Consumer Complaint: In XXXX, Portfolio Recovery Associates filed a lawsuit against me over an account that was fraudulently opened online, one of many accounts. It was my very first time ever receiving a lawsuit from anyone. I did not know, or understand my rights under the FCRA. To be fair, this is a first time I dealing with an extensive identity fraud where I am struggling to restore my identity. As a victim of domestic violence, which began with Identity fraud, i learned over time the correct protocol with my situation. I filed police reports, FTC, and IC3 reports/ complaints as well as gave copies to the 3Bs as well as all Creditors/ Agencies showing that I am a victim of Identity Fraud. For the most part, some respectfully removed the accounts but others responded with they disagree since after their investigation, their reports are accurate. I then asked for copies of original contracts where it showed, I signed and dated. One responded with they decline to provide me what I asked, Portfolio Rec Associates, on the other hand sent me several letters this week, 3 of which they are closing and removing accounts. But the account, filed lawsuit in XXXX, in the letter was statements wrong information for example it says The account was active since XXXX. I know for a fact that is not true and I can prove it. None of which was the original contract, but the final page was the judgement in their favor. That was the concluding evidence for them to have it remain on my credit report, and approved by both XXXX as well as XXXX. I investigated further and found out that those statements are completely bogus. It is not an official statement, in fact, the return address does not in no way link to the bank. It links to random pdf files of other statements, then from those it links to a completely website where it shows where the money is really going. I am beyond exhausted with this whole process. I am victim of identity fraud and XXXX XXXX survivor, XXXX for the second time because of my credit. Companies like Portfolio Recovery Associates pray on the most vulnerable as if its an easy target. Theres no telling how many other they have done this too. Moreover, only time will show who is honest and who was deceiving.

Me and my attorney informed the airport what happened cause they didnt return the car like they said they were going to do. Then the credit card company allowed the airport to make a large purchase more than my credit limit. I believe it was around XXXX. I didnt pay the company so they passed the info to a collection agency and they were calling me. I informed them of the incident and put a dispute in but was denied. I asked how the company allowed a purchase to be made that was more than my limit. The company still calls me ( Portfolio )

Based on this information Portfolio Recovery and XXXX, XXXX XXXX, XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX; all violated my rights and the following laws : violations of Section 392.307 of the XXXX XXXX XXXX : Failure to Notify the Consumer of the limitations period has expired & Title 12, Section 1006.26 of the Code of Federal Regulations : New rules from the XXXX Consumer Financial Protection Bureau prevent debt XXXX from suing or threatening to sue over time-barred debts. I formally request that Portfolio Recovery Associates , LLC XXXX XXXX XXXX XXXX XXXX, State of Texas XXXX XXXX XXXX XXXX XXXX stop any and all attempts to collect on this debt, rescind/vacate/set aside ( cancel ) Default Judgement immediately. Portfolio Recovery Associates XXXX XXXX XXXX acted in bad faith and failed to notify me of the statute of limitations while the law suit was at court.

Consumer Complaint: Portfolio Recovery XXXX are notorious for harassing people for alleged collections accounts. I have reported them here in past years for alleged debts/collections. First, they have reported 2 collections to all 3 of my credit reports without providing any written notice and/or documentation of the alleged debts. On my credit reports, Portfolio Recovery doesn't even list who the alleged original creditor was or when the alleged debt was incurred. Second, Portfolio Recovery incessantly robo-calls my cell phone from dozens of different numbers daily that are not from their corporate number, including Sundays. Some of these numbers are : XXXX, XXXX, XXXX. XXXX, XXXX, XXXX, XXXX, XXXX, and this is just to name a few. Given the amount of different area codes they are calling from is a huge red flag that they are phishing scammers and not conducting legitimate business.

Consumer Complaint: Pursuant to 15 USC 1692 ( a ) Portfolio Recovery Associates used abusive practices in regards to acquiring my personal information as I have not opened an account with them nor did I give written consent to have my information. Portfolio Recovery Associates also violated 15 USC 1692j ( A ) because PORTFOLIO RECOVERY ASSOCIATES have contacted me in the past numerous times posing as a debt collector to collect debt from me, the consumer. Also 15 USC 1692g ( b ), this " alleged collector '' has failed to provide me with PHYSICAL proof showing my ORIGINAL contract with the ORIGINAL CREDITOR containing my signature. Portfolio Recovery Associates sent me a copy of an " alleged statement '' stating that it was verification. This does not contain original documentation nor does it contain my signature. My personal information was not permitted in writing by me, the consumer, stating that Portfolio Recovery Associates can retrieve my personal info which is fraud, which is a violation of 15 USC 1681b ( 2 ) which states that I have to give written instruction for my consumer report to be disbursed. Consumer Complaint: I recently viewed my credit report and noticed a XXXX XXXXXXXX account that was not mine. I contacted the creditors explaining that I am a victim of identity theft. I am for certain that the alleged debt did not belong me. They responded via mail stating that they had completed the investigation and the items were not deleted, as requested. I reached back out to them requesting the following ; copies of the original contract with my signature, copies of any papers that I agreed to pay what you say I owe, and explain what bounds me to them.Also, what kind of business dealing have I done with them? By law, everything on my credit report must be accurate, verifiable, and reporting a timely. If not, information must be removed from my credit report. Unfortunately, the problem was not resolved and they have yet to to provide signed documents with my signature.

Consumer Complaint: This company has infringed on my right to privacy, I have never given this company any right to have my personal information. This company is trying to collect on an alleged debt. This company reported unverified inaccurate information to the consumer reporting agencies, which has greatly harmed my ability to offer or extend my credit to other financial institutions. This is against federal laws. This account is not mine and was opened using my personal identification without my consent. When any furnisher of information is notified pursuant to the procedures set forth in Section 605B that a debt has resulted from identity theft, the furnisher may not sell, transfer, or place for collection the debt except in certain limited circumstances. Section 615 ( f ). Ive also never given this company permission to contact me which according to the FCRA is also against federal laws. I have asked numerous times for this company to stop furnishing false information to the CRAs and also for them to stop contacting me. My next step will be to file suit. This is my last time asking to please remove this account, its not mine.

Consumer Complaint: Portfolio Recovery has been repeatedly calling me for several years now from the number XXXX, which shows in called ID as XXXX. The calls have come in before XXXX XXXX and continue throughout the day. This happens several times a week, at times going over the 7 calls per 7 day limit as per FDCPA policy. I have also received numerous letters in the mail. I am a student who suffers from XXXX, and these calls cause me constant anxiety to the point I turn my phone off or mute it, which disrupts my day. Consumer Finance states the following on their website : The Fair Debt Collection Practices Act ( FDCPA ) says debt collectors can't harass, oppress, or abuse you or anyone else they contact. Harassment by a debt collector can come in different forms. Examples include repetitious phone calls that are intended to annoy, abuse, or harass you or any person answering the phone ; obscene or profane language ; threats of violence or harm ; publishing lists of people who refuse to pay their debts ( this does not include reporting information to a credit reporting company ) ; and calling you without telling you who they are. Portfolio Recovery has been repetitiously calling me with the intent to annoy and harass me. For this reason I will not call them or engage, as I do not feel safe or comfortable doing so giving their actions towards me. This is affecting my credit.
