Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: Refer to Complaint Report # XXXX Convergent Outsourcing informed me in their response that they had closed the account on their end, sent it back to the original creditor ( XXXX XXXX and would not be taking further action due to this being a fraudulent account opened in my name/identity theft. This account had already been resolved with XXXX & XXXX XXXX XXXX which is who XXXX XXXX the original creditor ) gave the account over to try to collect on. It was off of my credit report, and settled. I believe Convergent tried to collect a fraudulent debt they werent given since XXXX told me they never gave it over to that agency. I believe they are still trying to collect a fraudulent debt from me after this statement. Yesterday, they marked the fraudulent account on my report as late and negative which dinged my credit score further. They now know this debt is fraudulent & due to identity theft, and the agency is still trying to collect it. I would like to see the agency close the account as they informed me in the response to this complaint, and halt communication with me. I would also like to see this company audited. They are participating in fraudulent collection activities.

Consumer Complaint: To Whom It May Concern, XXXX has constantly let Convergent Outsourcing report account number XXXX an invalid debt in the amount of {$130.00} to my credit file. Dispute letters were received on XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. This I know from my certified mail with signature. The latest response I received from XXXX was on XX/XX/XXXX and this response from XXXX stated that account number XXXX with a balance of {$700.00} was in fact valid. This invalid debt was reporting to all three of my credit files including, XXXX, XXXX and XXXX. As of current day, this invalid debt is reporting to my XXXX credit file. This Invalid debt has been deleted from my XXXX and XXXX credit file but still somehow maintains to report to my XXXX credit file. I have reached out to Convergent Outsourcing as well as XXXX to provide me with their method of verification about this invalid debt of {$130.00} and have been met with non compliance several over the past 24 months. Every time a dispute letter was sent, XXXX and Convergent Outsourcing has constantly sent me a response stating that the debt was valid and both companies has never mailed me their METHOD OF VERIFYING the debt as required by the Fair Credit Reporting Act. XXXX and Convergent Outsourcing has continously and willfully violated my rights as a consumer by not following the FCRA guidelines by not providing me with their method of verification. XXXX and Convergent Outsourcing has not responded within the required 15 day deadline of them providing me a legal METHOD OF VERIFICATION. Both companies have only responded back to me by mail stating that this invalid debt is in fact valid. Every time i have disputed this invalid debt of {$130.00}, Convergent Outsourcing has mailed me back a copy of a bill that they claim is mines and stating the debt is valid. As for FTC opinion letter from Attorney XXXX XXXX XXXX, a printout of a bill or itemized document does not constitute verification Both XXXX and Convergent Outsourcing have acted in bad faith by not responding to me letting me know their method of verification. This is what Convergent Outsourcing has been mailing me back over the course of 24 months. I have previously reached out to XXXX and Convergent Outsourcing several times providing both companies with all the required documentation concerning this invalid debt. In return BOTH companies have violated my rights as a consumer. I have have mailed Convergent Outsourcing and XXXX several times over the 24 months asking for theIr METHOD OF VERIFICATION and for all 24 months, and have been denied my request for how they are verifying this invalid debt. The documents that i have provided with this complaint is proof that i have been met with NON COMPLIANCE several times over the past 24 months from both XXXX and Convergent Outsourcing using these illegal tactics to benefit both companies financially. XXXX has stood by over 24 months and provided a way to let Convergent Outsourcing report this debt without investigating if Convergent Outsourcing actually had a method of verifying the debt. As noted, this debt is currently deleted from my XXXX and XXXX credit files, but Convergent Outsourcing has refused to delete this invalid debt from my XXXX Credit file. Also as stated in 609 Disclosure To Consumers [ 15U.S.C 1681g ] ( a ) Information on file ; sources ; report recipients. Every consumer reporting agency shall, upon request, and subject to 610 ( a ) ( 1 ) [ 1681h ], clearly and accurately disclose to the consumer : As we know, the information that verifies the information inside a credit report is supposed to be in the files of the credit bureau as well. This is the Information that the credit bureaus are supposed to store in their database on every consumer. As well as 609 ( c ) ( E ) I am asking the Consumer Financial Protection Bureau to investigate the non compliance by XXXX and all Convergent Outsourcing who are reporting this invalid debt of {$130.00} to my XXXX credit file and not providing the required method of verification per my right as a consumer as said in the Fair Credit Reporting Act.

Consumer Complaint: CONVERGENT OUTSOURCING , INC . XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX There is a regulation under the FDIC Act known as Regulation 5000, which acknowledges an unsecured debt as a different classification from standard to sub-standard. On day 120 of default, all interest, late fees and overdraft fees cease, and the basis of debt id re-evaluated. On each of these collections the standard has been violated as both entities are using a 180-day default method, which means both the accounting and its subsequent collection process is a violation of my rights under the Fair Debt Collection Practices Act. In essence, both collection processes are VOID, and must be recalled by their respective original creditor. I am a XXXX American citizen who believes that my rights are being violated and my civil rights are in total violation under the Civil Rights Act. I make the following demands : XXXX ) A true copy original of my credit application, and XXXX ) A complete accounting under FDIC Regulation XXXX guidelines. I, XXXX XXXX believes in the credit reporting system as the most important element to the success of the commercial banking system. I am also a proponent of the Consumer Financial Protection Bureau ( CFPB ) as a tool to streamline issues on credit reports that may be dragging down my overall scores. Accordingly, I address each particular issue directly with the creditor in question, before submitting any complaint to the credit bureaus if necessary. Therefore, I desire the following reinvestigation as follows : 1 ) On accounts where late payments are posted, I respectfully request a review of the past payment history and to ascertain if certain payments could actually have been posted late because of an overlap on the 30-days grace period. I realize that this may happen on occasion, and I request only a summary review internally, and do not require any documentation. 2 ) On any account that falls within the 84-month negative reporting timeline, I respectfully request either the deletion of the account if said account was closed, or the elimination of the prior payment if the account it is still active, this is well within the Fair Credit Reporting Act ( FCRA ) guidelines pertaining to obsolete information. 3 ) Any collections must be proved if either a direct collection and/or debt purchase. In either event I request that a true original copy of right to pursue collection be established with each respective credit reporting agency, and if a debt purchase the guidelines proving transfer of ownership must be submitted to all credit bureaus as well as me personally to validate ownership and the right to collect. I am well within my rights requesting proper documentation as administered through the Fair Debt Collection Practices Act ( FDCPA ), the Consumer Financial Protection Bureau ( CFPB ) and the Federal Trade Commission ( FTC ), in addition to the even stricter guidelines enforced by the office of attorney general in my state of domicile. I respectfully request each investigation to be reported to XXXX, XXXX and XXXX XXXX within a reasonable time period, hopefully 30-days. I realize that the current Covid-19 crisis could cause delays, so the best efforts of each financial institution and collection agency will be appreciated under the current circumstances. XXXX XXXX

Consumer Complaint: Hi and hope you're doing well during this Covid-19 pandemic? Be safe! Listen, I was shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the XXXX major credit bureaus from a collection company that I never have dealt with before for XXXX bill for {$1200.00}. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity. You have 30 days upon receipt of this letter to provide strict proof of contract. In the event you can not provide strict proof of contract, you must cease and desist any and all collection efforts and immediately remove any derogatory information reported to the consumer reporting agencies. In addition, you will need to provide me your agreement, in writing, that you are closing your file, ceasing collecting activity, and deleting all information related to this reference number from any and all credit reports youve furnished the information to. In the event you transfer this account to an attorney without providing proof of contract, and proving your claim, he/she will be immediate reported to the XXXX XXXX XXXX and XXXX XXXX XXXX for code of ethics violations.

Consumer Complaint: Debt Collection agency called " Convergent '' mailed me on XX/XX/XXXX that creditor : XXXX XXXX placed a debt of {$80.00} against XXXX XXXX XXXX. I contacted Convergent in XX/XX/XXXX first week that I don't recognize these charges as I moved out from Arizona in XX/XX/XXXX, where I took services from XXXX & I cleared all my dues & made all payments on time. So, I need to check with XXXX & asked Convergent to put this on dispute. Convergent said till the dispute is sorted out, they will not report this debt to any Credit agencies. I contacted XXXX XXXX Collections department to discuss this matter and they informed me it is a reporting error from XXXX 's end and I don't owe anything towards XXXX equipment. The charges will be reverted by XX/XX/XXXX and I should inform Convergent about it not to report this debt to any Credit agencies. I wrote 4 times to Convergent email provided in there letter received via mail, but have not received any response. On XX/XX/XXXX I generated XXXX credit report as it was required for my rental home application. I was disappointed to see that Convergent reported this wrong & disputed debt as I owe {$80.00} towards XXXX XXXX. I called Convergent to report why they reported this as debt to XXXX credit agency when this matter is in dispute? and I already clarified that XXXX confirmed this is a reporting error from XXXX side. They said it will be reverted as {$0.00} in 40 days & can't explain why it was reported to XXXX They also confirmed that I don't owe any debt. I feel ashamed that my landlord agency questioned me about this debt in my rental application & said they have to rethink about my application. I think this will be reported to any credit card agencies as well if I apply for credit cards or bank accounts. My intention to complain is such agencies like Convergent should not be allowed to report wrong debt collections until matter is in dispute and when I am constantly updating them with latest developments. Ultimately, it was mistake of XXXX as reporting error and Convergent to report to credit agencies. I was not at mistake.

Consumer Complaint: I closed an account with XXXX several years ago. They attempted to bill for a device that was not revieced quick enough. I resolved the issue with XXXX management but the account was still turned over to collections. The first collections company contacted XXXX after I made them aware of the full situation. They removed the account from my credit immediately. It has since then been passed on to several different collections companies who all contact me and place the account on my credit report. The latest company refuses to remove it or to contact XXXX for the correct information.
