Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: On XX/XX/XXXX emailed the federal ombudsman 's office regarding my previous complaint on case # XXXX and I attached documents ( I have uploaded again here ) outlining my position. I do not know if that was received so I am returning to this site since it is where I initiated my case. Here is what I wrote regarding a response I received from FedLoan Serving : I would like my case reopened because the written response from FedLoan Servicing did not actually address the issue I have repeatedly raised. That issue is that if all of my loan payments are totaled, then in XX/XX/XXXX I made the 121st payment on my final 2 loans and the 122nd payment XX/XX/XXXX. I want those payments refunded because XXXX requires 120 payments. Attached is a letter outlining my position, along with the FedLoan response letter, their partial count of payments made after XX/XX/XXXX and a complete list provided me XX/XX/XXXX by a XXXX XXXX. Combining the lists and counting each payment I made on sequences 4 and 5 beginning XX/XX/XXXX shows that I made 120 payments so anything beyond that should be refunded. Multiple times FedLoan servicing has responded to my requests by giving me information that does not directly address the issue of the total number of loan payments. Again, please re-open my case and request that FedLoan Servicing directly address the issue that I have raised.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I contacted Fedloan Servicing in XX/XX/2020 and asked them to fix my paid ahead status payments to have them adjusted so they will count towards student loan forgiveness. I again contacted them in XXXX or XXXX and they told me they were still working on the request. Now it is almost 10 months later, and I am still waiting for these payments to be adjusted and counted towards my forgiveness. Also the payment count towards my subsidized and unsubsidized accounts are different, but should be the same. Please help me get the information I am requesting.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: I submitted a dispute letters in order to have accounts deleted because the information reported was incorrect. Instead of deleting the accounts they claim they updated information. There is no information updated or changed with the accounts I am disputing they still have incorrect information listed. I want every closed student loan account deleted from my report. The information being reported is inaccurate when I sent my dispute letters I sent proof along with the info as to why they needed to delete the loans off my report. Nothing was deleted claim to have updated the info but everything is exactly the same. It is their responsibility to report every account with accurate information and they have failed in this department.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: In XXXX, former President Obama announced the Public Service Loan Forgiveness Program. My wife and I lived in XXXX. I contacted Congressman XXXX XXXX XXXX office to find the link and gain assistance in submitting in the application. Over the next three years, I encountered numerous problems with the Department of Education ( DOE ). I completed the application six times. I submitted it six times. DOE officials stated the paperwork was not received electronically or by certified mail. DOE claimed the XXXX XXXX where I worked as a full-time XXXX did not qualify for the program. Yet, the nonprofit organizations with whom I volunteered or worked for as part of my community service obligations did quality. DOE claimed that I did not qualify for the program even though I made 120 payments. DOE again claimed that I filed for forebearance during this period or reduced payments which resulted in my denial. My wife and I moved to XXXX, Texas and I contacted Congressman XXXX XXXX XXXX office for assistance. This occurred in XXXX. His staff worked with me to coordinate my paperwork and obtain a consistent response from DOE. In XXXX, XXXX, I received a phone call from XXXX in XXXX XXXX, CA. Their representative, XXXX XXXX, stated that I was now approved to have 75 percent of my remaining student loans forgiven. Their organization contracted with DOE. I would pay {$510.00} for the next three months. My remaining student loan payment would be {$200.00} for the next few years. I agreed. However, my FedLoan account showed the reduction was not applied to the account. Congressman XXXX XXXX office staff worked with FedLoan, XXXX, and me periodically over the next nine months. A staffer finally inquired into XXXX. While their email address implied XXXX was a government agency, it was a third-party organization who had misrepresented themselves to me, to a Congressional office, etc. as part of DOE or held a contact with DOE to process such paperwork. At which point, FedLoan recommended that I contact the Consumer Financial Protection Bureau, the Federal Trade Commission, and the Texas Attorney General 's office and notify them of the situation. I had completed and battled with DOE for years over my application. How XXXX had access to my electronic information baffles me. They knew too much about what I owed and guaranteed that the remainder of my student loans were forgiven through the program. I would like the money I paid to XXXX returned. If it is possible, I would like DOE to finally acknowledge the receipt of the paperwork and apply not just the letter but the spirit of the law as was promised to me and countless others who dedicated their careers to public service.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: FedLoan servicing reported to XXXX this month that I was 120 days late on my student loan. I paid all my loans off with them as of XX/XX/2019 when I consolidated with XXXX. When I called them they told me they had not report to the credit bureaus since XX/XX/2019, which I proof that they have on my credit reports. They are impacting my credit since are report 16 accounts with them as currently 120 days late which they can not be since I OWED NO MONEY. They are impacting my ability to buy a home, buy a car or even if a job I apply to needs to look at my credit report. I want this mistake cleared ASAP

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I have sent over verification of my signature which showed that this account is not mine. I have sent several letters asking for verification of the debt sending a wet ink signature showing that this acct was signed for. They ignore my request and only send a letter asking if I want to try to apply for a loan discharge. When 99 % of people applying for this discharge has been denied. This is according to a current lawsuit against Federal Loan Servicing. They never responded to my letter and it's over 30 days. So they are in violation of FDIC and FDCA

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: Late XX/XX/2020 I received a letter telling me that Fed Loan servicing could not approve my public service forgiveness because my employer did not put his name and title on the public service employment certification form. I researched and saw that the information was indeed on the form. I called the FedLoan servicing company and asked why they sent me the letter because the information is on the form. The man I spoke with reviewed form I submitted and verified that the employer representative had included his name and title. He said he would correct the mistake. Today, XX/XX/2020, I received a letter dated XX/XX/2020 stating that FedLoan servicing could not approve my public service forgiveness because my employer 's EIN was missing from the form. This is NOT TRUE. The EIN is on the form. All required fields were completed on the form. I find it egregious and irresponsible that this organization is not properly doing its due diligence to ensure that they are properly managing consumers ' form when they send in the requested required paper work. Their ineffectiveness, incompetence, and inefficiency is causing me undue and unnecessary stress during an already stressful time ( Coronavirus pandemic ). I have attached a copy of the document that I sent to them. My PII is redacted.

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: I have called fedloan to use my spouses student loans to lower my payment to XXXX for the IDR I am currently in. I feel The amount that is given for a repayment plan should be XXXX. I am not sure what they used to recalculate my payment plan. My family is bigger and my from last years and my pay is almost the same. Everything is suppose to be considered in this. I want and explanation on what they used to calculate my repayment plan with the details and calculations. I had this same problem last year I had to call them to lower it to XXXX, but I am not sure why this is not happening now. I dont really like fed loan they are a very difficult company to rationalize with and they had an issue with reading paycheck stubs. This is very upsetting and annoying. I need documentation and supporting details on what is used with the calculations and how they came about the calculations. Also I never applied for deferments or forbearance I just did recertifications for my IDR. But here is what was said to be used to calculate my amount. Document provided. If anything is needed please dont hesitate to let me know.
