Consumer Complaint: I XXXX XXXX XXXX, agent, and beneficiary of XXXX XXXX XXXX, declare under penalty of perjury ( under the laws of the United States, if executed outside of the United States ) that the foregoing is true and correct to the best of my knowledge. Further, I certify that I am permitted by FEDERAL and STATE LAW to file this dispute. I also understand that knowing and willful misstatements or omissions of material facts constitutes a FEDERAL CRIMINAL VIOLATION punishable under 18 U.S.C. 1001. Additionally, misstatements are punishable as perjury under 18 U.S.C. 1621. I am alleging that a person or a company without my authorization rather it be written, or verbal consent used my personal identifying information such as my " social security number '', name, address, etc., to buy, sell, report, or furnish my information. Charge offs and collections are certificates of indebtedness which become income once charged off and CAN NOT be reported to a consumer report. Since successful at least one of the above-mentioned misuses of my information, this debt collector and credit reporting agency is in direct violation for furnishing this unknown account on my credit report and identity theft pursuant 15 U.S.C. 1681 & 15 U.S.C. 6801. These inaccuracies have caused me much suffrage and defamation of my character. ( g ) Creditor means any person who offers or extends credit creating a debt or to whom a debt is owed. The term creditor does not, however, include any person to the extent that such person receives an assignment or transfer of a debt in default solely to facilitate collection of the debt for another. I extended my credit, being my social security number to these companies which makes me the original creditor and grantor. Prove the contrary or delete inaccuracies from my report! Consumer Complaint: I am writing to bring to your attention the apparent violation of 15 USC 1681c-2 regarding the blocking of fraudulent information on my consumer report. On XX/XX/2023, I submitted a package to Equifax containing my proof of identity, a letter explicitly stating my non-consent and non-benefit from the fraudulent activity, and a comprehensive identity theft report from the Federal Trade Commission. According to 15 USC 1681c-2, Equifax is obligated to block fraudulent information from my consumer report within four business days of receiving the aforementioned package. However, I recently received a letter from Equifax stating that the fraudulent information will not be blocked without re-submitting the documentation already provided. This discrepancy is a direct violation of the aforementioned statute, and I am hereby notifying you of my intent to pursue arbitration to resolve this matter. I urge Equifax to rectify this situation promptly, in compliance with the law, and to cease any further actions that contradict the legal requirements outlined in 15 USC 1681c-2. The previous mentioned violation ( of 15 USC 1681c-2 ) constitutes a separate but continuing violation 15 U.S. Code 2068, each day of the violation constitutes a separate offense ( {$1000.00} each according to 15 U.S. Code 1681n ), the maximum civil penalty shall not exceed {>= $1,000,000}.
