Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I have spoken to FedLoans multiple times about incorrect payments for PSLF. I requested recount 2 years ago and received an email on XX/XX/XXXX but many of the payments were still incorrect. I asked for a new recount on XX/XX/XXXX, and still have not received this. Many of my loans had bills created without credit given making my PSLF counts discrepant. All were paid via automatic direct deposit with some loans being credited and others not. Further, I was put into deferment by XXXX XXXX against my request, and payments from XXXX - XX/XX/XXXX have variable counts across my 13 different loans. I would like this explored and payments to retroactively count for PSLF.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: I raised this in Complaint # XXXX ; however, the company wholly ignored this issue. I am now forced to file a new complaint because CFPB closed that complaint. I have been working with FedLoans ( PHEAA ) to get several monthly payments counted as qualifying payments towards PSLF for several years : In XX/XX/XXXX, I requested that my then-current loan servicer, XXXX XXXX, apply a loan interest reduction under the Servicemembers Civil Relief Act ( SCRA ) since I was serving on XXXX XXXX in the XXXX XXXX XXXX XXXX In that letter, I specifically stated that I did not want to enter into a military forbearance. However, XXXX XXXX placed me into a military forbearance against my wishes. This caused my loans to be in a military forbearance from XX/XX/XXXX through XX/XX/XXXX. ( More info below ). In XX/XX/XXXX, my loans were transferred to XXXX XXXX. In XX/XX/XXXX, I worked with XXXX XXXX to correct its mistake. XXXX XXXX requested that the Military Forbearance be removed from my account and that the $ XXXX/month XXXX payments be counted toward PSLF. Finally, in XX/XX/XXXX, FedLoans removed the military forbearance for the period of XX/XX/XXXX through XX/XX/XXXX. As a result, my qualifying payments were recalculated to include XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX to count toward PSLF. However, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX were not counted as qualifying payments even though those were still {$0.00} XXXX payments. I made several inquiries about why those three months were not counted, and I have never received an update. I have contacted FedLoans about this issue with no resolution. I supplied copies of the paper work from XXXX XXXX to XXXX XXXX in that complaint. I then contacted the FedLoans Ombudsman after hearing nothing. I still have heard nothing.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: I applied for the loan forgiveness program in XX/XX/2021. I explained to the representative that we are not in the office plus PII can not be sent over email, so I asked the question of what can I submit for verification. She stated my W2. Thus, I submitted a W2 for my previous Government jobs and my current job at a non-profit. In XXXX, I received a stating Not Eligible, and they did not evaluate the eligibility of my current employer. When I called customer service, they stated my current employer is on hold in the system, but could not explain anything else. On XX/XX/XXXX, I received another request to submit the certification for my current employer because they are open. Thus, I sent the certification with signature on XX/XX/XXXX. I called on XX/XX/XXXX checking on the certification, and the representative said it was scanned in because of the volume of application and the process will take longer. As I explained to her, I am receiving misinformation and this process is confusing. I did everything each representatives requested and the process was wrong.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Investigation took more than 30 days

Consumer Complaint: 1. FEDLOAN Account XXXX Please correct this inaccurate information on my credit report. I recently pulled my credit report from your Bureau and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 90 days late on this account in XX/XX/XXXX and 120 days late in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX as well as 150 days late in XX/XX/XXXX. I immediately disputed this information with FEDLOAN and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( XXXX ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. 1666a. Regulation of credit reports ( a ) Reports by creditor on obligor 's failure to pay amount regarded as billing error After receiving a notice from an obligor as provided in section 1666 ( a ) of this title, a creditor or his agent XXXX not directly or indirectly threaten to report to any person adversely on the obligor 's credit rating or credit standing because of the obligor 's failure to pay the amount indicated by the obligor under section 1666 ( a ) ( 2 ) of this title, and such amount may not be reported as delinquent to any third party until the creditor has met the requirements of section 1666 of this title and has allowed the obligor the same number of days ( not less than ten ) thereafter to make payment as is provided under the credit agreement with the obligor for the payment of undisputed amounts. ( b ) Reports by creditor on delinquent amounts in dispute ; notification of obligor of parties notified of delinquency If a creditor receives a further written notice from an obligor that an amount is still in dispute within the time allowed for payment under subsection ( a ) of this section, a creditor may not report to any third party that the amount of the obligor is delinquent because the obligor has failed to pay an amount which he has indicated under section 1666 ( a ) ( XXXX ) of this title, unless the creditor also reports that the amount is in dispute and, at the same time, notifies the obligor of the name and address of each party to whom the creditor is reporting information concerning the delinquency. ( c ) Reports by creditor of subsequent resolution of delinquent amounts A creditor shall report any subsequent resolution of any delinquencies reported pursuant to subsection ( b ) to the parties to whom such delinquencies were initially reported. 1666b. Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). I DEMAND to see proof that I was mailed my statement to the correct address notifying me of both payment due date and delinquency of payment on the account. If you can not provide 100 % Verifiable proof and proper documentation that the CREDITOR fulfilled its obligations under the ( FCBA ) and ( FCRA ), I therefore demand these late payments be removed from my account or I will be forced to be in contact with the Attorney General of my State and the Consumer Financial Protection Bureau. I therefore am submitting my written request to you to conduct an investigation. Per the FCRA, you have 30 days to conduct this investigation and respond to my request. If you do not respond within this time period, per the FCRA, you must remove this negative information. Thank you for your time, XXXX XXXX SS # : XXXX Date of Birth : XX/XX/XXXX XXXX : Consumer Financial Protection Bureau XXXX XXXX XXXX XXXX XXXX, Iowa XXXX

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I have made all required monthly payments to my consolidated loans ( currently serviced by FedLoan ) while employed by a an eligible nonprofit employer for almost 10 years, and 31 of my payments have been classified as ineligible. I have followed all loan servicer instructions and directives and documentation from federal agencies precisely as they existed at various times over the past 9+ years, so am deeply confused and concerned that many payments are ineligible. Multiple payments classified as ineligible by FedLoan have been under " manual review '' for over a year with no change. In XX/XX/2021 I submitted my annual certification in an attempt to have my payments reviewed for both XXXX and XXXX eligibility with no change. I formally requested that the other ineligible payments be manually reviewed earlier this summer with zero change in status. Please note that I have faithfully paid my required payments every month for almost 10 years ( 9 years 9 months ), stayed in eligible full-time employment ( 2 non-profit employers total ), in the good faith belief that I would qualify for federal loan forgiveness at the 10 year mark as described by all program documentation. As of XX/XX/2021, after 9+ years of payments, I have paid {$42000.00} of the original principle balance of {$64000.00}, and have a remaining loan balance of {$45000.00}. According to FedLoan, I have 40 remaining payments under XXXX and 31 remaining payments under XXXX. This is outrageous, and I ask that my payment history be reviewed and my " ineligible '' payments be reclassified as eligible and my payment summary updated accordingly.

Issue: Dealing with your lender or servicer

Subissue: Need information about your loan balance or loan terms

Consumer Complaint: I am having trouble with what should be simple - figuring out how much my monthly payment will be. They also applied a payment I made to the principal instead of the interest ( even though the payment checkout says payments are applied first to interest ) and I was never able to find anyone to talk to about this. My servicer, FedLoan, has an error message when I try to access repayment options/payment on their online portal saying " this information is not available. '' I try to email them ( once in XX/XX/2021 and once in XX/XX/2021 ). I try to go to the chat option to see if I can talk to someone and I have tried this maybe 30 times ( I check a few times a day for weeks ) and they have never had anyone available. I think the chat function does not really exist. So I try to call them ( almost 10 times ) during their business hours. The automated line does not even provide an option to speak to someone but I eventually figure it out by pressing 0. They never have a representative available and say they will call you back. When the call back rings, and I pick up, it " buzzes '' and then automatically hangs up. I also sent them a XXXX message. I have yet to receive a response or speak to anyone about what my expected monthly payments will be. How am I supposed to know how to budget for it and when it is due?

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: Just wanted to share a story- I have a private loan with American Education Services from way back in XXXX. In the last 10 years of consistent repayment, I have now paid {$7200.00} on a {$6200.00} loan. According to AES, I still owe {$6200.00} - which is more than my original loan even was. How is this remotely right? They've got their money back plus {$1000.00} - are there advocates for student borrowers like me?
