Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have been attempting to resolve denial of payments approved for the PSLF program for years. I previously was paying my loans through XXXX, then they were transferred to fedloan servicing. I have paid my payments on time in full, and because the tranfer, fedloan is denying qualifying payments due to computer or human error on their end. Please see email from fed loan. They state on loan sequence 6, one cent did not apply to payment XX/XX/2015 during tranfer and was applied to the following month. The other loans were approved for that same month. The rules for payment to be applied to XXXX is I must pay in full on time. I did this, and because fedloans error I am being denied. I have attached payments from XXXX showing I paid the full amount in both months. I do not have control over how the payments are applied to loan sequencing. I have additional months they are denying that they will not review or respond about.

Consumer Complaint: I am a victim of identity theft. Due to the Corona Virus Pandemic, we are all facing which has me sitting still at home and I saw the recent news about the multiple XXXX Data breaches. I decided to look at my credit reports from the 3 major credit bureaus and found that someone had used my Identity. I have no idea how the theft took place. I also have no knowledge of any suspects. I appreciate your effort in getting this matter resolved. Thank you. Please let me know if you need any other information from me to block this information from my credit report. Thank you.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: I've been disputing fraud accounts on my credit report since XX/XX/2021. I keep sending multiple sets of letters to the bureaus and the creditors so the excuse of " we didn't get it '' doesn't happen. Furthermore, each letter is certified mail with tracking and each letter shows signed and delivered and yet the bureaus are still not taking any actions. The accounts are not showing in dispute nor are they removed from my report. The accounts always show up with different name variations and different account number variations and yet the bureaus seem to ignore the trend and let these fraud accounts affect my credit score. I have requested the investigation to be initiated and also verifiable proof to be submitted should the account claim to be mine. Not only have I not received any mail showing the verifiable proofs needed to justify the accounts to be on my report, I haven't even received any letters at all stating the investigations have begun. Per the FCRA and federal law, the process is supposed to be 30 days. 130 days later, I'm still here shelling out money for certified mail with no end in sight and no results to show. This is my last option before I take this up with my lawyers and sue for full compensations and damages incurred. Finally, it seems that when these complaints are submitted, the bureaus are using the excuse that they " can't confirm my identity '' to get away with taking no actions on my credit report. Please investigate this as well.

Consumer Complaint: Fed Loan Servicing has violated my right to operate in commerce as a consumer, which is a violation of federal law. I have identified and made Fed Loan Servicing aware that my students loans are a consumer transaction. My social security card/number was used in order for this transaction to proceed. My social security card/number belongs to the Social Secuirty Administration and anything purchased with my social is the obligation of the United States Corporation according to Truth in Lending 15 USC 1601. A credit card ( as defined under 15 USC 1601 ( I ) the term credit card means any card, plate, coupon book, or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. Therefore under this definition by law this transaction makes me the original creditor. The FDCPA 15 USC 1692 never uses the term borrower, because there is no such thing as a borrower. You can not borrow your own money, and if referred to as a borrower in any contract is a violation of 15 USC 1692. Fed Loan Serving is a third party lender/bank/debt collector, and can not loan money or extend credit let alone attempt to collect a debt. I have expressed these violation and asked for a sworn affidavit and I submitted a debt validation letter which was signed and dated by a Fed Loan Serving Agent which is breaking federal law. They did not provide me with any documentation or provided any of my requests on my debt validation. Instead again referenced me as a borrower and XXXX XXXX as the authorized signature for the creditor. It is impossible for XXXX XXXX to be the original creditor and yet signed an official document stating otherwise. I have also requested the immediate cease and desist on reorienting to my consumer reports without my consent which is a violation of 15 USC 1681. Fed Loam Servicing has blatantly refused to acknowledge my consumer right in that regard and continue to report on my consumer/credit errors which is actively damaging my consumer reputation which is a violation of the FCRA.

Consumer Complaint: I've been trying to dispute matters with the student loans XXXX, SC State and Fedloan inaccurately reporting late payments. This been going on since XXXX 2021. They keep saying they don't have any late payments and I've been clearly sending them reports showing all the XXXX day late 's and its hurting my credit really bad. I had XXXX this year and it affected me tremendously but then I also had my loans consolidated recently. They are just reporting inaccurate information on my credit report and it has to stop. By law I have rights and they are abusing the credit law 15 U.S. Code 1666 ( b ). I need all those late payments removed from XXXX from XXXX, SC State and Fedloan because this is inaccurate information.

Consumer Complaint: American Education Service has been communicating incorrect information regarding my student loans qualification for Public Service Loan Forgiveness. In 2013, I enrolled in an Income Based Repayment Plan following being denied for Teacher Loan Forgiveness with them. I have been paying on the Income Based Repayment Plan since 2013, as a requirement for PSLF. Last summer I did some reading regarding loan forgiveness as I was planning to buy a home. I discovered that I had FFELP loans do not qualify for PSLF. These loans would never be forgiven as they are not Direct loans. Further, I needed to consolidate them as Direct loans with another company I contacted AES and made a complaint. I then consolidated my loans with Fed Loan Servicing, not knowing that these two companies are sister companies. I understand that it is my responsibility to read. However, I was following the recommendations of a specialized department that handled loans. I truly don't want to start over. I am seeking to gain those years back that I paid on IBR. Additionally, I am working with the sister company of AES, which is very concerning because they have been misguiding me for years. I have submitted a complaint with their Solutions Department and I have not received a response. I have also shared this with their sister company Fedloan Servicing. After continual sharing of my problem with Fed loan Servicing. A FedLoan representative shared that AES notes state that they recommended that I consolidate in 2013. This was blatantly untrue and I am concerned that FedLoan is covering for American Education Service. Additionally, despite receiving the alert that the Fed Loan was recording the call, they shared that I was not allowed to record the communication.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: On XX/XX/XXXX I consolidated all of my federal student loans with XXXX and made my first payment towards XXXX XXXX Loan Forgiveness ( XXXX ) on XX/XX/XXXX. In XXXX I learned that XXXX mistakenly did not consolidate all of my loans and my Income Driven monthly payments were being applied in pieces to multiple sets of loans. I immediately sent written complaints to XXXX The U.S Department of Education, and any other authority that could take action. My argument was XXXX XXXXs expectation to have me realize their mistake early on was illegitimate because my monthly payment was based on my income and knowing how they were applying it was not information that would benefit me given that it was XXXX I was pursuing. In XXXX of XXXX I received a letter from XXXX that indicated that they recognized the error they made and I was informed that all of my loans were now consolidated into one ( as I originally requested in XXXX ) and that every payment I made would be retroactively based on my XX/XX/XXXX consolidation. What this means is that my XXXX clock should have began XX/XX/XXXX on my entire student loan file. Please see attached letter. When I recently moved my loans over to Fedloan Servicing ( as required for XXXX ) and requested the status of my progress towards XXXX they sent me a chart indicating 11 different Federal Loans with three different estimated dates to qualify for XXXX. The estimated dates of qualification range from 16 months to 21 months after the date I had in my mind of XX/XX/XXXX ( 120 months after my first payment post-consolidation on XX/XX/XXXX ). The letter I received from XXXX in XXXX is attached. I should have one date of expected eligibility, not 3. And that date needs to be on or near XX/XX/XXXX, not XX/XX/XXXX like the estimate I received in the mail states. Please assist.

Consumer Complaint: Consolidated all qualifying loans with Fed Loan on XX/XX/XXXX. Started working for eligible PSLF program starting XX/XX/XXXX through XX/XX/XXXX. However, Fed Loan states that XX/XX/XXXX " You Do Not Have A Bill Due For This Payment Period '' and XX/XX/XXXX " You Do Not Have A Bill Due For This Payment Period '' therefore are not counting these two months as a part of the 120 months for payment which doesn't make any sense as I was working for a qualified employer since XX/XX/XXXX. Fed Loan also states that from XX/XX/XXXX - XX/XX/XXXX my employment isn't certified even though I fill out the recertification of employment annually without missing any steps to keep record of the count. I recently filled out the recertification form ( XX/XX/XXXX ) to re-certify the same employment I've been working at since XX/XX/XXXXand was emailed " We will process your Income-Driven Repayment ( IDR ) recertification request once the final bill of your current schedule is generated on XX/XX/XXXX. '' This statement also doesn't make any sense as my final bill shouldn't be until many years down the road. I would like an updated official count on my PSLF loans before my loan is transferred to another servicer. Thank you.

Subissue: Received bad information about your loan

Consumer Complaint: On XX/XX/XXXX, I submitted a complaint about PHEAA ( FedLoan Servicing ). I noted that they miscalculated my eligible payments for the TEPSLF program. PHEAA responded on XX/XX/XXXX stating " you called your loan servicer, XXXX XXXX XXXX, on XX/XX/XXXX to request an alternative repayment plan. Effective XX/XX/XXXX you began repaying your loans under the XXXX XXXX XXXX XXXX. This continued until XX/XX/XXXX when you requested to change your repayment plan to the Income-Based Repayment ( IBR ) plan with XXXX. '' This information is inaccurate. I was on an alternative repayment plan from XX/XX/XXXX to XX/XX/XXXX. However, I called XXXX XXXX XXXX in XX/XX/XXXX to request a Standard Repayment plan. Starting on XX/XX/XXXX, I was on a Standard Repayment Plan. This continued until XX/XX/XXXX. In XX/XX/XXXX, I requested to change my repayment plan to the Income-Based Repayment plan with XXXX. I have been on the Income-Based Repayment plan since XX/XX/XXXX. Therefore, all of the payments that I made from XX/XX/XXXX to present are eligible payments for TEPSLF since I was on a Standard Repayment plan from XXXX XX/XX/XXXX and then an Income-Based Repayment plan from XX/XX/XXXX to present. The uploaded documents clearly show that I was on the Standard repayment plan from XX/XX/XXXX to XX/XX/XXXX. I have each letter documenting this from all of the loan servicers that I have had during that time frame. You can see the documentation of a Standard Repayment plan on the second page of each document. I have applied for TEPSLF three times in the last two and a half years and have been wrongfully denied each time. It is vital that PHEAA fix this error immediately since this program is temporary and is first-come first serve. Once the funds run out, I will not be able to claim what I am rightly entitled to based on my qualification for the program. I have met all requirements for the program. I have been terribly wronged here and have spend countless hours trying to remedy a problem that should have never occurred. Every time I try to address this with PHEAA they keep giving me more inaccurate information. This is completely unfair and should be addressed immediately. I am entitled to have my loans forgiven.
