Consumer Complaint: On XXXX XXXX, 2008 the credit market for my MBS contracts/contracted was restricted to the wider credit market by this unknown alleged finance entity on record on my real property credit contract after " Tender '' under Federal law was offered to the unknown party removing them from contract with/for TILA rescission 15 U.S.C. 1635. I have been discriminated against based on my MBS contract to a wider market. This unknown party had to be removed them self 's so Tender could be offered. Tender was Offered if the procedures were followed. As such you do not get a House. Tender was offered you have no legal standing after Tender was offered by Federal Law.

Consumer Complaint: I have problems with loan servicer Ocwen on how my account was billed and payments were credited to the account. Also, the additional charges and fees after the account was brought current as it took over 9 months for a payment of {$42000.00}, to be credited to the account. I requested a payoff quote dated XXXX XXXX, XXXX was {$55000.00} ( I have a copy ), Interest was due {$9900.00} per the payoff statement and at the end of the year XXXX I received a corrected Mortgage Interest Statement ( I have a copy ) for {$19000.00}. Also, IRS document reflects an additional {$9700.00} more interest from XXXX XXXX to XXXX XXXX, XXXX, in less than 10 months. My question is how a loan at XXXX per cent interest on a principal balance of {$29000.00} as of XXXX XXXX, XXXX accrue an additional {$9700.00} in 10 months? I would like someone to explain that to me. I sent a wire transfer of {$42000.00} on XXXX XXXX, XXXX ( I have copy ) was not credited as it was held as " UNAPPLIED FUNDS '' and not credited until XXXX XXXX, XXXX, 9 months after you received the funds of {$42000.00} per the Mortgage Account Statement dated XXXX XXXX, XXXX ( I have copy ). The Mortgage Account Statement also included additional charges for foreclosure costs, inspection costs and late charges that would not have been due if the unapplied funds had been applied to the account. Once the unapplied funds were applied on XXXX XXXX, XXXX the due date on the statement was XXXX XXXX, XXXX. This is incorrect as the payment and escrow was current by your records you faxed me and was on the XXXX XXXX statement. Per the enclosed print out and statement dated XXXX XXXX, XXXX there was {$27000.00} applied to the account from the original amount of {$42000.00} after the account was current. {$27000.00} applied as follows ; Principal {$8500.00}, Interest XXXX, Escrow XXXX. Also, on XXXX XXXX, XXXX less than two weeks after Ocwen received the wire for the {$42000.00} we request a payoff and received a payoff good until XXXX XXXX, XXXX ( I have copy ) in the amount of {$18000.00}. Wired funds were received by Ocwen in the amount of {$18.00}, XXXX on XXXX XXXX, XXXX before the XXXX XXXX, XXXX payoff expired. The {$18000.00} funds were held by Ocwen and returned that it was short of the payoff. XXXX my father contacted The Consumer Ombudsman, XXXX XXXX and received a payoff dated XXXX XXXX, XXXX to pay in full {$18000.00}. XXXX XXXX, XXXX Ocwen received the XXXX and final wire from XXXX XXXX in the amount of {$18000.00}. Again they sent the wire back after holding XXXX XXXX 's money for 90 days with the only explanation that it was not enough to pay loan off. I would like to believe that this was done in error as the mortgage was current on XXXX XXXX, XXXX payment to Ocwen in the amount of {$42000.00} and the additional payments paid in advance. The funds should have not been held in a separate unapplied funds account for over 9 months as the account accrued interest, foreclosure fees, late fees, inspection fees and attorney fees. This account was paid on XXXX XXXX, XXXX and if had been credit properly would not be in foreclosure at this time.

Consumer Complaint: I have a mortgage with Ocwen Loan Company. I have had issues with Ocwen in the past - mostly due to the fact that their workforce consists of people who do not have a command of the English language. I take care of my XXXX father and he has been in and out of the hospital. He is well right now and I am slowly going through mail. I discovered an escrow refund check dated XXXX/XXXX/15. I can no longer cash the check. When I have discovered checks from other companies that have expired, the company that issued the check is very happy to re-issue the check. I called Ocwen to please re-issue the check or apply the amount to my loan, they stated that they probably would not and it would take a week to investigate whether they could re-issue a check or not. I do n't understand why this! First, they gave the reason that my credit score was not good. My credit score has actually improved since 2015! Then they said the lowered my payment. My payment went down by XXXX dollars! That is not enough to make up the difference of {$610.00}

Consumer Complaint: Purchased the house in 1988. I retired and could no longer afford the home. Contacted the mortgage co. to do a quick sale it was approved. Could n't sale because they wanted more than the house was worth per thier appraisal. Next they approved a died in lieu. Next they kept stalling. Said thier Attorney had to do a lien search. Came back and said XXXX XXXX XXXX ahd a Lien on the property. I have never had any loan with XXXX. So I had a Attorney run a search nothing. I ask for the report. They sent me a report ran by XXXX XXXX Mortgage in california. I called them, they could not find anything. XXXX me to the Company in Indiana, they found nothing. So apparently these papers they sent me are fradulent. What they sent me was something they typed up. There is nothing legal about it. My Attorney did not find anything, thier soppose mortgage co dod not find or know anything about this lien. XXXX XXXX has been out of business for many years merged with XXXX XXXX, they had nothing. Changed name to XXXX XXXX XXXX, called them they had nothingThis has been going on for more than a year. My credit is now shot. They approved the quick sale, but I can not sell it because it is worth XXXX but they will only accept XXXX had offers for XXXX. Now they are putting up all the obstacles to not do the deed in lieu. Since there is no lien. They need to get this done and over with.

Consumer Complaint: During the process of selling a property XX/XX/XXXX, I was told by the title company that they were unable to get a clear title because a day before the scheduled closing XXXX claimed there was a mortgage default and would not clear the title. As a result {$60000.00} is being held in escrow from the sales proceeds. The mortgage on the property was paid in full in 2003. I have proof in the form of cancelled checks, bank statements, XXXX forms from the mortgage company which correspond to my tax returns, a payoff balance letter form the mortgage company, and a congratulatory letter from the mortgage company when I sent final payment. The original mortgage was with GMAC Mortgage the final mortgage payment was made to them. Due to the banking meltdown, this issue has ended up with XXXX. Lawyers at the title company I 'm working with have contacted attorneys at XXXX and XXXX XXXX, a vice-president at XXXX. They been unsuccessful in obtaining from XXXX what they are claiming the actual default is or any proof that there even is a default. I have called XXXX XXXX VP at XXXX numerous times to only receive voice mail. I have sent numerous emails with the same result. I also went to XXXX in person and attempted to speak personally with XXXX XXXX and deliver supporting documents as listed above. I was n't even able to gain access beyond the lobby of the building. In addition, no one would accept the packet of documentation I had prepared for XXXX XXXX. It is now being suggested to me, by the title company, that in order to release the escrow funds I may need to buy a bond for an additional {$900.00}. This mortgage was paid in full thirteen years ago and I have the proof. To pay more now seems ridiculous.

Consumer Complaint: We have been trying to sell a property since XX/XX/XXXX. We have a motivated buyer willing to pay in cash. We have submitted all the documents to Ocwen and have received a conditional letter of approval. Meanwhile it is now XX/XX/XXXX and Ocwen has n't given us the approval for sale yet they have everything asked for. They have made no effort to contact us regarding the sale but call to harass four to five times a day to collect the debt. No one at Ocwen knows anything but have started foreclosure proceedings on the property that 's waiting to close on by them stalling.
