Consumer Complaint: After I completed XXXX I moved to the XXXX area after XX/XX/XXXX to help out afterwards. I worked in XXXX and the XXXX services since then until I started as a XXXX. Currently, XXXX. XXXX. I submitted a loan modification application to Ocwen to modify my FHA mortgage and Ocwen did not make a decision on the modification application. Ocwen claims the home was sold at auction on XXXX without evaluating my loan modification application to modify the FHA loan. I lost the job that I had XX/XX/XXXX when I borrowed the mortgage from a company that sold it to GMAC. GMAC went bankrupt and now Ocwen is the loan service provider. I searched diligently since I lost my job XX/XX/XXXX but am not able to find employment, but I am a XXXX with student loans. The FHA loan was discharged in a bankruptcy in XX/XX/XXXX and I continued to make payments until my retirement account was empty.

Consumer Complaint: I have a old mortgage loan showing up on some title work on a property I am trying to sell. The loan was originally GMAC mortgage company which is a defunct mortgage company now. The property securing this mortgage was lost in a foreclosure and sold, the debt was discharged in a Chapter XXXX bankruptcy. In the research I have done Ocwen Loan Servicing has taking over for GMAC Mortgage company but I have tried contacting them via email and regular mail and have not received any return communication from them. This lien needs to be released so the sale can go through. My only recourse as of now is to file a " quite title '' law suit which could take a couple of months and cost thousands of dollars in attorney fees. There has to be a way I can get a executed lien release on this case.

Consumer Complaint: RECENTLY MY HUSBAND GOT A CALL AND WAS TOLD THAT WE WERE XXXX PAYMENTS BEHIND ON OUR MORTGAGE PAYMENT. TO BE EXACTLY IT WAS XXXX XXXX, 2016 THE DAY BEFORE OUR DAUGHTER WAS TO BE GRADUATING FROM COLLEGE. WE WERE IN A FRANTIC. I CALLED THE XXXX NUMBER AND SPOKE WITH SOMEONE THAT TOLD ME THE SAME THING. I TOLD THAT PERSON THAT WE HAD NEVER MISSED A PAYMENT BECAUSE WE WERE IN BANKRUPTCY AND KNEW THAT WE COULD N'T MISS A SINGLE PAYMENT AND THAT I HAD BANK STATEMENTS AND PERSONAL CHECKS THAT HAD BEEN CLEARED TO PROVE IT. I EXPRESSED TO THEM THAT SOME OF THE PAYMENTS MAY HAVE BEEN LATE BUT WERE ALWAYS PAID WITHIN THE MONTH THAT THEY WERE DUE.SOMEWHERE IN THE HEATED DISCUSSION I WAS TOLD THAT OUR MORTGAGE PAYMENT WAS DUE ON THE XXXX OF EACH MONTH, I THEN SAID HOW IS THAT? WE NEVER KNEW, WE NEVER GET STATEMENTS FROM YA 'LL AND THAT WE WERE TOLD WHEN WE FILED BANKRUPTCY THAT OUR PAYMENTS WERE DUE ON THE XXXX OF EACH MONTH. AS WE GOT FURTHER INTO THE CONVERSATION I ASKED TO SPEAK WITH THE MANAGER OUT OF FEAR OF LOOSING OUR HOME BECAUSE THE PERSON THAT I WAS TALKING TO WAS N'T LISTENING TO ME NOR UNDERSTANDING THE SERIOUSNESS OF MY FEAR AND CONFUSION. I ALSO EXPRESS TO HIM THAT WE HAD FULFILLED OUR AGREEMENT WITH THE BANKRUPTCY COURT AND HOW SOMETIMES THINGS HAPPEN IN LIFE THAT ARE BEYOND OUR CONTROL MY HUSBAND HAD LOST HIS JOB AND WE HAVE FOUGHT HARD TO MAINTAIN AND HAD NOT DONE SO ONLY TO LOSE OUR HOME IN THE END.I WAS THEN TRANSFERRED TO A ESCALATING MANAGER WHO FINALLY SAID THE REASON FOR THE LARGE PAST DUE AMOUNT WAS THAT OCWEN HAD TAKEN OUT INSURANCE ON THE HOUSE. I TOLD HIM THAT WE COULD NOT AFFORD TO PAY THAT AMOUNT AT ONE TIME HE ASKED IF WE COULD AFFORD {$700.00} A MONTH I SAID EXTRA? HE SAID NO THE TOTAL INCLUDED OUR MORTGAGE PAYMENT I SAID YES. HE THEN ASKED IF WE WERE HAVING HARDSHIP I SAID NO WE HAVE BEEN ABLE TO MAKE THE PAYMENT SO FAR. HE SAID IF YOU LIKE I CAN MAIL YOU OUT A LOAN RE-MODIFICATION PACKET. I SAID WE CAN MAKE THE {$680.00} PAYMENT ITS NOT A PROBLEM. HE THEN SAID IT COULD POSSIBLY LOWER YOUR HOUSE PAYMENT I SAID OK. AFTER I SAID OK HE THEN QUICKLY SAYS YOU MAY OR MAY NOT QUALIFY FOR LOWER PAYMENTS IT COULD POSSIBLY GO UP I THOUGHT TO MYSELF WE CA N'T AFFORD TO GO UP SO WE WILL JUST LEAVE WELL ENOUGH ALONE. SINCE THEN MY HUSBAND HAS BEEN BACK AND FORTH ON THE PHONE WITH DIFFERENT OCWEN EMPLOYEES SAYING DIFFERENT THINGS ALL OF THEM HAVE TOLD HIM CONFLICTING STORIES. WE TRIED TO PURCHASE HOMEOWNERS INSURANCE SEVERAL TIMES BUT WERE DENIED BECAUSE OF BANKRUPTCY. XXXX XXXX FINALLY GAVE US HOMEOWNERS INSURANCE BUT CANCELLED IT BECAUSE OUR YARD WAS NOT FENCED IN AND WE HAD A TRAMPOLINE IN THE BACK YARD AND HUGE TREE THAT ABOUT COVERED THE WHOLE BACKYARD. WE KEPT TRYING BUT WAS DENIED. WE FINALLY WAS ABLE TO HAVE THE TREE CUT DOWN USING TAX REFUND MONEY. WE GAVE THE TRAMPOLINE AWAY. WE TRIED AGAIN AND XXXX XXXX WROTE US HOMEOWNERS INSURANCE ON THE CONDITION THAT WE REPLACE THE ROOF WITHIN 60 DAYS. LUCKILY WE WERE DISCHARGED FROM BANKRUPTCY IN GOOD STANDING AND I WAS ABLE TO GET A LOAN THROUGH MY BANK TO PAY FOR IT. MY HUSBAND 'S ARGUMENT WITH OCWEN IS THAT THEY HAD THE HOUSE INSURED AND SHOULD BE LIABLE FOR THE ROOF. THE AMOUNT THAT THEY SAY WE ARE BEHIND IS WHAT WE PAID FOR THE ROOF. SINCE XXXX XXXX, 2016 WE HAVE BEEN BOMBARDED WITH MAIL. IT LOOKS LIKE THEY ARE TRYING TO FORECLOSE ON OUR HOME. CAN YOU PLEASE HELP US? THIS HAS BEEN A NIGHTMARE. I HAVE HAD MANY RESTLESS NIGHTS AND ANXIOUS DAYS WONDERING IF SOMEONE COULD HELP US. PLEASE HELP US WE SEEM TO BE FIGHTING LOOSING BATTLE UNLESS THE MONEY IS PAID UP FRONT AND SOON! WHO EVER IS READING THIS I ASK THAT YOU BE CONSIDERATE AND UNDERSTANDING IN THAT WE ARE TRYING TO HOLD ON TO OUR HOME AND THAT WE DO LACK SOME UNDERSTANDING IN THIS WHOLE MATTER. Issue: Cont'd attempts collect debt not owed

Consumer Complaint: Ocwen loan servicors is trying to collect a debt they do not have the legal standing to collect from me. Ocwen has asserted themselves on my homeowners policy as my mortgagee, they do not have any documents to support this claim. At best they are a default dect collector which I have no legal obligation to pay any money too. They have not been able to validate the debt according to the law. They acquired the suppose debt when it was in default therefore they could never be a true correct or legal mortgagee. The remedy I seek is for them to remove themselves as mortgagee from my XXXX XXXX casualty insurance policy so I can have a check issued to me without them as a cosigner. I do not believe that I Ocwen has the legal standing to ask me to pay them anything as all the documents they have sent me do not have their name as the original creditor on them. They have sent time and time again documents that do not contain their company 's name as a creditor. Therefore I believe that they 're standing is illegal and they need to stop interfering.

Consumer Complaint: During the financial crisis of 2008 I ran into problems and applied for a loan modification. I was accepted and received a lower rate for 5 years. After 5 years the rate increased by 1 % point per year. During those 5 years I never missed a payment. Each payment was on time. The increase of 1 % point per year has turned into a problem. The problem is that when I go to refinance no lender wants to touch the modified loan. I have been told that my situation is unusual in that I have made all the payments since the modification and lenders do not know what to do with the loan, therefore no one will bother refinancing me. I am at a crossroad an and looking for some guidance on what I may be able to do.

Consumer Complaint: I have a mortgage loan that was sold to ocwen, and had fallen behind on payments after some employment issues. Our current payment is approx. XXXX. We called in to ask for arrangements and were told to apply for a loan modification ; we declined and did not fill out paper work, but instead started sending in extra payments to pay down amount owed. We thought we had successfully done so by the beginning of XX/XX/2016 when our outstanding past due amount was approx. XXXX for XX/XX/2016 payment. We sent in XXXX which would have paid past due amount and left only a balance for the current payment month, which was also what the Ocwen website stated up until the first of XXXX. Needless to say that I was ecstatic to be over this hump and done with the nearly 20 calls per day by ocwen 's agents trying to push me into a loan modification or a huge lump sum payment. I was going to make another payment which would have paid my current month, leaving the past due nightmare behind us only to find via Ocwen 's webpage, that this company has reversed all of my payments since XX/XX/2016 ( approx. {$5100.00} ) and is now showing the mortgage in default, with payments owed starting at XX/XX/2016. I called Ocwen and they have no clue what is going on, the foreign sounding rep named XXXX, placed me on hold for 45 minutes only to tell me they have to send in an inquiry to their cashiering dept. to find out why this is being done and that I would have a response in approx. 7 business days, which would put us into the last week of XXXX. They do not know what happened, they do not know where my funds are ( they have not been returned to us ), they do not know how to fix it, but I am accruing fees and interest until they figure it out.
