Consumer Complaint: Predatory bank practices on our home ; ie, lack of modification two times, will not lower the 8.39 % interest. We were recommended to this agency from our state 's AG office. We believe the actual loan is with XXXX, yet serviced by OCWEN LOAN SERVICING with call centers in XXXX. Lack of negotiations from them. After 12 years and no missing payments from us. They will not be compassionate or care to understand w/o lowering the interest rate. Unfair practices to force retired, good people like us into foreclosure and lower standards of lifestyle from own home.

The XXXX and XXXX entered into an agreement dated XXXX XXXX XXXX, which were a Deed of Trust and a Note in the presence of XXXX. Per the Deed of Trust dated XXXX XXXX XXXX, this document was signed and notarized on XXXX XXXX XXXX. The notary was XXXX XXXX XXXX ; notary # XXXX expired on XXXX XXXX XXXX. Both these documents appear that the notary stamped the Note and Deed of Trust at the top right corner which states " we here by certify this is a copy '', it also has initials of the person that stamped the documents. First, did the notary from XXXX stamp these documents at the time the XXXX signed these documents? Second, if not, please provide the person name that did stamp these documents at the top right corner and initialed them! Third, please provide the date when these documents, Note and Deed of trust were stamped at the top right corner of each document which states, " We here by certify this is a copy ''! Forth, if not known, please contact XXXX and ask the questions that we are seeking. If this occurs, please ask for this response in writing and please provide us their response ( in writing )!

Consumer Complaint: In XX/XX/XXXX I was experiencing financial problem. I called my mortgage institution for monthly payment assistance. I was sent a package requesting to notate my hardship and list of monthly bills. I wrote a detailed letter and gave account of my monthly bills. I was then called and informed I was approved for the modification for my mortgage and a package will be emailed to me to sign. Only after I signed and agreed to the terms will I get the assistance I needed. Of all the paperwork I signed I was given what was called a SHARED APPRECIATION agreement which I am attaching as well. I was emailed the information and told to return it that day. I signed and returned the package and my payments were greatly reduced. Just recently I was attempting to refinance my mortgage which would lock me into a much lower monthly mortgage amount at a fix rate. I was approved however while finalizing the paperwork I was told my mortgage company is requesting over {$5500.00} to be added to the payoff amount. I was sent the XXXX. I called because I did n't understand what it was and I was told that because they helped me with my modification, that anytime I sell or refinance my home I agreed to share in the appreciation of my home. They stated they would receive {$5500.00} of the shared appreciation because in 2012 they appraised my home at XXXX and I financed XXXX at the time of the agreement. I was never sent anything that I can remember stating {$5500.00} was the shared appreciation amount. I feel this is predatory loaning for a person in need financial help. I was rushed to sign and fax back the information. If I understood I feel I had no other options as I could n't afford the mortgage I was paying. They knew I was in financial distress and I know they took advantage of my circumstances. My payments went from {$880.00} to {$590.00}. When I received the loan I was told to make payments on time for the next XXXX years and they would forgive approximately XXXX each year and I did so without incident. It appears to me that signing this agreement was there way of getting back what they stated was forgiven. I feel that these mortgage companies are taking advantage of people in hardships and later making even bigger profits. The extra money I could be getting from my refinance is money homeowner can later use for children 's college, home improvements or paying off debt but predators like OCWEN found a way to take that away.

Consumer Complaint: Ocwen loan servicing handles my loan, on XXXX XXXX and XXXX XXXX i made my payment online, after the XXXX of the month you 're forced to make a rush payment through their website call speedpay. I 've received a confirmation email that my payment was received on XXXX/XXXX/2016 at XXXX confirmation number XXXX and on XXXX XXXX I made XXXX payment at XXXX confirmation number XXXX. when reviewing my credit report it shows I was 30 days late twice and for XXXX it shows Im 30 days late when in reality the month is not even over. XXXX credit report and for XXXX my payments do n't even show. I try to reach out to Ocwen and they would n't able to explain me why they had reported me to the credit bureaus as being late. I really need your help in investigating this issue and it seems like Ocwen do n't care. All Im asking is for my rights as a consumer to be respected and not been abused. Obviously the information reported to the credit bureaus by Ocwen is false and is damaging my personal credit and preventing me on getting approved for a loan.

Consumer Complaint: My Mortgage company, OCWEN sent me a letter via XXXX mail on XX/XX/2016 ( Dated XX/XX/XXXX ) stating that my mortgage payment was returned for non-sufficient funds by my bank, XXXX. My account shows that no attempt was made by my mortgage company to get the payment that I had made electronically on the XX/XX/XXXX. I also spoke to a representative at my bank who confirmed that no attempt had been made to cash my payment. I have been paying my mortgage electronically for several months and keep a confirmation notice. There is a default feature at the OCWEN website, which allows me to pay from the same account -- which I did. In the letter from my mortgage company, I was instructed to make an immediate payment or I would suffer penalties in additional fees. So, in order to avoid those fees, I sent a rush payment via XXXX. But it still ended up costing me an additional {$45.00} above my regular mortgage payment. I feel that OCWEN was either careless or dishonest in this instance. I wanted a record of this complaint so that they will correct this situation, instead of allowing them to blame me for their incompetence.

Consumer Complaint: I was in the middle of a loan modification when Ocwen Loan Servicing sold my house. The stated that they notified me by mail but in reality the notice had been mailed to XXXX, California which is nowhere near XXXX, California. When I had been going through bankruptcy last year they had tried to sell it as well. I had been in contact with my relationship manager and even had an appointment for a few days after it was sold. I do believe my loan was robo-signed previously because none of the names that was on the paperwork were real people at any of the companies. The other day when I had called XXXX XXXX to get information about my loan I was told they did not carry the note. That I was nowhere in the system neither was the loan number. The next day I received a XXXX letter from XXXX XXXX stating they did carry the note. I also believe they may be somehow part of Ocwen as the gentleman, out of nowhere, stated they were not sister companies he had already asked that. The gentleman who bought my home said he understood my dilemma and would allow me until XX/XX/XXXX to find a place to live and move out. On XX/XX/2016 he served me with a 3-day notice and then on XX/XX/2016 he served me with an unlawful detainer. I have told him I am willing to move but due to the holidays and due to my lack of rental history it has been a problem. This gentleman told my XXXX year old tenant and her caregiver about the house and it has cause my tenant very bad health issues. He has been harassing and bullying me as he wants in the home to go through it and already wants to get a pool person over here to look at the pool. Accoring to the Homeowners Bill of Rights, this mortgage company needs to be put on notice that they have done a dual track foreclosure and that is against the law. I would also like to know that the bids were as the house was sold for much less than what was owed. Why were n't we guaranteed a single point of contact from Ocwen? Why was the Notice of Sale mailed to XXXX, California? I would like to readdress the violations of this company. There are tenants in the home and according to the Homeowner Bill of Rights, they have at least 90 days before starting eviction processes. Ocwen has copies of the rental agreements and past rental receipts as they were part of the modification paperwork.

Consumer Complaint: Our XXXX County Maryland XXXX Department said that they never received information from GMAC Mortgage that our mortgage was paid off in full so that the release of lien could be recorded. We have a letter from GMAC Mortgage dated XXXX XXXX, 2001 stating that the mortgage had been paid in full & that the necessary release documentation for the property was in the process of being completed and being sent to the county XXXX office. We have not been able to contact GMAC. Until the County XXXX XXXX office receives documentation, our property will continue to show a lien against it which will continue to create problems in acquiring credit or selling our property.

Ocwen has done nothing in two weeks, and are now demanding that the buyer remove the word " XXXX '' from line # XXXX of the Articles of Organization that were filed with Secretary of State - State of California on XXXX/XXXX/XXXX ( see attached XXXX docs ) - OR that we provide Corporate documents for XXXX - which is not possible, since they are not a purchaser in this short sale. We have already explained that XXXX is the Service of Process, and this can not be changed. Ocwen may not dictate who the business entity would like to use to receive service of process in case of suit. It is clear that XXXX is not a part of the buyer 's XXXX, as they are not listed in exhibit a of the Operating Agreement, nor anywhere else in the Operating Agreement. This is undue interference with a business entity.

Consumer Complaint: I have read much data recently pointing to the fact mortgage loans actually do not fund at closing and instead a bait and switch is done with the HUD1 and the paying off ( or not ) of prior liens. Therefore, when I was reviewing my closing documents, I was shocked to see " Total Estimated Funds Needed to Close '' on the RESPA listed as {$490000.00} vs. anything close to the loan amount of {$190000.00}. Might this be prima facie evidence of the chicanery happening?
