Consumer Complaint: It appears as through Ocwen Loans Servicing, LLC are going around in circles and not coming to an amicable resolution to this issue that has affected our property. This is in response to a recent letter sent through the CFPB Portal stating " Additionally as Ocwen did not service the account prior to XXXX XXXX, we have no record of establishing a credit tradeline prior to that date. You have indicated your credit report shows Ocwen established a credit tradeline prior to XXXX XXXX, however you have not supplied a copy of their credit report to Ocwen so that this claim can be investigated. To have this issue research further please provide a full current ( within 90 days ) of your credit report directly to me. ". Please note that a copy of the credit report dated XXXX XXXX, XXXX at XXXX was generated and sent to Ocwen by certified mail, through the Consumer Financial Protection Bureau and XXXX XXXX, XXXX, the XXXX Department of Finance legal division, Securities and Exchange Commission and XXXX XXXX XXXX XXXX Trustee on XXXX XXXX, XXXX along with all supporting financial documentation. After careful review of the Corporate Assignment filed on the property located at XXXX XXXX XXXX, we have discovered that the Power of Attorney Document Reference XXXX giving you Limited POA ( Power of Attorney ) is based on LOAN NUMBER XXXX which is not the loan for the property XXXX XXXX XXXX XXXX, NY XXXX. The recording was done in error The alleged loan number for the property is XXXX. I 'm also including a statement for your reference. Ocwen Loan Servicing LLC has requested XXXX XXXX XXXX to record the Corporate Assignment to validate their reason on collecting payments prior to securitizing the loan for XXXX XXXX XXXX XXXX XXXX XXXX and have not applied {$48000.00} of payments towards the property from XXXX XXXX - XXXX XXXX in the past 17 years. A complaint will be filed against the Notary, XXXX XXXX XXXX in the Executive Governors Office in Florida for his errors and omission by not validating the reference document. Furthermore Ocwen has not retracted the XXXX that has been recorded. Per the real estate records division, Ocwen Loan Servicing , LLC can only rescind the Power of Attorney.

Consumer Complaint: I filed Chapter XXXX bankruptcy and I have recently come out of it as of XXXX/XXXX/2016. While I was in the Chapter XXXX my mortgage company was GMAC. Since I have been out of my bankruptcy I have yet to receive any documentation from GMAC in regards to how to make my payment or who I should make it to. Right after I was out of my bankruptcy I went to refinance my mortgage. This is when I found out that my mortgage is no longer with GMAC, but it is with Ocwen. I have contacted Ocwen to find out when my next mortgage payment is due, but they are telling me that I am in an active Chapter XXXX ( which ended XXXX/XXXX/2016 ) and my payment is due XXXX/XXXX/2016. They are also telling me that they will not have any additional information until the Chapter XXXX payments have been processed and they ca n't tell me when this will occur. Furthermore they are telling me once it is resolved and they find out I am 30 days or more late, they are going to report to the credit bureau. This is not making sense to me since they are telling me that my payment is due XXXX XXXX, 2016 and they do not have any other date on file and if I go 30 days late this will hurt the mortgage process I am currently in.

Consumer Complaint: I got behind on my morgage really bad-Ocwen loan servicing, LLC is the lender. I was fighting XXXX at the time-had to file bankrupcy chapter XXXX. Ocwen offered to modification -which sounded good and all. I accepted because I thought it was the best way to keep my house. I went through 2 sets of modifications payments before they approved me. The thing is I was approved of payments of {$430.00} a month in which we can afford but I have 7 years to pay off my house and they tack all the fees on plus more in which at the end of the 7 years I will still will have a ton of money to come up with or loose it all over again. They say I owe XXXX on the home-how is this possible-thats more than what I paid for 25 years ago when I purchased it.Not sure what to do or who to talk to about this situeation and are they in the right as far this modification.

Consumer Complaint: in XXXX we feel behind by 2 months on our mortgage, and we offered to pay extra each week to catch it up over 3 months, Ocwen refused to allow us to do that, they said we had to pay the full 2 months at once or we could n't pay it. Now they are withholding {$400.00} of our escrow payments which was to cover our flood insurance, which for an unknown reason FEMA decided we are no longer in a flood plain, so they are refused to pay it. They keep lying and tell us they tried to call, we have caller ID and not 1 call came in, they continuously harass us if our payment is n't in by XXXX, even though I have called and said it would be paid by x date. They try to tell me yesterday ( XXXX ) that I was not authorized to discuss our loan, but I hung up and called back and was told that I am, this has happened on numerous occasions over the last few years. These are the ones that are fresh in my mind, but they never listen, always rude and never want to work with you if you do have an issue. They just want to undermine you so they can work to repose your home.

They confirm they have received all documents except a document explaining why a teacher is paid 11 months out of the year rather than 12. This explanation has been sent twice, escalated to the escalations specialist XXXX at Ext XXXX who by voicemail confirmed all documents received. Now we received a call and confirmed that they are stating they have not received the documents and the original documents are expired. They 're happy to assist with re submitting the documents ... This comes from the relationships desk. We have had several appointments with the relationships representative in which they have not kept the appointment. The note read back from the representative is that we did not keep an appointment yesterday so they left a message. no appointment was scheduled. Consumer Complaint: I lost my full time contract with my job and got behind in my payments. I completed all the paperwork for a modification. The company sent me a notice that they did n't have all of my paperwork in time to review my package. But, I completed all of the documents. I got a phone call that I did not send my income verification form and that it needed to be filled out and to sent in immediately. But I had already forwarded the letter of employment and my salary amount to them.They emailed this " income verification form '' with no code for me to open it. Since I could n't open it, I just emailed back my employment letter with the salary amount. Every time I called for information no one understood what I was saying ( everyone in the customer service office is in XXXX ). When I asked for someone in the United States, the representative told me she could not transfer me to the States and I would have to keep calling the same number until someone from the Stateside picked up. I was sent a notification in the mail that my home was in foreclosure and the sell date was XXXX/XXXX/XXXX. I called and was told they had not received my income verification form. I told them I emailed the salary letter. The representative told me I needed to complete the form. I told him I could not open the document, because no one had given me a code. This representative told me, the code is the last XXXX of your social security number. So, I went immediately and opened the form to complete it. That 's when I found out that the " income verification form '' was an IRS transcript request form!! I called back and asked why they needed a new form, because I had included everything with my documents. I was told the form was completed improperly. I asked them how? I was not allowed to alter ANY of the documents sent, and I was instructed to only complete the budget form and sign all the others. The representative stated that the " income verification form '' only include the years XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX but XX/XX/XXXX would be needed.So, I immediately forwarded the new document along with a completed IRS transcript I had already received for my son 's financial aid account at his school.I called a few days later to check on the status of the modification and was told my modification had been rejected because my paperwork was incomplete! I again asked to speak with someone in the US, I was advised they could not transfer me and that the foreclosure on my home would proceed on XXXX XXXX. I asked how much it would cost to reinstate my loan, but the individual was not sure about the total and just told me to send in {$6400.00}. So, then I called the attorney 's office handling the foreclosure ( XXXX XXXX XXXX ). The representative could not tell me about a reinstatement cost and directed me back to the company and to as for the Loss mitigation department. I called OCWEN again and asked to speak with someone in the loss mitigation department. I was told there was no loss mitigation department.I searched for a U.S. number and found XXXX. I called the number on Monday and was transferred to a woman named XXXX XXXX ( XXXX ext XXXX ). She apologized for the misunderstandings and advised me to forward {$4500.00} by bank wire only directly to any XXXX XXXX using the following information : OCWEN LOAN SERVICING , LLC IN TRUST FOR VARIOUS INVESTORS AND MORTGAGES routing # XXXX account # XXXX and to include my name, account number, and property address. She told me to fax the bank wire transfer receipt directly to her at XXXX or to fax it XXXX XXXX ( phone number XXXX ext XXXX ) at XXXX on XX/XX/XXXX. Everything was sent as instructed. I called to verify the stop on the foreclosure & was told it had been stopped. Was told on XX/XX/XXXX by HOPE the foreclosure was completed. The cash bank wire was returned 13 days later on XX/XX/XXXX reason : not enough information.

They make me go through so many signing of documents and in the end, the answer is no. The first time it was because " they owner of the loan did not participate in the HAMP program ''. Now this time because I am not delinquent! I have to pay them {$85.00} because I am late by a week or two, so they do not consider this delinquent then!!! Consumer Complaint: Wells Fargo is trustee to the account of my mortgage, serviced by XXXX. For the last five years I have battled these companies over issues such as illegal foreclosure, where they sold and repurchased the property for XXXX more than the original loan while I was applying for loan modification. Wells Fargo rescinded the sale but left the principle balance at the higher amount. Communicating with them is impossible as the call center is outsourced to XXXX. There is no communicating with these people They simply do not understand the issue and are like robots you can barely understand. Wells Fargo denied they have a connection to me. I am unable to participate in any programs to save my home. Apparantly this is an illegal XXXX equity loan that we simply did not understand. How can the average consumer win with the big business bankers? Who can help? What happened to the american way? After 16 years of paying a mortgage my principle balance is more than the original loan and I will lose the house XX/XX/XXXX. I was offered only to agree to foreclosure, no other options available from XXXX, the servicing company who 's motto is ; " Helping people is what we do '' This is my last attempt to find someone who will listen. I will have to let them win in the end and just walk away like so many other americans have had to do. Lose everything and start again while executives live the life of luxury. In XX/XX/XXXX-XX/XX/XXXX I invested XXXX dollars with an attorney and a class action suit to battle XXXX and Wells Fargo. Just before settlement my attorney disbarred and left me hanging. If this complaint is actually seen or read, I respectfully appreciate any help or direction with the issue.

Consumer Complaint: My mortgage is currently serviced by Ocwen. Ocwen modified my mortgage loan in 2012 and reported a principal reduction of XXXX to the IRS. However, Ocwen never reduced the principal on my loan by {$220000.00} ... .they simply report that amount as a " XXXX waived balance '' ( see attached ). I was advised by Ocwen that even though they did not reduce the principal of my loan, the IRS advised them it was " OK '' to report the loss. Since I received a XXXX income statement for XXXX, it has caused major issues with my tax filings, due to the extreme income adjustment. Ocwen has refused to reduce the principal balance of the loan by {$220000.00}, even though they have reaped the benefits of the IRS tax write off. Clearly, Ocwen has violated Federal IRS Tax Code and is guilty of financial fraud. Ocwen has also issued forced placed hazard insurance ( HOI ) at {$3500.00} per year, which is very extreme based on the current value of the property. Ocwen has failed to prove up the force placed insurance policy, even though i have requested it on numerous occasions. This serious increase in HOI has bumped my pushed my escrow up to {$430.00} per month ( see attached ). Furthermore, the current HOI has refused to pay for the serious plumbing repairs that are covered in normal insurance policies. Overall, I feel cheated and deceived by Ocwen, so I am seeing your assistance on this matter.

Consumer Complaint: I believe OCWEN Loan Servicing , LLC has committed robo-signing and mortgage document fabrication. In XX/XX/XXXX, I asked OCWEN a simple question " If I sell my house today, how much is the payoff amount ''. OCWEN told me a higher amount and that is when I became suspicious. I started to check over my documents and XXXX Office of City Register filed documents. I noticed there has been no assignor since XX/XX/XXXX after INDY MAC bank went bankrupted following the mortgage crisis in XX/XX/XXXX. It looked to me that no one owned the mortgage note and it was n't assigned to anyone. I told OCWEN that the mortgage was n't assigned to anyone and I asked them who is the owner of the mortgage note. XXXX told me that XXXX XXXX owned the mortgage note but when I called XXXX XXXX they told me they are not the owner or not affiliated with OCWEN in any way. So XX/XX/XXXX, OCWEN decided to file an Assignment of Mortgage which I believed is fraudulent. OCWEN, " XXXX '', XXXX XXXX XXXX, XXXX XXXX XXXX all share the same address. " MERS '' assistant secretary XXXX XXXX, who created the Assignment of Mortgage, does she exist. What is going on here.
