Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: There are XXXX Chapter XXXX Bankruptcies on my credit report with XXXX and XXXX. XXXX was filed in XX/XX/XXXX. I got a letter from the Bankruptcy XXXX in XX/XX/XXXX, and I told them that this was not mine. They dismissed it. In XXXX of XXXX, another case was apparently filed. I never knew about it because I had moved out of XXXX. That case was dismissed in XX/XX/XXXX. No paperwork was ever filed, and no debts were ever provided to the court, there are no creditors. I never had any debts or issues where I would need to file bankruptcy. I was the victim of major identity theft in XXXX and I have removed all of the fraudulent items on my credit reports with your help. XXXX items to be exact. XXXX has a fraud alert and they are aware of the other fraudulent charges that were removed, as does XXXX. When I ask them to block these XXXX items according to XXXX XXXX ( XXXXXXXX XXXX section XXXX ) they refuse. They say they validated and verified the items with LexisNexis. When I ask them to verify the Public Record in multiple letters and request documents to verify these items and the names and phone numbers of who they spoke with at the court, the actual finisher of the data, they respond with LexisNexis. I contacted LexisNexis and asked them for the same details, they responded with it is listed on XXXX. I responded with, I do not care where it is listed, I want documentation. No response. I contacted the Bankruptcy Court and they sent me a letter confirming that they do not supply information to the credit reporting agencies. They also state that they can not confirm the existence of these items. They have no jurisdiction over credit reporting agencies, the XXXX XXXX XXXX section XXXX does. They suggest I contact the XXXX XXXX XXXX XXXX XXXX. I did. I filed another identity theft report and sent that to the XXXX XXXX. No response. I have disputed these items at least XXXX times with each XXXX including LexisNexis. I was under the impression that to verify an item as legitimate on a credit report, the XXXX has to, after they waste everyone 's time with XXXX actually contact the furnisher? Am I wrong? If they do not, must they remove the item? They claim a wage earner plan filed, I would love to see it, it can not exist. In the meantime, I have been denied credit, charged outrageous fees, and interest all due to these fraudulent items, both due to fall off in less than a year. I am the CEO of a company that is funding a new factory in XXXX XXXX for {$120.00} XXXX. I am also a XXXX XXXX owner of that company. I can't tell you just I have had to explain this to the investors and how annoying this has been. If there is no way to resolve it, what a great way to attack your rivals in business, just file bankruptcy in their names, in a different state, and the names of the collection agency owners and the CEO of the XXXX XXXX. I assume that would be illegal, yes? I am unable to figure out what to do next. Short of having my law firm sue everyone. Please advise me on how to resolve this never-ending nightmare. Thank you, XXXX XXXX.

Issue: Incorrect information on your report
Subissue: Information belongs to someone else
Consumer Complaint: It has come to my attention that Lexis Nexis credit file/credit report with my information on it. I requested to have this information sent to me, but I was then asked to provide either my social security number or my drivers license. This a violating of my federally protected consumer rights. I never gave permission to furnish a consumer report with my information to anyone. They never asked for permission from me. They sent me a request form but because I never authorized them to furnish a consumer report on them, they should be the one filling out the request form. Lexis Nexis has personal and private nonpublic information about me and I feel completely violated. How and why do I have to prove to someone else that I am who I say I am, but any 'person ', as described in 15 USC 1681a, that gets my social security number, credit card as described 15 USC 1681a ( r ) ( 2 ), and goes to a credit reporting agency can place anything on my consumer report without the permission, this is a direct violation of 15 USC 1681b ( a ) ( 2 ). In the attached paperwork there is a section to 'opt out ' but the problem is i never opted in! This has completely stressed me out and this has taken a toll on my mental health. They have violated my privacy and I do not feel comfortable knowing my personal nonpublic information is just out there. Why are these companies able to get personal nonpublic information on consumers if it is a violation of their federally protected consumer rights.

Consumer Complaint: I contacted XXXX on XX/XX/XXXX because I have been violated of my rights by an incorrect account reporting on my credit file. XXXX said that the account that is reporting inaccurately was verified from the courthouse. I called the courthouse and they said they do not have any records on file and that they do NOT share anyones personal information to the credit reporting agencies nor do they intervene with the dispute investigation. They also sent me out a letter as verifiable proof. I called back to XXXX on XX/XX/22 to tell them that they are not doing a proper investigation of this account and they said that they are certainly verifying this from the XXXX Court house. I was transferred over to the supervisor who then confirmed that it was verified through LexisNexis. I told them that LexisNexis does not have it on their credit file and I showed verifiable proof from the dispute that I sent out in XXXX that was not properly investigated. The supervisor then said that the letter I sent in from LexisNexis was not something they can except because it came from a third party and that LexisNexis has to send an electronic file in order for them to accept it. I called LexisNexis and they said that they were sending out a dispute to XXXX with my new credit file. They also said that XXXX did not contact them about a dispute or an any account on my credit file. I am so upset with the progress I have received disputing this inaccurate account on my report. XXXX will not give me the right answer as to who they are verifying their information from. They are violating my consumer rights and laws by not telling the truth/false information or showing me physical proof of the verification. This is unfair practice and has become detrimental to my livelihood.

Consumer Complaint: I have repeatedly contacted XXXX about an inaccurate account that's reporting on my credit file. After several attempts of trying to find out who they verified this information from, they finally told me they verified the bankruptcy that's reporting on my account with Lexis Nexis. I called Lexis Nexis to see if XXXX had reached out to them about a dispute and they said that XXXX did not reach out to them at all to inquire about my credit file. They also confirmed that I do not have a bankruptcy reporting on both of my credit files with them. Lexis Nexis said they would send out my new credit file to XXXX so that they can update my credit file and remove the bankruptcy. They also said that XXXX shares a database system with them so XXXX can update their files, but often times they do not. I called XXXX on XX/XX/2022 to explain this to them and they said that LexisNexis has to send them an electronic file so they can update my credit file. LexisNexis told me that they sent out my dispute and new credit file in XX/XX/2022 to XXXX and XXXX has received it, but has yet to respond to it. This is completely detrimental to my livelihood. I have an account thats reporting inaccurately on my credit report and I have proof thats its inaccurate and XXXX will not remove it. This is unfair and a violation of my consumer rights according to the FCRA. I have shown verifiable proof that this account is inaccurate and XXXX is ignoring the proof and they are not doing a proper investigation.
