Consumer Complaint: Re XXXX XXXX XXXX XXXX XXXXXXXX Opened - XX/XX/2017 I was a cosigner for my father on the above-referenced account he used the vehicle, and he made all the payments on it, and we returned it. For some reason, the odometer and damage disclosure statement was never filed. This was a mistake by the dealer. After working on this for a while I finally got hold of this statement and its attached to this letter. When I spoke to the bank they explained to me that the dealer called them and told them that they got the vehicle from me and they should come pick it up but when they came to pick it up, they found it in a body shop. so they did not want to pay the money that the body shop asked for the vehicle, so they never picked it up The dealer is a representative of the bank since I returned it to the dealer and the bank confirmed that the dealer received it for me without any damages it is not my responsibility to get it from the dealer to the bank. This account should be deleted from my name immediately This account with XXXX XXXX many times but they completely ignored me. Every time I called, they explained to me that they could see that I gave it back to the dealer but they never picked up the vehicle from the dealer I also disputed this item with the credit bureaus but I've got no reply from XXXX XXXX Please see the documentation attached. This is extremely unlawful, that I have to go through such hard work and pain because I was denied several mortgages because of something I had no idea about. the dealer never notified me that it was not picked up, and XXXX XXXX never notified me that they never got it from the dealer they just put it on a collection of my reports

The nature of the violation ( s ) pertains to the unauthorized disclosure of my nonpublic personal information to non-affiliated third parties without proper notice or consent, a clear breach of privacy regulations outlined in the aforementioned laws. Congressional Findings and Consumer Reporting Agency Compliance : 15 U.S. Code 1681 underscores the paramount importance of fair and accurate credit reporting. The efficiency of the banking system is intrinsically tied to accurate credit reporting, while unfair methods erode public confidence essential for its operation. Consumer reporting agencies hold a pivotal responsibility in evaluating consumer information. They are mandated by law to handle this responsibility with utmost fairness, impartiality, and an unwavering commitment to consumer privacy. Additionally, under 15 U.S. Code 1681e, consumer reporting agencies are legally obligated to implement reasonable procedures that ensure the highest attainable accuracy of consumer reports. XXXX XXXX 's disclosure of inaccurate information not only violates my privacy but exacerbates these obligations, further intensifying their noncompliance with statutory provisions. Details of Violations : 1. **Disclosure of Nonpublic Personal Information : ** XXXX XXXX, without obtaining requisite consent or providing proper notice, disclosed my personal information to non-affiliated third parties namely XXXX XXXX XXXX and Equifax XXXX This action directly violates the Privacy Act of 1974 ( 5 U.S. Code 552a ) and the FCRA ( 15 U.S. Code 6802 ). 2. **Failure to Provide Opt-Out Opportunity : ** XXXX XXXX neglected to offer me the opportunity to opt out of the disclosure of my nonpublic personal information, as mandated by the FCRA 15 U.S. Code 6802 ( b ). The continuous disclosure without providing the option to opt out further exacerbates the violation. 3. **Continued Right to Opt Out : ** As per 16 CFR 313.7 ( f ), I reserve the right to opt out at any time, a privilege denied to me by XXXX XXXXXXXX actions. 4. **Exclusion of XXXX and XXXX Information : ** According to 15 U.S. Code 1681a ( 2 ) ( A ) ( i ), the term " consumer report '' excludes reports containing information solely related to transactions or experiences ( payment history and utilization ) between the consumer and the reporting entity. Remedial Actions Demanded : 1. **Immediate Deletion of Reports : ** I demand the immediate deletion of any reports or disclosures made by XXXX XXXX that contain my personal information, specifically transaction history. 2. **Compensation for Damages : ** Pursuant to 15 U.S. Code 1681n, I demand compensation of {$1000.00} per violation for the damages incurred due to XXXX XXXX XXXX willful noncompliance. Consumer Complaint: On XX/XX/2023, via certified mail ( XXXX XXXX Number XXXX ) Equifax received a package from me which contained : proof of my identity, the specific information that is the result of identity theft, and a copy of my complete and submitted Identity Theft Report with the Federal Trade Commission. As the consumer reporting agency, Equifax has failed to provide any documentation that would allow them to reasonably determines a condition to rescind blocking Account # XXXX - XXXX XXXX under Section 605B of the Fair Credit Reporting Act. Equifax has failed to block this account, and also failed to provide documentation to justify recinding said block, which is a clear violation of 15 U.S. Code 2068. The previous mentioned violation ( of Section 605B of the Fair Credit Reporting Act ) constitutes a separate but continuing violation 15 U.S. Code 2068, each day of the violation constitutes a separate offense ( {$1000.00} each according to 15 U.S. Code 1681n ), the maximum civil penalty shall not exceed {>= $1,000,000}.

Consumer Complaint: I am writing to file a formal complaint against XXXX regarding the illegal reporting of a charge-off, which is considered a certificate of indebtedness and therefore income under IRS Publication 4681. This erroneous reporting violates federal regulations, including the Fair Credit Reporting Act ( FCRA ) and the Privacy Act of 1974, causing significant financial and emotional distress. The charge-off, considered as income per IRS Publication 4681, should not be included in consumer reports, as explicitly mandated by federal regulations. However, XXXX has inaccurately reported this income, breaching the FCRA and IRS guidelines. This misleading reporting not only misrepresents my financial standing but also infringes upon federal regulations designed to ensure accurate and fair reporting to consumers. Despite my attempts to rectify this issue directly with XXXX by disputing the inaccurate information on my consumer report, the erroneous reporting persists. Consumer Complaint: As per the Fair Credit Reporting Act, specifically 15 USC 1681 section 602 ( a ), there is a stipulation emphasizing the responsibility of consumer reporting agencies to handle their duties with fairness, impartiality, and respect for the consumer 's privacy. I, as the consumer, assert my right to ensure the non-disclosure of my private information, supported by 15 USC 6801, which establishes the obligation of financial institutions to respect customer privacy. Entities providing information to credit agencies, falling under the definition of financial institutions, are bound by 15 USC 1681 section 604 ( a ) ( 2 ). This section dictates that a consumer reporting agency may only furnish a consumer report in accordance with the written instructions of the concerned consumer. The financial institution, as well as the consumer reporting agencies, lack my consent to furnish this information, and any form of consent, be it verbal, non-verbal, written, implied, or otherwise, is hereby revoked. 15 USC 6802 ( b ) ( c ) emphasizes that a financial institution may not disclose nonpublic personal information unless the consumer is provided an explanation of how to exercise the nondisclosure option. The entity providing information to credit agencies failed to inform me of my right to exercise this option. Furthermore, 15 USC 1681C ( a ) ( 5 ) prohibits consumer reporting agencies from including certain adverse information in consumer reports, particularly items that antedate the report by more than seven years. The adverse item being reported without my permission constitutes a violation of the law. Additionally, 15 U.S. Code 1681s2 ( A ) ( 1 ) states that a person shall not furnish inaccurate information to a consumer reporting agency. Furthermore, 15 U.S. Code 1681e mandates that every consumer reporting agency maintain reasonable procedures to avoid violations and limit the furnishing of consumer reports to specified purposes. XXXX XXXX, Equifax, XXXX, and XXXX are found to be non-compliant with these reasonable procedures. Lastly, in accordance with 12 CFR 1016.7, I am exercising my right to opt out of the reporting services provided by your organization. Also I am writing to address the charged-off status associated with my financial profile, citing the Fair Credit Reporting Act, specifically 15 USC 1601. This section asserts the charged-off account as a certificate of indebtedness, potentially considered as income. Given this classification, I kindly request the adjustment of my charged-off account to " Paid in Full '' to accurately represent the resolution of this indebtedness. This action not only aligns with legal principles but also ensures the proper reflection of my financial status on my credit report. Furthermore, in compliance with tax principles, income arising from the discharge of indebtedness in certain situations is not reportable. Therefore, marking the charged-off account as " Paid in Full '' would appropriately address the legal classification and adhere to the requirements set forth in 15 USC 1601.
