Consumer Complaint: I had received forbearance on my student loans through Fedloan, but they refuse to update their reporting to indicate such. As per Section 623 ( a ) ( 2 ) of the Fair Credit Reporting Act and the FTC 's published opinion of that section, they are obligated to update that information. Forbearance acknowledges that no payments were due for that time period, and as per the FCRA and the FTC 's opinion on it's interpretation, Fedloan must reflect that status with its reporting of me. I have received forbearance for the period of XXXX XX/XX/XXXX as well as XX/XX/XXXX through the current date, and have letters and documentation from Fedloan indicating such. Despite trying to work with Fedloan multiple times, they have not admitted this obligation due to me as a creditor and refused to accurately report these accounts. This is preventing me from finding housing and unfairly adversely affecting my life.

Consumer Complaint: I applied to AES ( American Education Service ) for Covid-19 relief and was told that my two federal loans were not eligible for interest free forbearance as stated by the CARES act as signed into law by President Trump. I noticed primarily that in order top even apply, I had to spend over a half hour just to find the application page ; furthermore, the forbearance was only applicable for 3 months instead of 6 as the relief act states. I called and asked about the issues and was told that : 1 ) my loans were not eligible for the 6 month forbearance ( I have 2 federal loans listed ) 2 ) also, my interest during forbearance would continue to accrue during this period and just that the interest would not be capitalized at the end of the forbearance. I don't believe that is intent of the Covid-19 relief act and honestly is not really relief. I know others whos servicers are doing completely opposite with the same type loan which is no payment until XXXX and no interest during this time. Please look into auditing and addressing this with AES as they are not obeying Presidential mandate.

Consumer Complaint: This is now the 2nd time I have had to report inconsistencies from AES based on the actual balance of an account and my personal Credit Report. AES has yet to resolve the inaccuracy. Failing to correct this may result in a Civil Complaint being filed against AES for failing to provide accurate reporting to the Credit Bureaus. This is a serious concern when inaccurate information is either withheld, purposely falsified, or intentionally changed inaccurately or left unchanged inaccurately. As of XX/XX/2020, the Report is now 5 days inaccurate as a recent payment was established and resolved any delinquency on XX/XX/2020. Please make every coordinated effort to provide factual information to the Credit Bureaus, as this information is not correct, notwithstanding, this inappropriate series of inaccuracies justifies litigated action on my part, and AES risks that possibility.

Consumer Complaint: I have talked to XXXX and XXXX, I submitted Forbearance paperwork all could be done over the phone and yet this company insistss on inundating you with mail, emails but never a solution over the phone for some reason like every other federal student loan. Then they blatantly XXXX on my credit report claiming can not find me? When they just spoke with me numerous times on the phone and yet as a citizen of the United States XXXX and all credit companies can put what they want on your credit report and you have no recourse whatsoever. You are basically at the mercy, and held XXXX by Credit Bureaus. well I'm sorry but that is going to change. Once the president of the United States gets wind of what a AES is doing, and the credit bureaus, they'll have to answer to him! I will make him very aware of what AES has been doing and how many times they have called me and how many times I have requested the same thing over and over again with XXXX income for the past 3 years while I was a XXXX to my husband who is a XXXX XXXX recipient an XXXX recipient. What's worse, is the credit bureaus just take the word of these companies in ruin people 's lives well guess what we've got president that actually is going to do something for the little guy so I have a really good feeling about this.

Consumer Complaint: On XX/XX/2020, I received a letter from FedLoan, U.S. Department of Education, stating that " On XX/XX/XXXX, the President signed the CARES ACT ''. Through THE CARES ACT, FEDLOANS 'PLACED THE [ MY ] LOANS IDENTIFIED XXXX e.g. XXXX # XXXX ] IN AN ADMINISTRATIVE FORBEARANCE FOR THE PERIOD XX/XX/2020, THROUGH XX/XX/2020. '' 1 ). For a student to be placed in Forbearance, THE STUDENT MUST REQUEST and call FEDLOANS Servicing Center at ( XXXX ) XXXX. Upon a request of THE student, " General Forbearance is decided by the LOAN SERVICER '' " if the student is temporarily unable to make [ your ] scheduled monthly loan payments for the following reasons : & Financial difficulties ; & Medical expenses, & Change in employment & Other reasons acceptable to your loan servicer ''. 2 ) I NEVER REQUESTED A FORBEARANCE from FedStudent Loans Servicing. Although the CARES ACT serves as a protection for those students who experience a hardship during the Corona Virus Shut-Down, there are students LIKE MYSELF who are accepted in the PUBLIC SERVICE FORGIVENESS PROGRAM ( PSFP ). 3 ) I NEVER INTENDED TO FORBEAR MY STUDENT LOANS AS I AM COMMITTED TO PAY ON TIME 120 PAYMENTS IN ORDER MY STUDENT LOANS TO BE FORGIVEN. PUBLIC SERVICE FORGIVENESS PROGRAM ( PSFP ) DOES NOT RECOGNIZE FORBEARANCE AS A COUNTING PAYMENTS TOWARD A PERIOD FOR FORGIVENESS CONSIDERATION. 4 ). Consumer Complaint: Good morning Time and time again I have tried to discuss and have someone fix this. I have a student loan by XXXX the department of education which first garnish my payroll at {$40.00} weekly through a rehabilitation program and at the same time I had a separate $ XXXX monthly payment that is automatically paid. Neither those amount were neglected or default but time and time again this company reported me late and on default damaging my credit. Further I have completed my rehabilitation program. As of XX/XX/XXXX due to the pandemic the Care act was placed that states that all student loans should not be reporting negative to the credit bureau. The care act also states about {$0.00} interested and even forbearance to be put in placed. Yet on XXXX XXXX reported me negative decreasing my credit score damaging my chances to qualify for a home that I so much need. This needs to be stopped. I have complied with all the requirements and no one seem to care and continue addressing this matter with careless and rude behavior. My credit shouldn't be mark negativity from the beginning. XXXX has been recieving payments upon agreement. I need someone to seriously look on this matter because this is unacceptable and very dangerous to my credit and is affecting my living possibilities. I do not believe this company have treated me fairly from the start. I need someone to make them address this matter properly

Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: In this particular case, FedLoan had granted Administrative and General Forbearance on each of my accounts specifically for the time frame of XXXX to XX/XX/2017, this is also the time frame during which each of my Fed Loan accounts show as Past Due on credit reports from each of the credit bureaus. The purpose of the forbearance was to prevent the accounts from populating as Past Due - furthermore, it was explained to me by a FedLoan associate that by agreeing to Forbearance terms and interest rate changes, I would allow FedLoan to report a forbearance instead of a past due for this time period - which was entirely the purpose of agreeing to such terms - to prevent credit damage. It is therefore inaccurate for FedLoan to report this time frame as Past Due and for there to be no mention whatsoever of the Forbearance. The purposeful inclusion of Past Due and withholding of the Forbearance for the aforementioned time frame is both misleading, inaccurate, unethical, and predatory - and it places FedLoan in direct violation of the FCRA. FedLoan has not fulfilled its obligation to assure maximum possible accuracy of the information being reported. FCRA 623 ( a ) ( 2 ) stipulates that any information, once reported, must be promptly updated so as to maintain its current accuracy. In order to maintain current accuracy, FedLoan needs to remove all Past Dues being reported on my accounts from XXXX to XX/XX/2017 and assure that Credit Bureaus report this time frame as Forbearance instead. FCRA 623 ( a ) ( 1 ) stipulates that if information is reported, it can not knowingly be inaccurate or misleading - FedLoan has been made aware of this discrepancy on several instances and has refused to make any adjustments. Section 607 ( B ) of the FCRA requires CRAs to " follow reasonable procedures to assure maximum possible accuracy of information '' in their consumer reports. These discrepancies on my credit report have negatively impacted my life in ways I can not begin to explain. My credit worthiness outside of my experience with FedLoan is clean and blemish-free. The following accounts are reporting erroneous late payment information from XXXX through XX/XX/2017. These accounts are included in a hardship forbearance granted by FedLoan. The forbearance means that no payments are due and therefore no payments could be late on them. FedLoan can not state that the account is currently showing as Forbearance for that time period but continue to report that time period as Past Due.
