Consumer Complaint: On XX/XX/XXXX a three/ninety day notice from a very aggressive attorney XXXX claiming to represent a XXXX. without disclosing any debt collection notices as required by law. Soon after, I received a summons to court from Atty XXXX indicating my primary residence and home had been sold in a non-judicial foreclosure. According to my records a Notice of Sale was filed on XX/XX/XXXX then a Notice of Recission was filed on XX/XX/XXXX by Ocwen my current lender. Subsequently, no other notices were filed and I was not notified of any sale dates. I had been communications with Ocwen my lender under review for a loan modification

Consumer Complaint: Starting in the first quarter of 2008, AMRICAN HOME MORTGAGE, HOMEWARD RESIDENTIAL and now OCWEN have conducted malpractices with me the borrower in the past including ( among other things ) : robosigning, charging improper fees, providing false or misleading reasons for denying loan modifications, failing to honor in-process loan modifications agreed to by prior servicers. As a research was conducted on my loan origination and process a number of these malpractices were found and have proof on my records. such as lack of having thje original note of my loan and not felling ashamed on that and at least giving me a fair modification that I can effort to pay. Instead I have had to request modifications a number of times through the past 7 years but have not received. At times they would offer modifications that made not sense in our finances situation such as offering a mortgage payment of XXXX while my income was not even XXXX monthly. My financial situation now is better then before. therefore again I went ahead and requested a modification and again this bank shamelessly is not even giving me a formal denial As matter of fact the bank representative says that the bank thinks that I requested to many modifications and did not accepted me, also they say that '' the Investor '' does not want to modify the loan .And question is which investor? because i have prove that this bank has sold my loan in the XXXX 7 times. if you need prove and i can send to you. That is why they do n't even have the original note. but no formal answer has been giving to me.. I need help. I need this bank to be held accountable on the dishonesty that they di in the past. When this bank was convicted my court on doing the same with other consumers they promised to act better with people and this has not happened at all with us. Please help us. Make this bank responsible for what they do being under lots of stress because of this matter and I need help regarding these issues.

Consumer Complaint: Ocwen Loan Servicing , LLC and I entered into a loan modification over a year ago. And have been making regular monthly payments for over a year now. However, Ocwen only choses to credit the payments it decides to deposit on the dates it decides to deposit or in some cases returns back the funds. I send a payment but they never credit it to the account. Ocwen also does not report payments that were made and credited to the account correctly or at all to to the credit agency 's. Ocwen now wants to try to foreclose on my property, but will not except payment from me. Then a new modification Ocwen sent just over a month ago, was signed and sent back with payment. Ocwen accepted the funds only to return them ten days later and file a foreclosure. Furthermore Ocwen since the original modification was completed over a year ago has been holding {$45000.00} in my escrow account. Two months of ecsrow is all the that can be held in an escrow account by law. Ocwen is holding over ten times that. Ocwen needs to credit my account the escrow overage amount of over {$40000.00}. Ocwen is also holding a {$10000.00} insurance claim check they refuse to endorse and mail me for Hurricane damage to my roof. Finally Ocwen is also charging me {$2300.00} a year in flood insurance I do n't need because i am not in a flood zone. And refuses to credit back the insurance payment even though Ocwen has acknowledged the property is not in a flood zone. I have been dealing with Ocwen for a number of years and have found them to be XXXX of the most corrupt financial institutions in the nation. I have every intention on continuing to pay my mortgage, but how can i do that if Ocwen will not except my payment. I hope to resolve this problem and the many other discrepancies on my account as soon as possible.

I had been trying to do a short sale on my home because I can not afford to keep it and since the first loan is getting a complete pay off the representative from XXXX will NOT release my debt unless they too get paid in full. Ocwen has refused to talk to me and they keep on referring me back to XXXX. I have asked XXXX to show me proof of debt with them BUT they just keep on giving me the run around. Please help me move forward with the sale of a home that I can not keep and I do not want it to go into foreclosure. I have been waiting 79 days to close my loan. I have already paid for the appraisal. I need to close the loan to save about $ XXXX/month. This is not the first time I have been wronged by an affiliate of Ocwen. When they bought my existing first mortgage loan at 8 % interest, they put false information on my credit report which inhibited my ability to repair my credit after going through a Chapter XXXX bankruptcy. I had to complain to you to get it fixed so I could begin to re-establish good credit.

Consumer Complaint: I receive a Form XXXX last year from Ocwen because filed for modification of my mortgage loan. Ocwen modified my loan and canceled a portion of the debt I owed in the amount of {$19000.00}. I understand that according to the IRS, this means that Ocwen is writing that amount off as a cancellation of debt and I no longer have to pay it back the {$19000.00}. Therefore, I need to include the amount of debt from XXXX report on my tax return as income which I did. As a result, it caused me to have to pay in taxes to the IRS last year, which I never had to do before when I filled taxes. This year, I filed for another modification with Ocwen. while speaking to the agent he informed me that I was approved for the modification and went over the terms with me. Ocwen stated that with this new modification called trial plan period that my principal balance is {$79000.00}. I ask the agent why is my loan so high, that its almost back the amount of my loan before the first modification ( {$87000.00} ). The agent said that the add {$12000.00} of the {$19000.00} back to the loan. I told him that they could not do that because that amount was charged off and reported as income on my taxes. My second complaint is also that there 's a balloon payment that will be of {$61000.00} at the time this note matures on XXXX XXXX. In my first modification the balloon payment was due XXXX XXXX, XXXX for {$16000.00}. In my opinion this is not a true loan modification. I feel that I am be taken advantage of, please help me. I have enclosed the first modification paperwork, the trial period paperwork that a sent me they will mot give me the permanent modification until the XXXX payment of {$400.00} have been paid, and the XXXX form I used to file my taxes.

Ocwen charged me as much as the entire yearly taxes just for city school tax. *Trail is set for XX/XX/2017 as I have now file a counterclaim and have no attorney.

Consumer Complaint: I am still waiting for a response from Ocwen. Case # XXXX. My first letter was XX/XX/2016. Ocwen responded with nothing more than a copy of my modification. That was n't what I asked for. I sent a follow up letter XX/XX/2016 and have not heard anything. I want an accounting of the numbers used in my modification and if Ocwen is not hiding anything, why wo n't they provide it. I work for XXXX Mortgage and the numbers I am referring to are in the modification waterfall. I provided them in my original letter. Further, when you apply for and are approved for a modification, is the Lender supposed to provide the numbers prior to your acceptance?? They did not. What about the Reg. Z and Reg. X with regard to modifications. Also, I was told the modification was a fixed loan and turns out it is an adjustable. Does the lender not have to provide that information when they are doing a modification? Please respond and have Ocwen provide the calculations used in the modification. Thank you, XXXX

Consumer Complaint: In XXXX 2015 my wife left me leaving me with a whole lot of debt that I was unaware that I had. My mortgage company, Ocwen Loan Servicing , LLC, offered to lower my payment. The company had impounded my taxes and insurance and I received a letter of tax lien from the county collector stating that my taxes were not being paid. I received a letter from the county and called my mtg. co they told me to disregard the statement it must be a mistake. I have seen many discrepancies in just the statements that I am sent monthly. I am now in the process to hire an attorney to help with understanding what exactly has been going on. My escrow account has been in the negative although I have been on time every month since I started paying the mortgage myself. There is a " deferred '' balance that has been fluctuating throughout. In 2015, I received a form XXXX of a cancellation of debt for XXXX in which I filed with the IRS but I was never forgiven of that amount.
