Over the years and mortgage was transferred over to Ocwen without our consent. In the past 2 1/2 years alone my husband and I have paid over {$30000.00} in mortgage payments. However our total balance went from a XXXX XXXX XXXX to XXXX XXXX $ after {$30000.00} in mortgage payments. We have been home almost 40 years and the mortgage lender stated that our home will still not be paid off for another 20 years.During this entire process my husband and I have made the mortgage payment every month principal balance and interest rate and the Total amount owed continues to grow and snowball out of control.

Consumer Complaint: OCWEN Loan Servicing LLC serviced my loan from XX/XX/XXXX until I sold the property to an individual ( not a bank ) in XX/XX/XXXX. Last week I applied for a new mortgage loan with both XXXX XXXX XXXX bank and XXXX XXXX XXXX and was declined by both due to a foreclosure reported on my first and second mortgages by OCWEN on XX/XX/XXXX. When the banks ran the application everything on my credit looked fine and I was pre-approved, but when the banks submitted the application into XXXX XXXX, that is where the incorrect foreclosure information was found. I made my mortgage payments when I was able and sometimes they were late, but my loans were NEVER foreclosed upon. I did receive some threatening letters from OCWEN at times when I made late payments, but I was never notified of a foreclosure process or served with any type of legal papers regarding a foreclosure. This information is completely false and I have requested that OCWEN have this false report removed immediately. I am still awaiting an answer from them if this will be done. Unfortunately since the false foreclosure is not showing on my credit report and only in the XXXX XXXX software, I am unable to dispute it with the credit bureaus. I have also accessed my entire payment history with OCWEN and compared to the information they reported to the credit bureaus and there are numerous payments that have been inaccurately reported. For your reference, I have attached a copy of my payment history with OCWEN, a copy of my credit reports with payments reported by OCWEN, as well as a spreadsheet with what I believe should be the correctly reflected for each month that I had a late payment. Consumer Complaint: I recently had a loan modification done with Ocwen and I mailed Ocwen money orders on two occasions one in XX/XX/XXXX and again in XX/XX/XXXX in the amount of {$3800.00} as of today they refuse to post the payments to my account. When I spoke to Ocwen on XXXX XXXX 2018 the relationship manager told me that the might not be able to accept my XX/XX/XXXX payment because she is not sure if they are going to accept the {$3800.00} I have to wait on the loan modification team. Ocwen is very unprofessional in dealing with home owners mortgage and most of the time the reps all give you different answers to questions ask and also concerning your loan with them. This is very stressful for me not knowing what is going to happen with my home,

Consumer Complaint: I moved in to my rental due to finical problem found out later it was Identify theft. I started a home modification in XXXX. it took 5 months for the go-ahead. They kept asking for the same paperwork I gave in the beginning. I made the 3 payments in a row. All the while I was getting foreclosure notices ocwen said disregard there not valid. I got a few and called in not valid do n't worry. So the payment where done. I received the paper work upon receiving I was rushed hurry get them back. Upon ready there was a balloon payment of {$27000.00}. the loan started at XXXX paid for 13 years XXXX and financed XXXX just to have a balloon of XXXX. They tried to sneak in. I called in and it was interest on interest. I denied and was goanna refi only to find out it was foreclosed on in XXXX so the lender would not touch. So now I 'm about to be kicked out. And the Kicker is there to blame for the Identify theft. They let some one assign themselves as account manager XXXX on my loans and they switched it around so I did not have access to my own account got. I Finally got the account back and had it done again in XX/XX/XXXX I was at a loss of how someone not on the loan could do that. I had to fight to get the account only to be months behind. I had to fight to get on like they where not my loans

Ocwen also retained Insurance proceeds which were due me for 4 years. They had just released the funds XX/XX/XXXX. Ocwen purchased XXXX XXXX back in XX/XX/XXXX. However XXXX XXXX XXXX initiated and completed foreclosure on XX/XX/XXXX. They also received a default judgement on XX/XX/XXXX. ( At his time I was in a XXXX XXXX XXXX and eventually XXXX XXXX XXXX XXXX XXXX ). Ocwen Loan Servicing has also been repoting incorrect information to the credit beaureaus since XX/XX/XXXX until present. A I have never understood how Ocwen Loan Servicing could purchase my previous lender XXXX XXXX XXXX XXXX and XXXX XXXX XXXX. was able to foreclose. This does not seem fraudlent to me. I am very interested in getting my home back to my ownership if at prayerfully possible. I have attached paperwork and cases

I was told over the phone, that I would have to wait 2 years before I could take market appreciation into account on the house, unless I was able to provide receipts and documents of the $ XXXX of improvements i made in the house XX/XX/XXXX-I received a document that stated I had to wait 2 years ( 2 years after the loan origination date ) before I could take market appreciation into account on the house, unless I was able to provide receipts and documents of the $ XXXX of improvements i made in the house. The document laid out the process, and made absolutely no mention of using a single vendor. XX/XX/XXXX- I received a document in the mail, stating my rights to cancel PMI, and the 3 stipulations that I had to meet verbatim The LTV ratio must be less than or equal to 80 percent as follows : For purchase transactions, original value is the lesser of the sales price or the appraised value from loan origination. For refinance transactions, original value is based on the appraised value from loan origination. The borrower must submit a written request to the address below. The loan must be current with no payments received 30 or more days late in the preceding 12 months or 60 or more days late in the preceding 24 months. The account must remain current throughout the cancellation process. Proof of a type satisfactory to the mortgage investor that the property has not declined in value since loan origination. ( Please note that any related fees will not be reimbursed by Ocwen Loan Servicing, LLC ). XX/XX/XXXX- Since my loan origination date was XX/XX/XXXX, I waited to the 2 year mark to get an appraisal done on the house. I got an appraisal done, and register mailed to Ocwen with the written letter to cancel PMI. XX/XX/XXXX- After no answer from ocwen or reply, I called customer service to ask what the status was. They said that a realtor estimate was not good enough, and that I would need to get an actual appraisal of the property. XX/XX/XXXX-After getting the appraisal, and mailing it to Ocwen registered mail, they said that the appraisal was not done through their single vendor, and the {$460.00} spent on getting the appraisal would be worthless. XX/XX/XXXX- After begging and pleading with Ocwen about the appraisal being from a NH State licensed appraisal, Ocwen still denied the appraisal to be used to cancel PMI. After being denied from using a state licensed NH appraiser, I asked which vendor we could use. Customer Service representatives, said " any vendor '', and then when I brought to an escalation manager none of them could name the actual vendor theyre required to use! Even in both denial letters, they do not state the actual reason that they are denying PMI cancellation. This is even after I met all the stipulations to cancel PMI, since it was not done through their single vendor it would not be allowed. This requirement was not mentioned in the contract signed at closing as well as the documents sent to me numerous times after making the inquiry of canceling PMI. This is even after Ocwen was forced to pay XXXX in very similar class action lawsuit, and barred from doing business in both Maine, and Massachusetts. Even after potential litigation. Ocwen refuses to honor my appraisal, for absolutely no reason.

Consumer Complaint: I am facing a foreclosure sale date by my mortgage servicer Ocwen on XX/XX/XXXX. I have been battling them for several years as I try to resolve issues relating to predatory lending, mortgage fraud, misrepresentations and lies. Ocwens law firm outright lied to me about my standing with them and failed to disclose that they had moved forward with a court action while telling me they did not and that I was in review for a modification. I have tried all angles, including submitting packages repeatedly to their loss mitigation department as well as battling them in court, where I have found sympathetic judges who agreed that Ocwen and investor XXXX XXXX could not prove that they had standing to foreclose. However, the last court date the judge ruled that Ocwen could move forward with a foreclosure sale date. I work as a facility manager and my wife manages a supermarket and together we earn a solid living. We have the means to make a reasonable monthly mortgage payment if Ocwen would put a reasonable offer on the table. We were solicited by phone by XXXX in XX/XX/XXXX and convinced it was in our best interests to refinance with them. We have a special needs daughter and at that time she required a great deal of care and I stopped working so that I could care for her. We were surprised that our loan was approved since I was not working and the monthly payment of {$1800.00} seemed a bit high considering my wifes income was about {$4000.00} at the time. We did not understand the high interest rate and the type of loan we were getting ourselves into and were shocked after the fact when we found that our lender charged us close to $ 30K in points and junk fees. In XX/XX/XXXX the recession hit our family and we began missing mortgage payments. We tried to modify our loan but in the middle of the process the servicing was transferred and then sued by XXXX XXXX for foreclosure. I found it interesting that the suit was filed by XXXX XXXX yet the note had not been assigned to them yet, the actual transfer of the security occurred three months after the court paperwork was filed. There are multiple paperwork irregularities that I have found that I feel demonstrate a pattern of fraud and malfeasance on the part of the lender, the figures in some places dont match, we were not provided with a Truth in Lending disclosure etc. which led to the court dismissing the case. I continued trying to modify but got the runaround and in XX/XX/XXXX went back to court. The judge ruled that the lender had not proven that they possessed the necessary paperwork that would give them the right to foreclose. Multiple documents were requested to prove standing and continuity of obligation by the judge but they could not provide them. The loan went to Ocwen and I have been trying to get a modification but am routinely transferred to agents in a foreign country who speak little to no English. In XX/XX/XXXX I received a notice that Ocwen was filing with the court for foreclosure. We had finally been able to get some traction and a modification package was supposedly in process at Ocwen. We spoke with the Attorneys for Ocwen from XXXX XXXX on XX/XX/XXXX ( relating to upcoming hearing ) and were told that due to the fact we had a modification package in review that there would be no foreclosure activities going forward, that the foreclosure was on hold and that we did not need to worry about the court date.. We later found out that Ocwen and Attorneys had gone to court on XX/XX/XXXX and obtained a judgement of foreclosure against us. Why would their Attorneys speak with us and lie and tell us not to worry and why did they not disclose that they had already obtained a judgment of foreclosure against us? This makes no sense and these are the same types of unethical and unscrupulous activity that Ocwen has engaged in in the past.

Consumer Complaint: I am writing to file a formal complaint with Ocwen regarding incorrect and misleading information I was given by Ocwens employee XXXX ( rep ID XXXX ) regarding Ocwens Federally Declared Disaster ( FDD ) area assistance program. I am requesting that Ocwen fully research the call I had with XXXX ( rep ID XXXX ) who said she was working from XXXX, Iowa, on XXXX XXXX, 2017 around XXXX XXXX EST. XXXX is the agent who suggested the disaster area assistance program to me. XXXX said there would be no costs for participating in the disaster area assistance program and that there would be no adverse credit reporting would occur during the FDD program period. She never mentioned that the FDD program was a forbearance program and that it would be reported to the credit reporting bureaus as such. So, either XXXX was misinformed, gave me misleading information, or Ocwen acted inappropriately by reporting late payments during the FDD program period. In either case, I acted upon the information provided by XXXX and hence, Ocwen. I have suffered damages as a result. My credit rating has been hurt by falling over 12 points since the FDD program began. I have even been denied credit as a result of a negative credit experience reported by another creditor which can only be attributed to Ocwen.
