Issue: Getting a loan or lease
Subissue: Fraudulent loan
Consumer Complaint: I filled out a credit application for a vehicle. Based on the negative equity and credit, the dealer said I needed a strong co-signer. My fianc who had a 730+ plus score co-signed the loan. The dealer came back with 11.5 percent with my fiance as the primary. I believe there was predatory lending going on. Looking at my paperwork, I dont understand how someone with excellent credit could end up with 11.5 % apr. the Dealership is XXXX XXXX XXXX of XXXX North Carolina. Consumer Complaint: This complaint is regarding a delinquent reporting made by Santander Consumer USA. After paying this car loan for over 5 years this company is stating that the final payment on the loan was required at the maturity date there was an amount of {$100.00} that was due. I informed the office that no one sent me a letter stating that the loan was maturing and the payment would have to be made by that date because I would have sacrificed to pay it. As I informed the company we are going through a pandemic and even with the loss of income I have never been late with a payment. This reporting has reduced my credit score between 21 to 32 points amongst all credit bureaus and I contacted them and requested for this reporting to be deleted. The car has been paid off. I have explained that I am trying to financed another car because the current car is very old and is not operational. I have explained that this reporting is affecting me and they have completely ignored all request and are the least bit concerned about the issues. I have never been late with a payment, it was an oversight with the maturity date because this car was purchased over five years ago and Santander has never explained that it had to be resolved by the maturity date or else I could be impacted. Even with the pandemic they have dismissed all request. Im seeking CFPBs help in getting this matter resolved

Subissue: Investigation took more than 30 days
Consumer Complaint: I have sent four letters to this company to verify the debt via certified mail and they have not responded to me at all. Per the Fair Credit Reporting Act if a company does not verify a debt within 30 days they have to remove it which I have confirmation with the USPS that they have received multiple letters from me and they have failed to response with any information verifying the debt showing my signature and that I owe them any money. They also have failed to remove the account from my credit reports.

Consumer Complaint: Contacted Santander in reference to a vehicle loan in XX/XX/2020. The vehicle was totaled 2 years ago however after the insurance company paid them {$15000.00} Because of the extreme interest I still had a balance of {$8000.00}. Ive paid until until the Shelter in place order in GA came up. I called them in good faith to settle this account since I dont have the car and just want to make good, but was denied a good option. I sent a request on Social media ( XXXX ) and to spare themselves the publicity someone reached out promptly with an option of reducing my payment by {$1.00} per month. I reached out again on XX/XX/XXXX and to escalate this matter and yet to receive a response in which I received an automated response stating Someone will contact me in 24 to 72 hours and weeks later nothing.
