Consumer Complaint: I was recently included in a class action lawsuit with Santander Consumer. On Friday XXXX a representative from this company called and attempted to collect money from me on vehicle that was a total loss. I advised the rep that per the attorney general I wiuld be receiving a check on XXXX for the monies Santander over charged me for I told the rep now how can I owe you XXXX for a car that is now owned by XXXX XXXX but you all included me in a lawsuit of accounts that you over charged plus I dont have the car anymore. Santander ripped me of and I actually payed three and a half times what the car was sold to me for.also I am receiving a refund check from you?

Consumer Complaint: On XX/XX/2021 i contacted Santander Auto in regards to inaccurate information ive noticed being reported on my consumer report in the form of a late payment over 30 days. Company personal stated that there was nothing she could do regarding the inaccurate information. i also inquired about the excessive fees my accounts occurs each day the payment is late example 2 days past the due date and an extra $ XXXX {$100.00} dollars would be added to my account. according to 15 USC 1692, that's abusive debt practices. Personal hung up the phone. After calling again and reaching another representative, that personal would only discuss making a payment with me and would not help me any further then that. The action i am taking is writing an Affidavit of Truth and filing a complaint.

Consumer Complaint: In XXXX of XXXX I purchased a XXXX Platinum Extended warranty with my used car. My car was a XXXX XXXX XXXX XXXX with XXXX miles on it. The warranty was purchase at XXXX XXXX in XXXX, Maryland with a XXXX XXXX who advised me it would cover most everything. However the vehicle was repeatedly denied warranty work by XXXX when I tried to use it. I complained to oversite agencies and to the phone team. The phone team became incredibly hostile and tribal during the process. The XXXX ladies screamed at me when I asked for a supervisor and put me on endless holds. Many cases with XXXX and the dealer shops were opened. They sabotaged the billing and cancelled the plan after yelling XXXX XXXX type stuff at me. They even asked if I voted for XXXX. This is retaliatory and illegal. Please provide me the reason it was cancelled. Please provide me an entire billing history. Please refund all amounts paid into this account. This level of XXXX tribalism and financial scheming has no place in america. I saved the recorded calls for court. Please provide the amounts I paid in and the address to subpoena stuff. If the warranty isnt immediately refunded or retroactivated with no lapse I will sue.

Consumer Complaint: Received a loan from company in 2014 for about {$11000.00} on a used vehicle. Paid quite a few payments and the balance barely budge still at about a little over {$9000.00}. Company will not budge on fair resolution of the situation. This loan has been a nightmare and Im just may have to file for bankruptcy. Santander is a preditory lender who uses illegal practices and that my loan is now in litigation for the State of South Carolina this account should be permanently deleted from reporting as negativity. Please remove per. Attorney General XXXX XXXX.

A consumer credit transaction in which a finance charge was involved. 15 USC 1605 defines a finance charge as the sum of all charges in a consumer credit transaction. The finance charge does not include cash, but Santander Consumer USA took cash. The Finance charge is supposed to include insurance, but Santander Consumer USA made me purchase insurance separately.

None of which I have knowledge of nor did I consent to that company to check my personal and credit information. Santander Consumer USA did not provide the following proof : Permissible Purpose My written authorization Proof that I personally initiated these inquiries. To my knowledge, I have not signed any documents authorizing your organization to view my credit history therefore, your inquiry into my credit report violates the Fair Credit Reporting Act, Section 1681b ( c ) : Transactions Not Initiated by Consumer. There are currently XXXX complaints stating the same so it seems as if this is a common thing for this company.

( c ) On XX/XX/21, a response was received from SANTANDER CONSUMER USA that confirmed verbatim, " We have submitted a request to place the above referenced account into cease and desist status and you will no longer receive any further communication regarding the account except for certain notices via mail required by applicable law ''. Consumer Complaint: Santander Consumer USA. I had a car loan with Santander. I had my car for 3 years. I was in a car accident ( hit from behind XXXX on XX/XX/2020. My car was declared a total loss on XX/XX/2020. I had car insurance ( XXXX XXXX whom paid Santander and I also had GAP insurance ( XXXX ) whom also paid Santander. They are still reporting this on my credit every month as if i still have the car and reporting late payments. I called and spoke with Santander and told them the car was a total loss and they were paid by my insurance and my GAP coverage, however they are still reporting this on my credit.
