Consumer Complaint: I requested a copy online of my LexisNexis file. I placed a security freeze on my file. I received my LexisNexis file with login on XX/XX/2022. My consumer file is 134pages. I called the number provided at XXXX. I found gross errors in reporting violations by LexisNexis to the credit bureaus. I asked them to correct these errors and they refuse to do so. This is absolutely unacceptable. This is an action for damages brought by an individual consumer ( myself : XXXX XXXX ) against the LexisNexis for violations of the Fair Credit Reporting Act ( hereafter the FCRA ), 15 U.S.C. 1681 et seq., as amended. II. Jurisdiction and Venue Jurisdiction of this Court arises under 15 U.S.C. 1681p and 28 U.S.C. 1331. Venue lies properly in this district pursuant to 28 U.S.C. 1391 ( b ). Here are my factual allegations against LexisNexis : 1. I have verified that my data was exposed in the XXXX breach and in fact that same breach is legally tied to LexisNexis. 2. LexisNexis Risk Solutions FL , Inc. ( Lexis ) is a business entity that provides background screening services, decisions-making intelligence, and operates as a consumer reporting agency and furnisher of credit information to the larger credit bureaus. 3. LexisNexis have been reporting derogatory and inaccurate statements and information relating to my credit history to third parties ( hereafter the inaccurate information ). 4. The inaccurate information reporting on my credit reports is not directly derived from government records or court dockets. The original supplier of this inaccurate information to XXXX XXXX, XXXX and XXXX was Lexis, or Lexis corporate predecessor. LexisNexis or its corporate predecessor obtains select information from court and government records, not the complete or actual public records, and then molds and fabricates that select information into the format which it sells to XXXX XXXX, XXXX, XXXX and other third parties to be placed upon consumer credit reports. 5. I have multiple gross inaccuracies. However, the most disturbing and most detrimental to me is the reporting of the XXXX XXXX bankruptcy. 6. I have contacted PACER to see if they are the furnisher of my bankruptcy information to the credit bureaus. They have verified that they are not. 7. Next, via certified USPS mail w/ delivery conf. I sent a letter to the United States Bankruptcy XXXX XXXX XXXX Arizona. In this letter, I asked the Clerk of the Court to provide me with the disclosure and rules, procedures concerning bankruptcy information of debtors to XXXX XXXX XXXX XXXX XXXX ( XXXX, XXXX, XXXX, LexisNexis, XXXX, XXXX, etc. ) 8. I included a self-addressed, stamped envelope for my return evidence request. 9. What the United States Bankruptcy XXXX XXXX XXXX XXXX sent me back in the self-addressed, stamped envelope was a letter in big red, bold letters stating the exact following : PLEASE NOTE : THE BANKRUPCTY COURTS DO NOT PROVIDE INFORMATION TO THE CREDIT REPORTING AGENCIES. DEBTORS MUST DIRECTLY CONTACT CREDIT REPORTING AGENCIES TO DISCUSS INFORMATION ON A CREDIT REPORT. UNDER THE FAIR CREDIT REPORTING ACT, THE CREDIT REPORTING AGENCY ( AND THE CREDITOR ) ARE REQUIRED TO CORRECT INNACURATE OR INCOMPLETE INFORMATION ON A CREDIT REPORT. THE CREDIT BUREAU WILL VERIFIY THE ITEM IN QUESTION WITH THE CREDITOR AT NO COST TO THE CONSUMER. NO ONE CAN LEGALLY REMOVE ACCURATE INFORMATION FROM A CREDIT REPORT. YOU CAN ASK FOR AN INVESTIGATION AT NO COST TO YOU OF INFORMATION IN YOUR FILE THAT YOU DISPUTE AS INACURATE OR INCOMPLETE. UNDER THE FAIR CREDIT REPORTING ACT, BOTH THE CREDIT REPORTING COMPANY AND THE INFORMATION PROVIDER ( THAT IS, THE PERSON, COMPANY, OR ORGANIZATION THAT PROVIDES INFORMATION ABOUT YOU TO A CREDIT REPORTING COMPANY ) ARE RESPONSIBLE FOR CORRECTING INACCURATE OR INCOMPLETE INFORMATION IN YOUR REPORT. THE CREDIT BUREAU WILL VERIFY THE ITEM IN QUESTION WITH THE CREDITOR. THE CREDIT REPORTING INDUSTRY HAS A POLICY THAT REQUIRES A CREDITORY TO RESPOND TO AN INVESTIGATION WITHIN 30 DAYS. AFTER THE INVESTIGATION IS COMPLETE, THE CREDIT REPORTING AGENCY WILL NOTIFY THE CONSUMER OF THE OUTCOME. IF THE INFORMATION IN THE REPOST HAS BEEN CHANGED OR DELETED, THE CONSUMER WILL RECEIVE A COPY OF THE REVISED REPORT. LexisNexis has not followed the law under 15 U.S.C. 1681!!! Please help me to hold them accountable.
