Consumer Complaint: I, XXXX XXXX, of XXXX, in XXXX, Connecticut, MAKE OATH AND SAY THAT : XXXX. XXXX, XXXX, XXXX, XXXX XXXX, XXXX, XXXX XXXX, Portfolio Recovery have willfully repeated to damage my consumer credit year in and out for over XXXX years. They have violated many of my consumer rights as well as federal laws and cfpb laws. XXXX. XXXX XXXX violated the following Federal laws 12 USC 1431- no bank can loan me anything they are borrowing from me 42 USC 408 -Asking/using my social on any extended credit, pre approval or loans is a federal crime being there is no lawful money. UCC 3-104 - Willfully and illegally used my negotiable instrument in the extension of credit to be paid to me. 15 USC 1602g - I the consumer am really the creditor!

Consumer Complaint: I just learned a XXXX credit account was established in my name and using my personal information through XXXX Bank. The balance being reported on my credit report is {$4100.00}. I have never applied for or held a XXXX credit card. On XX/XX/2022, I contacted Portfolio Recovery Associates and spoke with XXXX XXXX XXXX. I advised her of the situation over the phone. The Case Number is XXXX. In addition, I sent an email to XXXX advising that my identity had been stolen for the purpose of obtaining the XXXX credit card and requesting that they request the credit agencies remove this alleged debt from my credit report. On XX/XX/2022, I also contacted the card issuer, XXXX Bank. I was unable to speak with a representative and will be following up with the bank as soon as possible.

Consumer Complaint: XXXX is the name of the business based out of Virginia, yet I get calls every single day from around the U.S. These are not from their designated other locations and they use a different phone number every single time. You block it, they call you from another fake location. Starting from the most recent : XX/XX/XXXXXXXX XXXX, IL, XX/XX/XXXX XXXX, MA, XXXX XXXX, CA, XXXX XXXX Kentucky. They have called me from four different locations, four times in the past seven days. When you answer the phone, they very clearly are some scheme because they hang up after ten seconds of silence, every single time, and it is under the guise of attempting to collect debt if you ever call the number back, if it doesnt say the line is disconnected.

I am a federally protected consumer and I am concerned that this account may be a direct violation of my rights to privacy by violating the fair credit reporting act, Gramm Leach Bliley Act. According to 15 usc 1681a ( d ) ( 2 ) ( A ) ( i ) information relating to transactions and experiences are excluded from consumer reports, according to 15 usc 1681s-3 ( a ) ( 1 ) ( B ) consumers should be allowed to prohibit solicitation in regards to marketing and the sharing of such information. Consumer Complaint: PORTFOLIO RECOVERY, LLC ( " Portfolio Recovery '' ) is in violation of the Fair Debt Collection Practices Act ( " FDCPA '' ) 15 U.S.C. 1692f ( 1 ). The company is also engaging in racketeering activity and defamation of character. 1692f ( 1 ) prohibits a collection agency from making any attempts to collect on a debt unless expressed in the original agreement. The credit card agreement, statements, bill of sale and any testimony are general. The company does not possess any account-level documents that would identify me as the debtor. Portfolio Recovery is attempting to collect an alleged debt in the amount of {$570.00}. There is no contract that gives the company the authority to do this. Therefore they are in violation of the FDCPA, spreading false information about me to third parties and attempting to swindle me out of money. These crimes are held criminally liable under Title 18 with a fine of up to {$500000.00} and 20 years jail time. To be clear, I am disputing this debt and invoking my right to obtain documentary evidence, in accordance with 15 U.S.C. 44 for the records as described in IRS Publication 583 for Account # : XXXX. In the event that Portfolio Recovery does not have the documentary evidence I demand they immediately cease collection, zero out the account and delete the debt from my consumer report. Failure to comply may result in legal action.
