Consumer Complaint: this is a formal complaint in regards to a charged off/ Writing off accounts from : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX inaccurately reporting on my credit report, I have filed disputes with XXXX, XXXX and Equifax and they failed to resolve the matter, ACCORDING to15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to t he purposes listed under section 1681b of this title. Consumer Complaint: I am filing a complaint because there are some negative items in my credit profile, but I have not confirmed or accepted that these are accurate. I dispute these claims and demand that any negative information be removed from the reports immediately. The claims that this information in my report is negative, untrue, incorrect, incomplete, untimely, and not verifiable are unsubstantiated. I have yet to be provided physical verifiable proof that the claims of negativity within my report are true. After reviewing my report, there are several deviations from mandatory reporting standards therefore the data in my report can not be accurate and complete! AGAIN, FACT IS that to this date, no entity ( neither the accusers nor you ) has elected to properly and lawfully in truth, accuracy, completeness, timeliness, and otherwise in full reporting compliance ( particularly in metro 2 compliance ) to provide to me, the consumer alleged, even a single or ONE tangible shred of evidence from any much less any of these data furnisher ( s ) of your absolute maximum compliant reporting ( s ). I have indeed made known my concerns of the data providers and you continued potentially unlawful chicanery-based subterfuge in my credit reports as related to these allegations hereby above detailed .I have never received any substantiating verification of irrefutable full truth, accuracy, completeness, timeliness, ownership, responsibility, and compliance to any and all federal obligations and even the metro 2 compliance requirements from anyone even if and when I forwarded written request of information to VALIDATE the account information that your firm reported as miraculously verified, yet without any such proof of this alleged affirmation of facts. I feel it is best to release your reporting this disputed information at once I will have no choice but commence the unpleasantness of a Sections 1024.35 ( Notice of Error ) under Regulation X ( CFPB regulation ) that confirms my private right of action directly against your firm for FAILING to respond and CONTINUING to report disputed information after direct notice of said dispute was provided. You have 5 days to comply and provide a written notice of the suspension of this item pending the resolution of the investigation action or face litigation. Here now and forever annul all account records of derogatory, adversary, or else wise deficient of proof of full of reporting compliance ( be it FCBA, FCRA, FDCPA, Metro 2 Compliance, or else whether mentioned or not ) claims or aspects of claims associated. Did you even conduct an investigation because it is still not reporting 100 % correctly? 1. Account involved in litigation " an incorrect high balance '' an inaccurate date of last activity " REAGED ACCOUNTS '' " Reinsertion WITHOUT PROPER NOTICE '' an undated late pay a charge off listed as open a collection account with a limit. XXXX Account Number : XXXX This is not mine. I am a victim of ID Theft and I have included a police report. Please investigate and remove from my credit report. Its sad that your company would ignore the FTC guidelines in regard to your investigation efforts. I wonder if other consumers are being affected by your lack of investigation. I would like to know to whom you talked with at the collectors office when you started your investigation? Also, please send me their complete address.
