Consumer Complaint: I discovered a collection on my credit i did not know about. After completing my contract with XXXX a charge was added to the account that was later described as a equipment fee. I had no information of this debit and requested proof it was valid. I received nothing. After 60 days i again called and was given only a phone number to a collection agency named convergent. I called and spoke with them requesting proof i owed this debit and it was valid. I also placed a letter in the mail with these same requests later that day. I received nothing. After another 30 days i called back to make a final attempt to resolve the debit. The agent i spoke to offered me a settlement that included a complete deletion of the account from my credit report and a paid in full status. She made the case that the settlement was cheaper and faster than getting a attorney. Because this false debit was causing great hardship to my family by preventing the refinance of my home and the agent knew this i felt blackmailed into the arrangement. I agreed and gave my credit card number and awaited the documentation of this agreement in the mail. After another 30 days with no documentation, no deletion from my credit report, and no return communication from repeated phone calls i contacted my credit card company. They opened a fraud case. XXXX XXXX determined the false statements and deceptive agreements along with the complete absence of agreed documentation made by the agent to obtain my credit card number met their requirements for fraud and they promptly reversed the charges. The collection agency responded by placing a second collection on my credit report. So at this time they are reporting two accounts. Injuring my credit further. I am at this time reviewing local attorneys to begin legal action against the collection agency. They blackmailed me with inaccurate reporting info, lied to me to get my credit card number, provided not one piece of requested documentation, and falsely placed a second new collection account on my credit report. I have no documents as they refuse to send anything. If you need copies of the fraud finding by my credit card company i can produce that at any time. However absolutely no bills, letters, or documentation of this debit of any kind has been received by me at any time.

Consumer Complaint: In XXXX of 2016, while reviewing my credit report, I noticed a collection from XXXX XXXX XXXX for XXXX in the amount of {$700.00}. Upon further investigation I found the account was open with an address I never lived at & the social security number used was similar to mine. The 5th & 7th digits were incorrect. I immediately filed disputes with XXXX & XXXX. Both agencies responded " Result Verified-No Changes ''. I then filed an Identity Thief Report with the FTC and sent letters to XXXX request they provide copies of the paperwork used to open the account ; copies of bills with phone numbers called ; any & all information showing when, where & by whom the account was opened. I filed a total of 8 disputes with the Credit Bureaus & all that was resolved was the wrong. They continued to claim the account was mine, but stated they COULD NOT provide me with any information regarding their investigation. XXXX never responded to my letters. Today, I received a collection letter from XXXX XXXX XXXX How I need to start the letter writing process with Convergent.

Consumer Complaint: Convergent XXXX , placed an account on my credit report without FIRST notifying me of my right to dispute. XXXX They continue to forget the law as this is the 2nd time this company has done this to me. XXXX My rights say I have to be notified and given 30 days to dispute prior to placing the item on my credit report. XXXX Convergent XXXX collection practices are illegal and are continually being used on the American people. XXXX I called the company to see what was the bill. XXXX I was told that the bill was for XXXX XXXX and XXXX . XXXX I have not received a right to dispute. This bill has not been verified and validated. I do not have a contract with Convergent XXXX I am in the process of buying a home, and getting my clearance to work. XXXX Remove this incorrect collection immediately.

Consumer Complaint: I received a letter from XXXX XXXX, in an attempt to collect a debt, during the month of XXXX 2017 for an account opened with XXXX XXXX. I have never had an account with XXXX and I immediately called and told them I did not have an account and they told me I had to file a dispute and go into the bank and I did both. I filed a dispute online and went into XXXX local bank branch where they confirmed by social security number, address, and drivers license number to all be different from the account holder. They contacted Convergent and let them know but I then received a letter, dated X/XX/17, not only stating that this was a valid debt but also attached was this lady 's bank account information along with her driver 's license number and social security number! AFTER I told them I was not this lady they STILL sent out information to my address, which is completely different than my own in an entirely different state! I wonder how many other persons information they have given out unbeknownst to them. This has to be against the law and I want someone to know that they are not handling peoples ' personal information the right way. They should have called XXXX back to find out whether or not they had the right person before sending out this lady 's information.

Consumer Complaint: I was cancelling my service with XXXX in the first couple of days of XX/XX/XXXX.I asked what amount I owed for the few days of the month of XXXX. The lady told me that they could not compute that prior to the next month 's billing and I would at that time be billed only for the pro rated amount due. When I received a bill it did not have a pro ration. I called then told me they would correct that. When yet another bill came out, it showed a credit for that next month for approximately 90 % of the bill, BUT THEY SHOWED THAT THE ACCOUNT HAD BEEN CANCELLED IN A PRIOR MONTH, AND THEREFORE THE CREDIT WAS GIVEN AGAINST XXXX OWED, AND THEN I WAS BILLED ON THAT SAME BILL FORM the full amount of the previous month, it was shown as over due. ( That would be the month that the credit should have applied to, and it would have shown the correct amount due, and it would be the first time that I was given these figures and therefore could not be considered over due. I wrote a letter which has now been sent to different addresses for XXXX. I have never had a response to my letter, instead I have received pre recorded credit collection calls, the same one approximately six times per day. None of those were ones I could give this complaint to. One call did come in I could not get the number to call which referred to my letter, But no one was repeated where I could answer.

Consumer Complaint: CONVERGENT OUTSOURCING, INC. has never contacted me in writing regarding this time-barred debt. Cell phone debt has a federal statute of limitations of two years. After the statute of limitations has expired on a debt, it is considered time-barred.

In XXXX v. XXXX XXXX , XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX at XXXX [ XXXX XXXX ] and in XXXX XXXX XXXX XXXX. XXXX, XXXX XXXX XXXX [ XXXX. XXXX ], and its progeny, the courts have consistently held that FDCPA claims are viable where they are premised on a debt collector 's knowing attempts to collect time-barred debts. In these cases lawsuits were filed to collect the debts or lawsuits were threatened or " further collection action '' was threatened. That is precisely what defendant has done here. Defendant knowingly and fraudulently transferred a prescribed debt onto another account then refused to heed disputes by plaintiff and his counsel. Worse yet, defendant has initiated collection actions, including dunning plaintiff, based on the new account which balance is solely consisting of the prescribed account balance. This plainly falls under the further collection action prong of this analysis.

It is fairly settled law that filing suit on a time-barred debt is a clear FDCPA violation. The seminal case is XXXX v. XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX XXXX XXXX ). Also :

Consumer Complaint: On two occa sions this year, once in XXXX and once in XXXX I contacted Convergent Outsourcing to remove a debt from my credit file. I have never entered i nto a contract with Convergent so therefore by law they are not legally allowed to report to my credit report or attempt to collect on a debt. XXXX Convergent has since contacted me twice and stated they have verified my debt. But still no signed contr act between the parties. What they did send was a copy of a bill from XXXX therefore not validating the debt.
