'' Fact, I so invoke nunc pro tunc, specified remedy under 15 U.S. Code 1692 ( c ) ( 2 ) and declare that the natural person, consumer in fact, original creditor, and I furthermore appoint XXXX XXXX XXXX, of Convergent Outsourcing, Inc. to quash all alleged, indirect, unverified debt, and set off, charge off and charge back all verified debt by herein extension of credit, so be it. The Fair Debt Collection Practice ( FDCPA ) states that the debt collector is mandated to cease all collection activity when verification is requested. Verification is defined as : confirmation of correct truth, or authenticity by affidavit or deposition. 15 U.S. Code 1692c ( a ) Communication with the consumer generally without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt. A cellphone is the main object of this matter and such phone was mailed back to phone company as I was instructed to. Consumer Complaint: Hi Convergent Outsourcing Inc ; / XXXX ; Im confused and stressed and shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Consumer Complaint: As far as I am aware, and due to the receipts I have, XXXX was paid almost two years ago directly before it ever went into collections. I called to request validation of the debt from Convergent on Friday ( the day I received the letter ) and it was then I realized they had blocked my personal cell phone from calling them ( due to the nature of my job ) and I made sure to call from my work phone immediately after to require an employee to hear the message I got on their recorded line. The call was made XX/XX/21 at XXXX CST and I spoke to XXXX XXXX After playing the message to her, she disconnected the call immediately. I decided to call again from my work number to see if it was an accident or if the same thing would happen, it disconnected after 8:55 minutes on hold. Not only do I have no knowledge of this debt, this company has made it impossible for me to contact them to pay them even if they validated the debt. I wrote them an email Friday at XXXX and requested validation of my debt including what exact service was being billed within 48 hours, they did not respond. I have no means to contact them if they keep blocking my numbers and I am requesting this be removed since I cant pay a company that blocked me. You are more than welcome to require them to provide the call made on the above date at the above time so you can see the proof behind what I've said.

Consumer Complaint: I had an outstanding balance with XXXX that I settled with XXXX XXXX XXXX in XX/XX/XXXX. Around XX/XX/XXXX I got a collection letter from Convergent regarding the same account. I initially thought it was sent in error since I didn't pay attention that it was a different collector, I just saw it was the XXXX acct & I had already gotten a proof of payment letter back in XX/XX/XXXX & with everything that was going on in the world I really just forgot about it. When I got another letter that's when I noticed it was from a different collector. I checked my credit report & saw the amount was back on my report but now Convergent was the name on it. I called Convergent in XXXX to get info & between speaking to them & XXXX several times I was eventually told my account was sent to Convergent from XXXX in XX/XX/XXXX because at that point it was still showing as owed in XXXX XXXX because that was before they received the confirmation of amount paid from XXXX XXXX. I spoke to someone at XXXX I was told was manager in the account recovery dept ( not sure if that was the exact name but was told they were dept that handled old accts that are sent to creditors ) & she verified she saw the amt on that account was paid in full & I had no outstanding balance with XXXX. Since XXXX I have made several calls, pretty much once every 4-6 weeks, to Convergent & have sent any & every document they request as proof of payment ( bank statements, proof of payment letter from XXXX ) but all they do is put it off on XXXX, ask me to send more or re send the documents I sent previously saying they didn't receive but the previous person I spoke to just the weeks/month before had verified receipt & said they needed time to review & reach out to XXXX. I have spoken to who I was told was managers who say they will review & get back to me but not one time has anyone done what they said they would
