Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: I was shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity. You have 30 days upon receipt of this letter to provide strict proof of contract. In the event you can not provide strict proof of contract, you must cease and desist any and all collection efforts and immediately remove any derogatory information reported to the consumer reporting agencies. In addition, you will need to provide me your agreement, in writing, that you are closing your file, ceasing collecting activity, and deleting all information related to this reference number from any and all credit reports youve furnished the information to. Consumer Complaint: On XX/XX/2020 Convergent Outsourcing, Inc. sent a collection letter to me for a debt. Upon, further research, this account was transferred/sold and I am no longer responsible for the account. Debtor 's creditor did not verify this collection. Also, there was NO written form of communication, contract, or signature for this accused debt at all. A bill without a signature does not validate the debt and anybody can send a bill and say it's mine. According to the FCRA Convergent Outsourcing , Inc. has violated my rights as a consumer and I'm requesting legal action to remove this account immediately.

Consumer Complaint: I requested documents for verification from Convergent Outsourcing ( a third party debt collector ) to validify an alleged debt. I received documents from Convergent Outsourcing and the very first document stated that I did owe the debt. According 15 USC 1692b ( 2 ), that is a violation of the FCRA. I also notice on one of the documents that I later received that the alleged debt is associated with an address that I have never lived at. I have currently sent a dispute to the third part debt collection agency via certified mail and I'm currently waiting on a response. The documents ( Affidavit of Truth and invoice ) were received by the company on XX/XX/2021.

I need this resolve, under the Fair Credit Reporting Act, these disputed items may not appear on my credit report if they can not be supported by any evidence ( 1 ) In general No person ( company ) shall sell, transfer for consideration, or place for collection a debt that such person has been notified under section 1681c-2 of this title has resulted from identity theft. ( 2 ) Applicability The prohibitions of this subsection shall apply to all persons collecting a debt described in paragraph ( 1 ) after the date of a notification under paragraph ( 1 ).
