Consumer Complaint: I have contacted Lexus Nexus, XXXX, XXXX, XXXX. about false information reported by Lexus Nexus. I contacted them all XX/XX/23 by phone and certified mail for them to remove this false information. I received a response from XXXX that the information was certified and correct. I asked for proof of this which has not been provided. I know the XXXX Court does not provide information to the reporting agencies or any 3rd party data mining companies to certify. This statement by XXXX is false. This is false information and should be removed ASAP as there was no XXXX XXXX XXXX that I was involved in. This is putting my business in a bad financial situation and companies like this should not be able to provide false information. XXXX for helping in getting this resolved.

I am requesting a full account of how the information was reverified. Who conducted the re-investigation at Lexis Nexis and who is the representative your company spoke with at the XXXX XXXX XXXX XXXX along with a copy of all written and digital documents ( i.e., electronic mail and scans )? Under the Freedom of Information Act and Fair Credit Reporting Act, I am entitled to this information if I believe there may be a compliance reporting issue with my Consumer Report. Based upon your letter dated XXXX XXXX XXXX you stated in the second paragraph, Lexis Nexis stated the following, LexisNexis initiated a dispute of the said record on her behalf. Please advise which organization, courthouse, and Consumer Reporting Agency was the dispute filed with. The documentation listed on Information for XXXX, XXXX, and XXXX Consumers reads, Lexis Nexis Risk Data Management Inc. ( Lexis Nexis ) is a provider of bankruptcy information to XXXX, XXXX, and XXXX. The documentation further states to contact your company with questions about the information. Thus, I am contacting your company directly. In the same letter and paragraph dated XXXX XXXX XXXXXXXX your company wrote, This investigation was resolved as of XX/XX/. During our investigation, LexisNexis determined bankruptcy record case XXXX was accurately reporting and associated with XXXX XXXX identity. Please be advised, LexisNexis was unable to provide XXXX XXXX with the investigation results because we were unable to fully authenticate XXXX XXXX identity. On XXXX LexisNexis mailed a need additional information letter directly to XXXX XXXX for her review. Please advise how the information reported is accurate if you can not identify me. In the third paragraph of the letter dated XXXX LexisNexis verified that bankruptcy case number XXXX is still accurately associated with and reflects an accurate case status in XXXX XXXX consumer reports prepared by LexisNexis. Since your company has admitted in this statement that you are the furnisher of information, please comply with my request regarding the complaints listed above and received from the Consumer Financial Protection Bureau. Please explain what this means in detail as the information is reading conflicting and confusing : In this same paragraph, your company wrote, The address originally filed on the full bankruptcy docket XXXX XXXX XXXX XXXX XXXX, NJ XXXX, obtained from Public Access to Court Electronic Records ( PACER ), is an address that has been reported to LexisNexis with XXXX XXXX full social security number by the nationwide consumer reporting agencies. The address along with the last four digits of the social security number listed on the full bankruptcy docket also matches the previous address and last four digits of the full social security number we have on file for XXXX XXXX. Please speak to the following questions : 1. How does the software report information to Lexis Nexis? Does this mean that Lexis Nexis has a contract with the Federal Bankruptcy Courts to receive information via automation? 2. Please share a copy of the full docket and audit performed by your company that substantiated the accuracy of the information your company is reporting. 3. Please explain how Lexis Nexis determined my social security number is accurate when : a. Lexis Nexis has stated that your company is the furnisher of the information, and your company conducts all the investigations on behalf of the NCRAs? Please explain how these entities play a part in your companys verification process if they did not provide the information. b. How did your company determine the accuracy of my social security in the full docket with the last four digits? Does verification require the entire number to be verified? Based upon your companys verification process my entire social security can not be verified because XXXX only provides the last four digits of the social security number. This also goes back to the Federal Courts stating in their documentation the Federal Courts do not share bankruptcy information with your company or any other Consumer Reporting Agency. It may be difficult to confirm the validity of my social security number with a person in the Federal Courthouse to confirm accuracy. 4. In your companys letter dated XXXX XXXX XXXX it states your company is unable to verify my identity. However, in XX/XX/ I spoke with XXXX ( Consumer ID # XXXX ) who identified me and he went on to explain that your company does not verify any information in the XXXX XXXX When your company has a moment can you speak to this in detail? Consumer Complaint: On XX/XX/XXXX, I got a notice from XXXX, XXXX, and XXXX that LexisNexis reported and verified bankruptcy on my consumer report. LEXISNEXIS you are in violation of the law. You are reporting a Bankruptcy on my Consumer Report that you claim to have verified and is Metro2 Compliant. Bankruptcy is considered public records because it can be accessed for a fee through a system called PACER. The thing about public records is that nobody reports them to Consumer Reporting Agencies. I have a written and Signed Letter from the court stating they do not furnish information to the Consumer Reporting Agencies. PACER is an electronic system the courts use to store information, but its not reported to the Consumer Reporting Agencies. So that leaves me, the Consumer, to believe you violated my right to privacy and, without written consent, furnished information about me which is a direct violation of the law. 15 USC 1681 ( a ) ( 4 ) ( 4 ) There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and respect for the consumers right to privacy. PRIVACY ACT OF 1974 The Privacy Act requires that agencies give the public notice of their systems of records by publication in the Federal Register. The Privacy Act prohibits the disclosure of a record about an individual from a system of records absent the written consent of the individual unless the disclosure is pursuant to one of twelve statutory exceptions. The Act also provides individuals with a means by which to seek access to and amendment of their records and sets forth various agency record-keeping requirements. PROHIBITS : formally forbid ( something ) by law, rule, or other authority. 15 USC 1681b - Permissible purposes of consumer report ( a ) IN GENERALSubject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 1 ) In response to the order of a court having jurisdiction to issue such an order, a subpoena issued in connection with proceedings before a Federal grand jury, or a subpoena issued in accordance with section 5318 of title 31 or section 3486 of title 18. ( 2 ) In accordance with the written instructions of the consumer to whom it relates. LEXISNEXIS, you have completely and utterly broken the law and violated my personal right to privacy by furnishing information that is inaccurate and found to be untrue. This clear catastrophe has severely damaged my character, family, and ability to obtain personal and household credit. LEXISNEXIS I demand that you remove this bankruptcy from my consumer report immediately, as you have no right to furnish such information. I also demand that you send disputes on my behalf to XXXX, XXXX, and XXXX, to which you sold this information too for profit. Consumer Complaint: I was insured with XXXX for automobile insurance for 3 or so years and they all od a sudden decided to raise policy premium rates on me so I got a quote with XXXX XXXX XXXX who was much lower than theirs so I cancelled with XXXX insurance through XXXX courtesy cancellation option they have. I got the letter from XXXX saying my policy is cancelled and that I owed them XXXX dollars ( or else ) from them in a letter. I tried paying them through the XXXX application on my phone which had my card information stored on it but XXXX had blocked that function on their own application. 5 months in on a 6 month policy XXXX decides theyre going to raise rates on my asking for a nerly XXXX dollar increase on my policy for one month. I began to shop for cheaper insurance ( bare in my mind I had no tickets or accidents recently and still have no tickets ). I contacted XXXX XXXX and went through the whole process with an agent and then he said I will be sending you over to someone else who will be finalizing your policy. When I was turned over to her she said " you are no longer eligible for insurance with us XXXX reports you have multiple accidents and you have XXXX points on your DMV report through Florida ) then quickly hangs up on me. Since then I have had a very difficult time getting coverage with other auto insurance companies. I have received the reasons through mail that XXXX is inaccurately reporting to other companies and it is very inaccurate and exaggerated. Florida DMV information is protected information and can only be released if the owner of that information releases it. What XXXX is doing is illegal and very spiteful. They need a full investigation into their business practices and I need to have these XXXX fabricated inaccuracies removed from the consumer report and they need to be prosecuted for violating private information laws protected by the state of Florida
