Consumer Complaint: Ocwen Loan Servicing is listing a negative account on my credit reports. I do know that there is no law requiring Ocwen to submit any credit information to these credit companies. Owen and I are working together to sell this house which would benefit myself and Ocwen. Ocwen is not seeking money damages so there is no reason to keep this account on my credit reports. The mortgage was predatory from the start and has been a nightmare ever since. Because of this derogatory account on my credit report, I have been denied credit, bank accounts, employment, and proper housing. The CPA prevents companies from unfair, deceptive, and abusive acts. I am being treated unfairly and abused by Ocwen. This account is not REQUIRED to be put on my credit file so there is no reason other than to harrass me, that it should be listed.

Consumer Complaint: Regarding case # XXXX, how much time does Ocwen need to make a copy of the filing they have been claiming 'for months ' that they filed with the county? The question regarding as far as to why has their 'collection department ' being the one handling this loan when the loan was never on collection should also be an easy answer they should readily provide Why does the investor on whose behalf Ocwen was servicing the loan, wants to keep the note. I think that in this case CFPB should intervene and question the issue.

Consumer Complaint: About XXXX XXXX, XXXX XXXX XXXX started trying to collect a deficiency amount on a mortgage that had been improperly foreclosed by GMAC in XXXX XXXX. GMAC has since admitted violating the required procedures for foreclosure and I was compensated by 2 different federal settlements from the mortgage lawsuits. GMAC shows my balance as {$0.00}. No Deficiency judgement was ever sought or obtained for this amount by GMAC or XXXX XXXX and Tennessee has a 2-year statute of limitations for such filings under Tenn Code XXXX XXXX. XXXX XXXX is aware of this law but has continued to report this to XXXX and XXXX as an unpaid collection. I have disputed this with both bureaus and XXXX has remove it but not XXXX. This has hindered my ability to obtain a mortgage using my VA loan. XXXX XXXX is unresponsive about this. This is an unfair collection attempt by a 3rd party for a balance that the original lender agreed to remove under the federal settlement.

XXXX XXXX, XXXXIn the past ten years, hundreds of thousands of residential mortgages were bundled together ( often in groups of about XXXX mortgages ), and investors were offered the opportunity to buy shares of each bundle. This process is called securitization. Each such bundle of residential mortgages was given a name, such as " XXXX XXXX XXXX XXXX XXXX XXXX. '' The name indicates information about the particular trust such as the year it was created ( XX/XX/XXXX ) and its contents ( with OPT indicating that the loans in that particular trust were originally made by Option One Mortgage ) .Each such bundle/trust has a Cut Off Date identified in the trust documents ( specifically, in the Pooling and Servicing Agreement ). The Cut Off Date is the date on which all mortgage loans in the trust must be identified. In short, a final list of all of the mortgages in the bundle is set out. Each trust also has a Closing Date which is the date that the individual mortgages are transferred to the Trust Custodian, who must certify that for each mortgage, the custodian has a mortgage note endorsed in blank and proof that the ownership of the note has been transferred. This proof is most often an Assignment of Mortgage. Most trusts included the following or equivalent language regarding the Assignments : " Assignments of the Mortgage Loans to the Trustee ( or its nominee ) will not be recorded in any jurisdiction, but will be delivered to the Trustee in recordable form, so that they can be recorded in the event recordation is necessary in connection with the servicing of a Mortgage Loan. " Title insurance companies issued policies guaranteeing that the trust had clear title to the mortgages. When widespread defaults occurred, Trustees discovered that the laws regarding Mortgage Assignments varied significantly from state to state. Many issues regarding such Assignments were simply unresolved. One of the most significant issues was whether Mortgage Assignments could be back-dated or have retroactive effective dates. This issue arose because Trustees and their lawyers discovered in the foreclosure process that the Assignments could not actually be located, or that certain states did not allow blank Assignments. To solve the problem of the missing Assignments, new Assignments were made and recorded. Because the question of retroactive Assignments had not been resolved, most of these Assignments did not set forth the actual date that the Assignment took place. The Assignments were signed and notarized as if the transfer took place many years after the actual transfer date. The Assignments were prepared by specially selected law firms and companies that specialized in providing " mortgage default services '' to banks and mortgage companies. In jurisdictions with a high rate of mortgage defaults, over XXXX % of the filed Mortgage Assignments in the last three years were prepared and filed by the same XXXX or XXXX law firms.ATG

Consumer Complaint: On XX/XX/2016 I sent in my monthly mortgage payment to Ocwen for the month of XX/XX/2016. ( check # XXXX ). I am always a month ahead in payments. ( see attached ) Ocwen cashed that check on XX/XX/2016. I was expecting to receive my next payment coupon from them for XX/XX/2016 but by XX/XX/2016 I had not received it, so I sent Ocwen a email asking why I had not gotten it yet and on XX/XX/2016 I received a email from them that stated ( see attached ) a mortgage account statement is sent either when a payment is received or when a payment is not received by the end of the grace period, whichever is earlier. But as I just stated they DID RECEIVE my payment for the month of XX/XX/2016 ( see attached ) but have failed to send me XX/XX/2016 payment and here it is XX/XX/2016. I decided to give them the benefit of the doubt and and wait to see if they would send me my next payment. On XX/XX/2016 I still have n't received a payment coupon for XX/XX/2016 payment so I sent them another email stating that I am still waiting for it. I have not signed up for paperless billing and I never will. Ocwen suggested in their email to me that I just send in the payment without the payment coupon. I will probably have to end up doing this because of their negligence. I am scared to think of what problems lie ahead because of not having that payment coupon. This is not the first time Ocwen has failed to send a payment for the following month mortgage.
