Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: I was sent to Convergent Outsourcing by XXXX for an account original balance of {$1100.00} due to contract termination. Convergent sent me an offer letter to settle my account in full at $ XXXX contacted Convergent and made my payment of {$590.00} with my XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX on XX/XX/XXXX, and was told that by paying that amount, my account is settled in full. To date, XXXX still shows that I have the remaining balance of {$590.00} in my account therefore, my request to unlock one of my devices can't be completed. I initially contacted Convergent on XX/XX/XXXX and spoke to XXXX XXXX. XXXX confirmed that Convergent did receive my payment in the amount of {$590.00} on XX/XX/XXXX, and provided me a trace # for that transaction as XXXX. However, when being asked to provide me a Proof of Payment so that I can show XXXX, she refused to and instead, advised me that she would put a request to XXXX to send me a Confirmation Letter notifying that they received my payment to settle my account in full. I provided XXXX with both my email address and updated mailing address. However, knowing Convergent XXXXXXXX when they should have reported this paid amount to my XXXX months ago, I contacted them again on XX/XX/XXXX and spoke to XXXX. She advised that there is a note in their system that a request has been sent to XXXX to confirm my paid amount, and that would take around a week. I kindly reasoned with her that since it's not my fault, Convergent should have done this a long time ago instead of making me wait a week when I have a device that needed to be unlocked urgently. XXXX then told me that she would forward this to her Supervisor asking for a prompt action to expedite this process, and advised me to follow-up in a few days. I contacted XXXX right after and was advised by their Rep that my account still shows owe an amount and they haven't received any verification from Convergent, hence, advised me to contact Convergent again. I contacted Convergent again and spoke to XXXX XXXX She then told me that even though I paid {$590.00} I'd still owe the remaining balance of {$590.00} with XXXX since the original balance is {$1100.00}. I got into an argument with her because that's not how creditor - the collector - debtor works. Creditor - in this case, is XXXX, sold my account to Collector - which is Convergent at less amount that the original account balance. Therefore, Collector went after Debtor - me, with or without an offer to settle the account in full. I accepted the offer, paid my balance of {$590.00} and still, Convergent refuses to XXXX and passing me around providing false statements and confuses its customer. When being asked to provide Proof of Payment, they also refused to corporate. Every time I called I was transferred around and most of the time they'd tell me that I'm reaching the wrong department.

Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: Convergent Outsourcing notified me of a debt that had from XXXX in the amount of {$1200.00}. I called them on XX/XX/2020 to try to settle the debt with them. I told them I had {$700.00} to pay and they said the settlement amount they could take was {$810.00} which I agreed to. I paid {$700.00} electronically that moment then scheduled a payment for the {$11000.00} for XX/XX/XXXX. I have email confirmations of both payments and records of the payments out of my checking. On XX/XX/XXXX they reported to the credit bureaus that I owed them {$550.00} still and reflected this in their system. I called them on XXXX to confirm payments went through and debt was settled. I got confirmation over the phone and requested an email showing that. Never received it. On XX/XX/XXXX they again reported to the credit bureaus that I owed {$440.00} and again I called them on XX/XX/XXXX. Again got confirmation this was being fixed and documentation sent out. I have yet to receive anything from them. I called once again on XX/XX/XXXX and said they couldn't find my account then told me they handled XXXX XXXX XXXX customers not XXXX. I have been trying to buy a house and this caused me to lose my offer on a property. I don't know how to get this fixed at this point.

Consumer Complaint: I paid XXXX XXXX directly and by law, they must recall the account from Convergent, which Convergent agrees that they did. Therefore, Convergent has no legal reason to be reporting on my credit reports and must delete.

Issue: Took or threatened to take negative or legal action

Subissue: Threatened or suggested your credit would be damaged

Consumer Complaint: To whom it may concern, I would like to report a complaint against Convergent Outsourcing for not following with their promise to remove a collection item from XXXX and or all Credit Reports. This account was paid in full on XXXX of XXXX in the amount of {$260.00}, before processing the payment of the entire balance. Myself and Convergent Outsourcing had agreed that once the account was paid in full, Convergent Outsourcing will then remove the collection items from all credit reports : XXXX, XXXX and XXXX. The collection item was successfully removed from XXXX and XXXX around XXXX, XXXX & XXXX of XXXX. However the collection item is still present on XXXX. I have reached out to Convergent Outsourcing multiples and spoken to several employees that have promised me the removal of this item. I have been calling Convergent Outsourcing consistently since the XXXX of this year and have followed up every month checking in for an update. I lastly spoke with them on XX/XX/XXXX and they promised me that this situation was going to be resolved and the removal of the collection item, which is hurting my credit score. Today I received an update from XXXX regarding my dispute of this item without any success. As you can imagine, I am simply looking to get this matter resolved and the removal of the collection item as agreed with Convergent Outsourcing.

Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: XXXX leaked my personal information as well as the information of over 143 million Americans. This situation has affected me mentally as well as damaged my overall credit score and credit health. The three major credit bureaus XXXX, XXXX, and XXXX are now reporting accounts to my credit file that are a direct result of Identity theft. Credit reporting laws ensure that bureaus report only 100 % accurate credit information, and every step must be taken to assure the information reported is completely accurate and correct. I have requested debt validation, yet I have yet received any information in over 90 days. I am distressed that this account is currently being reported to my credit file. While I prefer not to litigate and contact the media, I will use the courts and publicity to enforce my rights under the FCRA. I will bring this information forth to a judge in my area, if these accounts are not removed from my credit file. The Fair Credit Reporting Act requires you to remove this account from my credit report as soon as possible. My lawyer has taken the steps necessary in order to bring this information forth to a judge in my area if this account is not removed from my credit file as soon as possible.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: Hi I am writing this complaint against XXXX and XXXX. XXXX and XXXX both said they verified a Fraudulent Convergent Outsourcing collection account on my credit report. Despite two written requests, the unverified items listed below still remain on my credit report in violation of Federal Law. You are required under the FCRA to have a copy of the original creditors documentation on file to verify that this information is mine and is correct. In the results of your first investigation and subsequent reinvestigation, you stated in writing that you verified that these items are being reported correctly? Who verified these accounts? You have NOT provided me a copy of ANY original documentation ( a consumer contract with my signature on it ) as required under Section 609 ( a ) ( 1 ) ( A ) & Section 611 ( a ) ( 1 ) ( A ). Furthermore you have failed to provide the method of verification as required under Section 611 ( a ) ( 7 ). Please be advised that under Section 611 ( 5 ) ( A ) of the FCRA you are required to promptly DELETE all information which can not be verified. I have also attached the correspondence I have rec-ivied from XXXX and covergent. I have also attached my ID so XXXX cant falsely say I hired someone to dispute these for me. I also want XXXX to know I have filed a complaint with the Attorney General Office and my next step is litigation

Issue: Took or threatened to take negative or legal action

Subissue: Threatened or suggested your credit would be damaged

Consumer Complaint: On or about XXXX of XXXX I became aware, by them calling me and my family members, that Convergent was saying that I owed them " {$1500.00} '' and I had 10 days to pay or they would forever ruin my credit. As of this date I had never received anything from them in writing and my credit was, is, PERFECT with credit scores averaging in the high 700 's ( which is extremely good ) I immediately sent them a certified letter disputing the debt which they signed for in XXXX of XXXX which was my right and I asked for proof of the debt and for them to stop harassing me and my family members. I was, and am, battling XXXX at the time and the last thing I needed where these tactics when I didn't owe them, or XXXX ( who they said they bought the debt from ), anything. In spite of my requests they never responded. Over the next 2 years I repeated these request for seven times and they never responded and they put it on my credit file which was wrong in many ways. In late XXXX I contacted my US Senator 's Office and they reviewed my paperwork and said " this is wrong ''. In XXXX of XXXX I sent them yet another certified letter, the same as previously, and this time they responded by sending me 2 pages. One was an amount, not a bill - not in compliance with the Fair Debt Collection Practices Act. for {$150.00} and the other was a duplicate bill of the {$150.00} but now they crossed it out and put in {$250.00}. In XXXX of XXXX I received a letter from my US Senators Office directing me to ( a ) sign the papers enclosed so that they would advocate on my behalf for privacy matters and ( b ) file a formal complaint with you all. From XXXX of XXXX through the writing of this complaint, is XX/XX/XXXX, I have had to dedicate my time to my health. It is WRONG what they have done to me and a simple " internet search '' shows thousands of others have gone through what I have. They never proved the debt. They never proved I owe {$1500.00}. The only thing they sent was a bill for {$150.00}. This is a matter of principle and I do not want to leave this earth with this hanging over my head. PLEASE HELP ME and have them remove this from my credit files and issue an apology to me and be kept from ever harassing me again. Thank you XXXX XXXX
