Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: Cares act directed all student loans to be placed in forbearance and allowed for refunds of automatic payments past XXXX XX/XX/2020. I requested the refund as the forbearance time did not affect my PSLF and payments would be made under the fares act. My email request was never answered but when I called 4 months later asking why it had not been acted upon they said it is always better to call directly. I explained that I had used there email option due to XXXX XXXX military move and they said always call. I am disappointed with the response in that they had an email option to request refund. I feel this is predatory in nature on fedloan.

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: I entered the Public Service Loan Forgiveness program about 6.5 years ago. My loan amount that was transfered was XXXX XXXX.They placed me in the Income based repayment ( IBR ) plan. From XXXX to XXXX of XXXX, I paid {$300.00} a month for student loan payments. In XXXX of XXXX, my payment jumped to {$550.00}. I called and complained. I was told that this was part of the forgiveness program repayment. I asked it they have a better plan that did not charge as much. I was told that this one was the most flexible. This went on until XXXX of XXXX when they jacked it up again to {$610.00}. I called and complained, again. They stated that if I fill out the IBR form to recertify, my payments would drop. I filled out the form and it took until XXXX to reduce it down to {$480.00}. At this time, I noted that my loan balance was {$48000.00}. In XXXX of XXXX, the payment went up again to {$520.00}. They raised it again in XXXX of XXXX to {$570.00}. It was explained to me when I entered the program that it freezes the interest and you pay down the principal balance so you basically get the interest forgiven.Looks like I am not getting even that. I have paid them {$34000.00} so far and yet I still owe {$36000.00} .The new recertify form is stating that my payments are set to go back up to {$600.00}. I have done the math, at this rate I will have paid off the loan with their repayment plan. In which case, there is NO LOAN FORGIVENESS!!

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I filed my annual Public Service Loan Forgiveness certification. Despite the period for certification being XX/XX/XXXX through XX/XX/XXXX and payments being on autopay but for the CARES act period, my fedloan only has certified 9 qualifying payments when it should show at least 12 qualifying payments. Their letter does not even mention the CARES act.

Consumer Complaint: I have been impacted by covid pandemic. We are unemployed both myself and my husband with no income. We barely have anything to pay home, utilities and food. The company was reached several times. They refused to give me forbearance or deferred on account of a pandemic. This is inconceivable. They are forcing me into making monthly payment with income that I do not have,. I wanted to request deferred for year until things get better hopefully by then I can resume my payments as described. They will force me into income then change the monthly as described in their forms.very deceptive .This is unethical and unjust when I am unemployed due to the covid pandemic. They found loopholes to say they dont fall under cares act. Claiming they are under banking ... This is contradiction, of which all banking institutions have given deferred on mortgages loans and credit cards. How do they justify these loopholes.

Consumer Complaint: I needed to renew my income driven Repayment Plan on my loans. I was paying a bit under {$30.00} a month and although my income changed a bit they are quoting me {$800.00} a month. After I was asked to resubmit the appropriate application and proof of income they quoted me {$280.00} but keep stating they do not receive my paperwork. I have mailed in by paper 2 times and uploaded all necessary paperwork on their web page 4 times. Each time being told that something was still missing. Today was the 5th time I am sending proof of income. I am told to call back on Thursday to see if it is received and if my payments will change ( for the 4th time ). Note to others out there : Always take names and dates of who you speak to and send mail certified.

Consumer Complaint: Under the CARES Act, student loan servicers are required to refund any payments made on eligible loans made after XX/XX/XXXX but before the Act was passed. I made such a payment on XX/XX/XXXX, but despite numerous requests to FedLoan servicing, I have not received a refund, nearly four months later.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: Fed Loan servicing is refusing to remove an inaccurate 90 day late mark on all three of my credit bureau 's reports in XXXX of XXXX on several of my loans. However, my letter that I received from Fedloan clearly states I was in Forbearance from XX/XX/XXXX - XX/XX/XXXX. I have disputed with all three credit bureau 's and Fedloan refuses to remove it even with the attached letter they sent to me with the dates clearly listed on the letter sent. They continue to report this as a 90 day late mark, stating I never entered into Forbearance until XXXX of XXXX. Section 623 ( a ) ( 2 ) of the FCRA addresses the duty to correct and update information by " furnishers, '' or persons who furnish information to consumer reporting agencies ( " CRA '' ) such as credit bureaus. In particular, this section requires a person that " has furnished to a consumer reporting agency information that the person determines is not complete or accurate '' to " promptly notify the consumer reporting agency of that determination '' and provide any information needed to make it complete and accurate. ( 1 ) Thus, on its face, this provision requires a furnisher to provide corrected or updated information to the consumer reporting agency that it had reported to originally. A furnisher that reports current information to a different CRA has done nothing to " correct and update information '' with CRA that possess the information that the furnisher has now determined is incomplete or erroneous. This duty extends to all student loan accounts reported to CRAs, regardless of whether they were accurate at one point, because the section requires the furnisher both to " update '' accounts as well as to " correct '' those that were erroneous when submitted to the CRA. At the time, even if my payments were late in XXXX of XXXX, and Fed Loan accurately reported them as late. Fedloan, later granting a forbearance for that time period, per the cited opinion, Fed Loan has the duty to update the accounts to show that there were no late payments given the account status of being in forbearance during the period late payments were originally reported.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: My previous complaint was recently closed and did not answer my question. I asked fedloan about why I am still being held responsible for 2 loans that clearly show the disbarment was cancelled and also states {$0.00} of {$2000.00} was disbursed & {$0.00} out of of {$1000.00} was disbursed, they stated the reason it shows cancelled is in regards to the second disbursement. However, when I view the loan period for said loans the dates show XX/XX/XXXX-XX/XX/XXXX. How could there be a second disbursement made in XXXX when thats after said loan period? Also, why were 2 of the 3 second disbursements cancelled and not the other? That does not make any sense how you would cancel 2 second disbursements but allow 1 other to be disbursed. If what your saying is accurate then I would be charged for a second disbursement ( that you claim was disbursed ) on my loan breakdown but it does not appear. Whats even more concerning is that at the top of the total loan breakdown it shows {$4800.00} total owed, {$1700.00} original amount awarded ( coincidently the same amount as ONE loan that was disbursed, ONE time. ) I am requesting all documentation relating to every disbursement that was ever made, cancelled or not, every cancellation and copies of the alleged second disbursement that was cancelled for 2 loans as well as the second disbursement that was successfully awarded.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: My student loans were reported delinquent on 90 and 120 days in XXXX of XXXX and XX/XX/XXXX. During tjis time my loans were on forbearance. As a reault my credit score dropped over 100 points. I contacted fed loan servicing and was told to send in the dispute form which I did roughly a month ago. My credit report was just updated and I was notified my dispute was closed, but the false negative reporting still remains.
