Issue: Problem with a lender or other company charging your account

Subissue: Transaction was not authorized

Consumer Complaint: On XX/XX/ at XXXX XXXX XXXX XXXX the consumer ) received a phone call from XXXX which said Wells Fargo XXXX his caller ID. The caller identified himself as a Wells Fargo XXXX XXXX XXXX by the name of XXXX XXXX. He told me that my account had been compromised in a large security breech at XXXX and that I'd lost access to my online account. He asked me about fraudulent activity on my account ; a purchase of {$1500.00} in FL, and asked if I authorized XXXX in the amount for {$10000.00}. My answer was NO, I did NOT authorize those transactions. XXXX told me I needed to regain access to my online banking. He sent me text to a link that was as follows : XXXX. Under extreme duress, I clicked on the link and a XXXX online banking page come up. I was instructed to log in. I then received text messages with codes and was told it was a part of the wire reversal process. I came to find that the fraudster was sending a XXXX of $ XXXX out of my small business account. When I realized this was fraud onXX/XX/XXXX at XXXX, I immediately called XXXX XXXX support at XXXX to report what had happened and for the next XXXX minutes was transferred from dept to dept until the call was concluded at XXXX. At the time I was being passed around, the XXXX the fraudster made was still PENDING and could have possibly been stopped. Eventually and lastly, I was transferred to XXXX XXXX Assistance XXXX regarding the fraud. On XX/XX/ I was told by a female XXXX XXXX XXXX XXXX, on a recorded line " to not worry, that the bank will make me whole again ''. Yesterday,XX/XX/XXXX, I received a letter from the claims department Claim # XXXX stating that XXXX will NOT be reimbursing me for the $ XXXX which was fraudulently taken from my account on XX/XX/2023. If WELLS FARGO would have reacted in a timely professional manner, instead of pushing me off from dept to dept for XXXX minutes, they could have stopped the fraudulent activity and recovered my $ XXXX. This is obviously negligence on behalf of Wells Fargo 's fraud department.

Issue: Managing the loan or lease

Subissue: Problem with fees charged

Consumer Complaint: Arbitrarily being charged late fees when payments were made to cover late fees in the past. Wells Fargo is charging me a total of {$360.00} in late fees now although I have already paid all of the late fees throughout/during the life of the loan. I think this is a way of the company trying to steal my money. They can not justify that I have not paid the late fees after I demonstrated through all of my payments that I paid the late fees every time I caught up on my payments. After all these years they are trying to say that I owe these late fees and can not prove that I did not pay them. This is now causing hardships for me and I have XXXX children with XXXX and I am not able to keep disputing this with Wells Fargo!!! This is impacting my health.

Issue: Managing an account

Subissue: Fee problem

Consumer Complaint: Wells Fargo has been charging me rediculous international fees to use my debit card. What a rip off and complete scam. Each transaction has resulted in a fee. I need this money reversed immediately. Why keep my money in a bank that's going to nickel and dime its customers any chance it gets with fees.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: The presence of a derogatory rating on my account is deeply concerning to me. I am worried about the impact it may have on my credit, as it has already resulted in the denial of a recent loan application and an increase in the interest rates on my existing credit accounts. I want to emphasize the significant financial and emotional distress this negative rating has caused me and will continue to cause until it is resolved.

Issue: Struggling to pay your loan

Subissue: Lender trying to repossess or disable the vehicle

Consumer Complaint: Company Repossessed vehicle at XXXX for being 68 days behind after payment for XXXX was scheduled on XX/XX/2023 and payment was processed on XXXX XXXX. Making installment loan only 56 days behind in loan agreement it states that the company allows 90 to 120 days / 3 consecutive months of late payments before repossession is filed. My vehicle was repossessed at 68 days. On XX/XX/XXXX, I called the company to set up a deferment and was told I would have to make another payment of {$800.00} to set up the deferment plan. Later in the conversation, the agent told me being that I had just made a payment that I was not in the process of my vehicle being repossessed because that took care of XXXX payment making only 2 months behind at the time of the call. The agent told me to call back on that follow Monday and see if the payment had been processed. I told the agent that I had just started a new job and I would be able to make another payment in two weeks when I was paid again. The agent proceeded to tell me that she would put in the notes to put a hold on the account. Two weeks later on XXXX night XX/XX/2023 I logged in to make a new payment and was locked out. I thought the system had a error going on or something and the next morning my vehicle was unlawfully repossessed. I was not consecutively behind three months at the time of the repossession and I had already spoken with an agent about doing a deferment and was denied because my last payment was still processing. My account was occurring as late since XXXX online and was never updated making it seem as if I was over so many days behind and I wasnt. This was never updated even after I made 5 payments afterwards. After my vehicle was repossessed I spoke with a Supervisor at XXXX XXXX on XXXX XX/XX/2023 and this is where I discussed the details of my situation with him and was told that I would a receive a call back from him on Monday XX/XX/XXXX by noon I never received the called so I called back and was told by another agent/manager at XXXX and was told he would not connect me to another supervisor or manager. The agent refused to listen to my situation fully to understand the matter of my call and told me he would not transfer me over to someone else because he wasnt going to change his answer. I filed a complaint on XX/XX/2023 for a wrongful repossession and was told I would be contacted within 24 hours after the case. I have called to speak with a representative about my case Everyday and several times and I have not heard anything back from them. I am experiencing emotional distress from this situation and it is very unfortunate and unlawful what has happened. The agents continue to tell me Im three months behind until I tell them to look at my payment history and then they still try to argue with me even with receipts that my car payment is behind 3 months when its not. I have the the days calculated and the payment statements to prove my claim. since XXXX my payments have been made and I have attached pictures for proof. This company file repossession for my vehicle even after I made payment and picked my car up two weeks later after making payment.

Issue: Trouble during payment process

Subissue:

Consumer Complaint: Wells Fargo Bank ( Wells ) in a unusual procedure was allowed to become the servicer of XXXX XXXX XXXX XXXX XXXX ( XXXX ) XXXX pooled loans and in assigning most all the Deed of Trust over to Wells would present a legal problem if and when ( XXXX ) would fail, because there would be not party with an financial interest legally able to claim a debt due. Wells having millions of XXXX pooled loans that they own and are servicing which in no case that XXXX is the holder of debt on these loans. The Assignment of DOT is placing a lien against the property by the owner of the loan in which no occasion is a nondebt holder allowed to replace itself as the holder of the debt because they are not owned a debt. What occurred is that XXXX wanted to seize XXXX portfolio of XXXX XXXX pooled loans as XXXX was in financial trouble that lead to the bank being seized by the XXXX. So after XX/XX/XXXX, there was no entity that was owned a debt from the Fed Gov backed loan XXXX had in the XXXX XXXX portfolio. The Assignment of DOT that were recorded were not the result of a sale of the debt and could not demand a debt be repaid because there was nothing to be repaid. In order to foreclose XXXX would have to come back to life and have the mortgage Note returned to them by XXXX after it paid it XXXX investor loan back, and have the lien assigned back to them. However, as of today XXXX not come back from the dead and they never sold the debt but were unable to complete the mortgage contract which cause the loan to stop existing because of failure to perform. Wells was collecting payments illegally from XXXX XXXX Fed Gov borrowers starting on XX/XX/XXXX, and taking those payments and passing them through to XXXX XXXX investors from loans that were completed due to the fact the counterparty in XXXX stopped existing. Wells knows XXXX is never an investor/owner of the mortgage loans due to the restriction place on the agency by US Congress XXXX However, when performing a HAMP modification and adjusting the loan payment does not cover what XXXX was obligated to and the only way to cover XXXX obligation was to steal the properties of the homeowner requesting the TARP protected HAMPs modifications! A audit of the mortgage servicing files don't show a pay off of the non-existing XXXX mortgage loans, but will show that XXXX is being paid out of foreclosure proceeds and VA & FHA insurance programs to pay the debt owned by XXXX not for any mortgage loan debt because there is no loan remaining. What happen is one amount of monies in the mortgage servicing account can not pay two almost equal amount of debt as there only one foreclosure proceeds and insurance payout, but two amounts alleged to be due. XXXX paid for the investor loan leaving their XXXX partner in Wells to be paid the remaining amount for servicing service, whipping out the account and paying the allege debt of the homeowner. The account trick is accomplished because there is not XXXX to be paid and no update reported as to the loan debt disposition! XXXX would be the report entity however they don't exist, and this allows the account fraud to be successful. XXXX who was not authorized to act on the mortgage loans and would lose monies if a modification were granted instead with Wells refused to obey XX/XX/XXXX, VA XXXX XXXX which as with the victims of the CFPB Consent Order were denied TARP protection of being granted a HAMP. Wells did not address the violating of rights granted by TARP as Wells received {$25.00} billion in bailout funds from XXXX, yet denied homeowners the same bailout of a lower interest rate in order to make a monthly payment to a debt that could not be confirmed but a solution to whether the debt existed by the homeowner not disputing it but taking the new terms of the modification, that create new titling that the borrowers authorized when agreeing to the modification!

Issue: Problem when making payments

Subissue:

Consumer Complaint: I applied for a received a loan to start a small business. the loan appears on my personal credit. I wrote in once before about being unable to advance the payment due date when I make more than one payment. I received a {$4.00} invoice in XXXX, despite making 2 payments in XX/XX/2023, XXXX payments in XX/XX/2023 ( cover XXXX, XXXX, XXXX, XXXX ) and 2 payments at once in XXXX ( should cover XXXX and XXXX ). I received an invoice for XXXX payment in regular amount. I called and spoke with XXXX, who immediately transferred me to XXXX, when I said I was recording the call as well. I was disconnected and reached XXXX who transferred me to XXXX, who transferred me to XXXX, because XXXX could not access the system. XXXX said that only car loans advance payments with extra payments. I told her not true, because mortgages did as well. She said my loan will not advance payment. I asked her to show me that stipulation in the loan agreement or what law allows it. I told her that I asked and was told that I could make extra payments without prepayment penalty at the time of application. She said there was no higher escalation but conceded that she had a boss and that she was not in the CEO office. I state that was the second untruthful statement made to me. When I informed her that I was recording the call, she read a statement of not approving of being recorded and disconnected the phone, despite being told that Georgia and Federal law allows one party consent. WellsFargo reports this on my personal credit. If I want my payment date advanced with extra full payments, I have the right to. If they can not point to a law or loan stipulation, they need to honor that right. Also, they can not give themselves the right to record conversations and deny that to customers, who have a lawful right to do so under federal and state statute.
