letter was a notice of debt owed to XXXX for the amount of {$270.00}. I do have a XXXX account, but use it very infrequently, maybe once a year ... maybe once every two years. I did not recognize the sum and the letter was surprising. It looked like junk mail, I'm glad I opened it. I went online and checked my XXXX account. The account was normal, in good status, a XXXX balance, all payments in the history tab had cleared. I assumed at that point the Convergent Outsourcing letter was junk, a scam, etc. I was ready to toss this piece of mail, but did a online search for " XXXX Convergent Outsourcing '' and boom, a whole slew of hits popped up dated from XX/XX/XXXX to XX/XX/XXXX. Clearly this same scenario has been played time and time again for nearly a half decade ; and it continues today. At this point I called XXXX ( a one hour wait for every call and transfer ). The XXXX rep confirmed that my account was in good standing, saw no suspicious activity, and knew nothing of the collection letter or had any answers for me. I called the number on the Convergent Outsourcing letter. I talked with a Convergent rep. At first the rep appeared to be helpful in solving this problem, but after a short time I felt I was being baited into saying " yes I have used XXXX before '' and " yes I do have a XXXX email account '' ; in this day in age it's like saying " yes, I breathe air ''. I said I felt uncomfortable with the call and was going to hang up and did. But before I hung up I did deny knowing anything about the debt or the XXXX account used to create it. What I did get out of the conversation is that my NAME and ADDRESS were used to create a XXXX account and the fraudulent XXXX account was linked to a XXXX account ( I don't believe my credentials were used to start the email account ). I also got the impression a bank account that was not mine or in my name was used to link to the fraudulent XXXX account. XX/XX/XXXX I did find time to once again call XXXX to remove my name from the debt and get some answers. After a few transfers I was able to talk to one rep in the fraud department who was able to use on of the account numbers on the Convergent Outsourcing letter to pull up the fraudulent account information. The rep was able to confirm what I had learned from Convergent ; which was this : XXXX allowed : 1. A second XXXX account to be created in my name with the use of two pieces of information about me : my NAME and physical ADDRESS. 2. A new XX/XX/XXXX and Bank account ( not in my NAME ) were linked to the fraudulent account. 3. The fraudulent XXXX account was then used to make one or more transactions. Then the XXXX and Bank account were then closed. After some Q & A with the XXXX rep, I was told the fraudulent account and debt would be escalated in the fraud department for further investigation, but that I was clearly not a part of this scam. The rep assured me that the account and debt would be cleared with Convergent ; and this process could take 3-4 weeks. I would be notified via email when the issue was resolved. By XX/XX/XXXX I still had not received such an email or any other communication from XXXX. On XX/XX/XXXX I received a second letter from Convergent Outsourcing. The body of letter stated that Convergent had received my claim of Identity Theft and had forwarded it to the original creditor ( XXXX ). The creditor responded and indicated the Identity Theft claim was not valid. On XX/XX/XXXX I called Convergent Outsourcing. The rep confirmed that XXXX had denied the Identity Theft claim and the debt account was still open ( and Convergent is still attempting to collect the debt from me ). Later on XX/XX/XXXX I called XXXX again. After many hours of holding, transfers, and callbacks seeking a qualified rep who had the aptitude to understand the issue and trace down the fraudulent account, I was able to speak with someone who ( once again ) said they would escalated the account to the XXXX Collections department for another look. I did get a direct phone number for XXXX Collections ( not an easy feat ) so I will follow up with that number tomorrow. What I did find disturbing about today 's conversation with the XXXX rep, is that the fraudulent account was still active ... the rep froze it for the first time today. It's disturbing to me that this loophole in the XXXX system has been exploited for over a half-decade and XXXX is turning their clients who are in good standing over to debt collectors.

Consumer Complaint: A collection account from Convergent Outsourcing has been placed on my credit reports. It reflects XXXX XXXX XXXX is the original creditor, it states the account was placed on my credit report between XX/XX/2019, and XX/XX/2019. It shows this account was opened on XX/XX/2019. I did not open an account with either company on XX/XX/2019, and I dont have an account with XXXX XXXX XXXX and have no knowledge of this account. I did not receive prior information from either company prior to this being placed on my credit reports ; otherwise, I would have immediately disputed the erroneous account.

Issue: Took or threatened to take negative or legal action

Subissue: Threatened or suggested your credit would be damaged

Consumer Complaint: Hello, I took out a student loan from XXXX XXXX / XXXX XXXX XXXX in XX/XX/XXXX. I was unable to keep up with payments on this loan, and the last payment I was able to make was in XX/XX/XXXX. Collection activity began shortly thereafter, primarily from Convergent Outsourcing , Inc . I am writing today to formally complain that Convergent Outsourcing has illegally re-aged this debt and has begun reporting it to the three credit bureaus again, despite the it being far too old to continue reporting. This debt aged off of my credit reports in XX/XX/XXXX, 7 years after the last payment along with the credit reporting time limit. Suddenly, on XX/XX/XXXX, this debt has re-appeared on my credit report and has damaged my credit again. According to the bureaus and my reports, Convergent Outsourcing is claiming that my Date of First Delinquency is XX/XX/XXXX. As you know, the Date of First Delinquency is defined as the date a consumer first becomes 30 days late, never brings the account current, and then a charge off ensues. The account was charged off in XX/XX/XXXX, as you will see in my supporting documents, but this is obviously NOT the DOFD. The re-aging of this debt is illegal and is an attempt to bully me. According to the Fair Credit Reporting Act, the latest possible DOFD is XX/XX/XXXX. As I write you today, this is 7 years and 8 months ago. I am attaching a few documents, all from my XXXX credit reports, to help you understand. 1. ) Screenshot of XXXX - XXXX showing Date of Last Payment - This image is a direct screenshot of my XXXX credit report from XX/XX/XXXX, clearly stating that the last payment I made on this account was XX/XX/XXXX. It also shows that they discontinued reporting the debt in XX/XX/XXXX. 2. ) Full Credit Report _ XX/XX/XXXX_ FINAL CONVERGENT.pdf - This is a copy of my credit report from XX/XX/XXXX, showing both the XXXX/XXXX XXXX XXXX ( XXXX ) loan ( details in the screenshot above ) in the Accounts section, along with Convergent in the Collections section. This shows the original creditor as XXXX XXXX XXXX XXXX, the trust that originally bought the charged-off loan from XXXX. 3. ) Full Credit Report_ XX/XX/XXXX_ CONVERGENT FALLS OFF.pdf - This document shows that Convergent ages off of my report according to the appropriate timeline. 4. ) Full Credit Report _XX/XX/XXXX XXXX FINAL WITH DOFD.pdf - This is simply showing the full final credit report on which the XXXX / XXXX loan existed, with the details from document # 1 included. Full Credit Report _ XX/XX/XXXX XXXX FALLS OFF.pdf - This report shows the original loan from XXXX/XXXX has aged off of my report, 7 years from the DOFD. 5. ) " Full Credit Report _ XX/XX/XXXX BEFORE CONVERGENT REAPPEARS.pdf - This document shows the state of my credit report before Convergent illegally reported my debt to the credit bureaus. 6. ) Full Credit Report_ XX/XX/XXXX _ CONVERGENT REAPPEARS.pdf - This, finally, is the report showing Convergent inaccurately and illegally reporting this debt, suddenly re-opened in XX/XX/XXXX. I have contacted and disputed this with all three bureaus. XXXX and XXXX continue to investigate, but XXXX was expectedly insufficient, maintaining that the account had been updated and that the DOFD was XX/XX/XXXX. They explained to me over the phone that they simply contact the furnisher to confirm the information on the report rather than looking into the details. Its clear to me that the dispute process via the bureaus is not thorough enough and that a complaint against Convergent Outsourcing is necessary. I am not comfortable attempting to dispute directly with Convergent as their tactics are clearly abrasive and aggressive. I would sincerely appreciate your thorough investigation as you will see that this reporting behavior is extremely inaccurate and illegal. Finally, I just want to recap that this debt originally aged off of my credit reports appropriately. It is this sudden activity as of XX/XX/XXXX that has caused me to write you today, as they are attempting to muddy the Date of First Delinquency and bully me by reporting this well beyond the legal timeline. It is important that Convergent reports this accurately and that XXXX, XXXX and XXXX acknowledge the change.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: After viewing a copy of my credit report, I noticed a collection account placed on my credit report from CONVERGENT OUTSOURCING in XX/XX/2016 in the amount of {$110.00}. First and foremost, I have confirmed that the debt collector, CONVERGENT OUTSOURCING is not licensed in the state of Florida to collect on this debt. Secondly, CONVERGENT OUTSOURCING violated the Fair Debt Collection Practices Act rules and regulations when they failed to send me a written debt validation notice including the amount of the debt, name of the creditor, and notice of the consumers right to dispute the debt within 30 days ( see 15 U.S.C. 1692g ( a ) ). Third, what obligation do I have at all to CONVERGENT OUTSOURCING? I have never heard of them, have no written contract with them, and have never received any benefits from them. Yet, CONVERGENT OUTSOURCING has submitted negative information to all three credit reporting agencies ( XXXX, XXXX, and XXXX ) against my name and social security number and demands collections payment from me in the amount of {$110.00}. Therefore, I am requesting VALIDATION made pursuant to 15 USC 1692g Sec. 809 ( b ) of the FDCPA. I respectfully request that CONVERGENT OUTSOURCING provide me with competent evidence that I have any legal obligation to pay them. I am asking CONVERGENT OUTSOURCING to please provide the following : 1. Agreement with the creditor that authorizes you to collect on this alleged debt 2. The agreement bearing my " WET '' signature stating that I have agreed to assume the debt 3. Valid copies of the debt agreement stating the amount of the debt and interest charges 4. Proof that the Statute of Limitations has not expired 5. Complete payment history on this account along with an accounting of all additional charges being assessed 6. Show me that you are licensed to collect in my state ; and 7. Your license numbers and Registered Agent.

Consumer Complaint: I received a mailing XX/XX/XXXX from Convergent Outsourcing Inc.stating that I owed, XXXX for Original Creditor XXXX Calling Card Classic. And if paid within 60 days, I only have to pay XXXX. I called and spoke with, XXXX XXXX, XXXX XXXX, and XXXX XXXX, All of which had numerous guesses as to what this was actually regarding but wanted to know all of my financial information and social security number right away. Finally, XXXX XXXX 'guessed ' that this was an old credit card debt from XXXX? I don't nor have I ever had an open credit card, that isn't current and up to date from XXXX. He then said 'oops ' and responded that he will just put in his 'fraud file '. I have never had any accounts associated with calling cards, XXXX classic or credit cards that were delinquent.

Told her to send me in writing, along with proof, what this supposed claim was about that you want me to pay. You need to give me the background, numbers, dates, etc. Never heard anything from them. On XX/XX/XXXX, I received a notice from a debt collector -- Convergent Outsourcing, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, WA, XXXX for {$340.00}. Issue: Credit monitoring or identity theft protection services

Subissue: Billing dispute for services

Consumer Complaint: Recently I received correspondence from a collection agency ( Convergent Outsourcing ) regarding an alleged {$360.00} debt owed to XXXX. This is not a valid debt. On MXX/XX/XXXX, XXXX mistakenly initiated an electronic financial transaction debiting my account at XXXX XXXX in the amount of {$18000.00}. My account was locked down as a result, and I was unable to pay my other bills. Despite the fact that I repeatedly contacted XXXX regarding their mistake immediately after the XX/XX/XXXX debit, XXXX again attempted to initiate an electronic debit from my account in the amount of {$18000.00} on XX/XX/XXXX. As I had after the first improper debit, following the second transaction I called, texted, and visited XXXX local office in person. Because of these improper actions by XXXX, I was forced to cancel my direct deposit into my bank account, to purchase money orders to pay some of my other bills, and I had to spend a great deal of time and energy resolving other issues related to the improper debits. Shortly thereafter, I cancelled my cable service through XXXX. After speaking with the several individuals, including the manager, I was assured that my account with XXXX held a XXXX balance and that I owed no money to XXXX. On XX/XX/XXXX while visiting the local XXXX office to verify that I owed no money to XXXX, I reviewed my account status with XXXX representatives and was again assured that my account held a XXXX balance. Then this spring, I received a notice from Convergent Outsourcing seeking to collect {$360.00}. This is not a valid debt.
