Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: In the month of XX/XX/2019, I received a letter from Convergence Outsourcing Inc. regarding a re-aged debt Per Section 623 ( 5 ) ( A ) says : In general. A person who furnishes information to a consumer reporting agency regarding a delinquent account being placed for collection, charged to profit or loss, or subjected to any similar action shall, not later than 90 days after furnishing the information, notify the agency of the date of delinquency on the account, which shall be the month and year of the commencement of the delinquency on the account that immediately preceded the action. I immediately responded to Convergence Outsourcing Inc with an affidavit of denial ( not validation ) explaining this debt has been blocked per section ( 605b ) of the Fair Credit Reporting Act, an was the result of identity theft. Upon checking my credit report on XX/XX/XXXX I noticed this debt is now appearing on my credit report. These actions from Convergence Outsourcing Inc are clearly violations of consumer rights and unacceptable due to the fact the debt has been re-aged and also was the result of identity theft, and has already been blocked from the credit bureaus from a previous debt collector. This is my 2nd and final attempt to resolve this issue before pursuing litigation.

Consumer Complaint: I was a XXXX satellite service customer and in XXXX we planned to move to another home in the same neighborhood. I called customer service to ask my service to be moved to the new address. I was told there would be no additional charge for the move. After they hooked up service at my new address I received a bill from them for the move for {$370.00}. I disputed the bill with them and reminded them that their customer service representative told me there would be no charge for the move since we were already customers. Despite several calls to customer service and repeated requests for them to remove the charge, the charge was not removed. In XX/XX/XXXX we received a collections bill from XXXX XXXX XXXX for {$370.00} for XXXX. I disputed the bill by phone and I was told that they would contact XXXX and get back to me. They never responded. In XX/XX/XXXX I received a collections bill from XXXX XXXX for {$370.00} for XXXX. I disputed the charge again by calling XXXX XXXX. They stated they would speak with XXXX and call me with their findings. They never responded. In XX/XX/XXXX I received a collections bill from Convergent Outsourcing for {$370.00} for XXXX. I sent a letter this time on XX/XX/XXXX stating " If you believe that I am responsible for this debt please mail me a copy of the relevant documents. Please record that I dispute this debt. If you forward this debt to another company and/or report it to a credit bureau please indicate that the debt is disputed. '' I never received a response. Upon review of my credit in XX/XX/XXXX I saw that I had a collection reported for {$370.00} from XXXX XXXX for XXXX. I contacted XXXX XXXX by mail disputing the debt and making the same statement as I did in my letter to Convergent. They never responded. Upon checking my credit in XX/XX/XXXX I saw a collection reported by XXXX XXXX for {$370.00} for XXXX that states it was opened on XX/XX/XXXX and last reported XX/XX/XXXX. This charge has been disputed since XXXX. This collection is continually sold to different collection agencies and therefore reported as newly opened every year on my credit report since then. I have never received any response to my dispute of this debt from XXXX. I have never received a response from any of the collection agencies who have notified us of this debt.

Issue: Written notification about debt
Subissue: Didn't receive notice of right to dispute
Consumer Complaint: I was made aware of a negative mark on my credit by my credit union XX/XX/XXXX. This is an inquiry that has never been shown on my credit report prior to this day. I was unaware of the creditor as I appeared on my report as COI. After doing some research and calling around this is a company name Convergent Outsourcing , INC . I contacted this company and was told that this was a debt collector for a XXXX account from XXXX. I had not received a bill or notification of an additional bill. I also have never been told about any debt on my credit. I was never provided an account number. The representative XXXX stated that this debt was reported in XX/XX/XXXX over 5 years after this account was said to be opened. In 5 years I was not made privy to a debt owed. The lady proceeded to explain that for a payment of {$170.00} the debt would be settled as paid in full and that they would report to the Credit bureau as such to have this removed. I was not made aware that I had an option to dispute this matter, I was only told that a settlement payment would get this removed. The rep XXXX took a payment in the amount of {$170.00} and gave a confirmation # XXXX, XXXX advised that she would provide a " XXXX Balance " email and was provided my email. XXXX stated this information would also be mailed out. XXXX provide a phone number # XXXX and stated to look for the email in the next couple days and that the remark would be removed. I have not received an email of this letter to date in my mail or email. I called the company XX/XX/XXXX and spoke to a rep named XXXX and advised that I had not received the email I was told I would. XXXX asked for my information, first my telephone #, and name, she then tells me that she can not find me in their system. She ask for my social security # and tells me that she can not find me in their system. XXXX then tells me that she will have to get with her manager to find out what other ways they can check to see if I have an account. At this point I am concerned about several issues. This company is soliciting debt from consumers without providing proper information. Funds were exchanged no receipt was provided, no email of settlement provided, and now no recollection that an account exist for me. I am requesting that this be reversed, that I am refunded my money and that this be removed off my credit report, this is a violation of my rights as a consumer.

Subissue: You told them to stop contacting you, but they keep trying
Consumer Complaint: I noticed an increase in unknown calls, private, unavailable calls, calls from numbers I did not recognize starting in XX/XX/XXXX. I started keeping track of the numbers in XX/XX/XXXX and did some research and found two repeated numbers belonging to Convergent outsourcing Inc . They have called me on my home phone number and cellphone. I started to keep a log of the calls received XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX. I mailed a do not call letter - certified mail return receipt, which they received on XX/XX/19 - but they still kept calling. I called and have talked to them several times and told them to do not call me - but they still keep calling. I filed a lawsuit against them for violating the TCPA act and they received it on XX/XX/19 but they still keep calling. They continue to violate the TCPA by continuing to call me on my cellphone without my consent : I am not their debtor, and they have been notified in writing, by phone calls and by a lawsuit to stop calling but they still continue to call. I will be filing a second lawsuit on XX/XX/19 for the continued violations of the TCPA act and FDCPA compliance.
