Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: AXX/XX/XXXX I was billed for a XXXX XXXX Account that I never opened. XXXX had told me that they will close the account and send it to internal fraud. But, they sent it to collections. I later spoke with XXXX and Convergent ( debt collector ) several times. Convergent said they will close it. But I recently, XX/XX/XXXX, received two letters saying will settle for a reduced amount. This debt needs to be closed and removed from my credit report.

Consumer Complaint: I am a victim of identity theft. Due to the Corona Virus Pandemic, we are all facing which has me sitting still at home and I saw the recent news about the multiple XXXX Data breaches. I decided to look at my credit reports from the 3 major credit bureaus and found that someone had used my Identity. I have no idea how the theft took place. I also have no knowledge of any suspects. I did not receive any money, goods, or services as a result of identity theft. I contacted the Credit Bureau and told me to file an Identity Theft Report which I am doing. I appreciate your effort in getting this matter resolved. Thank you. Please let me know if you need any other information from me to block this information from my credit report. Thank you.

Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: Last Fall, I became aware of a company claiming I owe money on a telephone bill that is not mine. They were making derogatory reports to credit agencies. On XX/XX/XXXX, I challenged that company - XXXX XXXX XXXX - to prove this alleged debt was mine according to to the Fair Debt Collection Practices Act, something which I knew they could not do, and once they could not, that they would have to desist their activities. They sent me an invoice, pretending that this constituted proof of a debt. On XX/XX/XXXX, I responded with a Cease and Desist, with which XXXX XXXX XXXX failed to comply, so I filed a first complaint with FCPB where I prevailed. I forwarded all of this information to the alleged debt originator, XXXX, informing them that if it truly was them who was alleging this debt, they or their agents must comply with the law. The issue seemed successfully resolved. In XXXX of XXXX, I was contacted by Convergent Outsourcing, Inc. alleging a debt with XXXX. On XX/XX/XXXX I replied with an immediate Cease and Desist, informing them of the past events and that they and their alleged originator were still bound by the prior Cease and Desist and the findings of the FCPB. Today, XX/XX/XXXX, I received a letter from Convergent Outsourcing , Inc. claiming that they had " resolved my dispute and confirmed my debt '', once again submitting the unacceptable and illegal use of a simple invoice in lieu of the legally required signed document or court order - which of course does not exist - even though they had been served a Cease and Desist and not a dispute, and had already been informed that I was fully aware that an invoice was not proof. Moreover, any legal and legitimate collection agency would know that an invoice does not constitute proof of debt under the Fair Debt Collection Practices Act.

Consumer Complaint: I filed a complaint with this company a few weeks back. This company sent me reply to my concerns and mailed me a packet that shows a bill. This account does not belong to me. My phone carrier is XXXX and not XXXX. I NEVER had an account with XXXX and I am willing to provide the burden of proof in a court of law if I have too. I take my credit seriously and I will do whatever it takes to keep my credit in good standing. Please remove this account of my credit report before my next course of action concerning my credit reports.

Subissue: Debt was paid
Consumer Complaint: I was shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity. You have 30 days upon receipt of this letter to provide strict proof of contract. In the event you can not provide strict proof of contract, you must cease and desist any and all collection efforts and immediately remove any derogatory information reported to the consumer reporting agencies. In addition, you will need to provide me your agreement, in writing, that you are closing your file, ceasing collecting activity, and deleting all information related to this reference number from any and all credit reports youve furnished the information to. In the event you transfer this account to an attorney without providing proof of contract, and proving your claim, he/she will be immediate reported to the XXXX XXXX XXXX and XXXX XXXX XXXX for code of ethics violations.
